About this file

This is a capital construction contract template issued by the State of Colorado, Department of Natural Resources, Colorado Division of Parks and Wildlife, for construction projects managed through the Division of Parks and Outdoor Recreation. The template establishes the framework for capital construction work to be performed according to specifications and plans to be detailed in specific project solicitations. The contractor is required to begin work within ten days of receiving a "Notice to Proceed" and must complete all specified work within a timeframe designated in the Invitation for Bids, with time being of the essence in contract performance. The contract documents incorporate by reference the General Requirements and Covenants for Capital Construction published in 1996 and supplemented in January 2002, along with project-specific specifications, drawings, and the contractor's proposal. Work must be performed in a first-class, substantial, and workmanlike manner to the satisfaction of the State and its Architect/Engineer.

The contract amount will be established based on the specific project bid and is subject to adjustment through Final Quantities Contract Modification Agreements for estimated quantities of work and materials. The contractor is responsible for all material costs and labor expenses and must maintain workers' compensation and unemployment compensation insurance as required by law. The State reserves the right to collect liquidated damages if the contractor fails to complete work within the allowed timeframe. All contracts require approval by the Colorado State Controller before becoming valid, and the contractor is prohibited from beginning work until such approval is obtained. The contract is not assignable without written consent of both parties, and the contractor must indemnify the State against claims and damages resulting from any acts or omissions by the contractor or its agents.
