JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

(FAR 6.303-2)

1. IDENTIFICATION OF THE AGENCY AND THE CONTRACTING ACTIVITY

Requiring Activity:

2. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED

Pursuant to FAR 6.301(b) the action being approved is a Justification and Approval for Other Than Full and Open Competition to procure: brand name specific “WebSmart” Services.

The procurement of this data subscription service is necessary to support DLA’s continued operations and management of the CAGE system and WebCAMS. Data subscription service will allow DLA to assign new CAGE Codes and maintain CAGE profile data.

CAGE data supports the worldwide logistics community and numerous government procurement, contract, and financial systems. Each CAGE Code identifies the physical location of a registered manufacturer, contractor, service agency, or entity who wishes to do business with the U.S. federal government, NATO members, and approved foreign countries.

3. A DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET

THE AGENCY’S NEEDS (INCLUDING THE ESTIMATED VALUE)

DLA has a requirement to obtain the following WebSmart Service data subscription service in support of its assignment and management of CAGE Codes:

The estimated cost of this requirement is for a twelve (12) month Base Year beginning on June 15, 2025 – June 14, 2026 and two (2) twelve (12) month option periods.

4. AN IDENTIFICATION OF THE STATUATORY AUTHORITY PERMITTING

OTHER THAN FULL AND OPEN COMPETITION.

Identification of the exception to fair opportunity (see 16.505(b)(2)) and the supporting rationale, including a demonstration that the proposed contractor’s unique qualifications, or the nature of the acquisition requires use of the exception cited. The statutory authority permitting other than full and open competition is Title 10, U.S.C.

2304 (c) (1), as implemented by the Federal

Acquisition Regulation (FAR) 6.302-1, only one responsible source as referenced by the brand name citation “WebSmart.” and no other supplies or services will satisfy agency requirements

5. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE

QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES

THE USE OF THE AUTHORITY CITED.

Brand name WebSmart data subscription services are essential to the Government’s requirements, and market research indicates other companies’ similar products, or products lacking the feature, do not meet and cannot be modified to meet the Government’s needs. A brand name item, whether available on one or more contracts, is an item particular to one manufacturer and may be procured by brand name specification if essential to the Government’s requirements. The Brand Name Descriptions for this acquisition effort, which is WebSmart is essential in order for the Government to meet mission requirements and no other item can meet the Government’s needs.

DLA requires US and Global/World-Wide address information data subscription services and continues to evaluate said data subscription services through technical research, system testing and vendor demonstrations.

At this time WebSmart is the product that provides address confirmation drawing from all valid resources across the globe and is able to differentiate between the physical address (required by CAGE) and mailing address (not allowed in CAGE unless the physical and mailing addresses are equal values) and is able to identify what type of physical address is allowed (for example an UPS drop box is not allowed). In addition to worldwide addressing, WebSmart can validate legal names, geo-codes, point of contact within the company, phone number, and email addresses. The Melissa services are updated frequently so CAGE is pulling the most up-to-date information possible from the data subscription service. Lastly, CAGE has been running a pilot program for one full year to ensure that data from WebSmart can be used and is correct. Our Audit Readiness steps incorporate the WebSmart product/schema, and this has been accepted.

While there are other products that provide address/contact data WebSmart is the only product that has all the features and capabilities required of a robust validation required of the Federal Registration process and by CAGE.

The WebSmart data subscription service is proprietary to Melissa Data and is only available through Melissa Data Corporation and no other software OEM can provide such services.

6. A DESCRIPTION OF THE EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS PRACTICABLE,

INCLUDING WHETHER A NOTICE WAS OR WILL BE PUBLICIZED AS

REQUIRED BY SUBPART 5.2 AND, IF NOT, WHICH EXCEPTION UNDER 5.2

APPLIES

In accordance with FAR Part 6.2 “Full and Open Competition after Exclusion of Sources,” fair opportunity will be provided to all contract holders within GSA and open market.

7. A DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND

REASONABLE.

As the Contracting Officer, I hereby determine that pricing will be fair and reasonable based on pricing analysis in accordance with FAR 15.404-1. It is anticipated that the Government will use various price analysis techniques including, but not limited to: 1) comparison of proposed prices received in response to the solicitation (FAR 15.404-l(b)(2)(i)); 2) comparison with competitive published price lists (FAR 15.404-l(a)(2)(iv));

and 3) comparison of proposed prices within prices obtained through market research of the same or similar items (FAR l 5.404- l(b)(2)(vi)) in order to obtain a fair and reasonable price. The contracting officer will determine prices fair and reasonable prior to award using price history, IGCE, and published price lists (if available).

8. A DESCRIPTION OF THE MARKET RESEARCH CONDUCTED, AND THE

RESULTS, OR A STATEMENT OF THE REASON MARKET RESEARCH WAS

NOT CONDUCTED

The WebSmart data subscription service is proprietary to Melissa Data and is only available through Melissa Data Corporation and SHI. Per Melissa Data, SHI will not compete against Melissa Data on government contracts. No other software OEM can provide such services.

9. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO

REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE

ANY SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES

REQUIRED

J6 is required to conduct ongoing reviews of IT solutions in order to keep abreast of new technology, in both Government and private sectors. Whenever substantial improvement over presently identified solutions is demonstrated, DLA will continue to use the best product(s) and service(s) for their mission requirements. DLA has and continues to exercise competition as often as possible. DLA has always used a variety of vendors, manufacturers and contracts to fulfill its requirements.
