About this file
This is a Justification and Approval for Other Than Full and Open Competition (FAR 6.303-2) document for a sole-source bridge contract. The Department of the Interior's National Park Service at Lake Mead National Recreation Area (LAKE) seeks a one-year trash collection contract valued at an undisclosed amount. The contract, to be awarded to incumbent Boulder Disposal under FAR 6.302-2 (Unusual and Compelling Urgency), will run from March 1, 2026 through February 28, 2027. Services include collection and maintenance of 133 solid waste containers and 29 single-stream recycling containers across the north district of Lake Mead in both Nevada and Arizona areas. The bridge contract was necessitated because the current contract (140P8121C0002) expires February 28, 2026, the Government could not evaluate extension pricing at the time of award, and a 43-day government shutdown beginning October 1, 2025 prevented timely procurement of a planned five-year follow-on contract. Without this bridge contract, a lapse in service would threaten park employee and visitor health and safety.
The contracting officer determined the estimated rate is fair and reasonable by comparison to similar competitive contracts: the Mojave National Preserve trash services contract and the Katherine Landing trash services contract. Boulder Disposal was selected as the sole source based on being the local trash services provider with limited vendor options in the market due to industry constraints and the contractor's continuous outstanding performance. Market research was not conducted due to the unusual and compelling urgency exception. The NPS plans to issue a competitive solicitation for a five-year follow-on contract in summer 2026. The justification was certified by Contract Specialist Caleb Overbaugh, approved by Contracting Officer Caroline Bachelier, reviewed for legal sufficiency by Attorney-Advisor Karen Glasgow, and approved by Chief of the Contracting Office Lilette Baltodano on January 22, 2026.

JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION
Over SAT (FAR 6.303-2)
PR Number: 44036438
1. Identification of the Agency and the Contracting Activity:
Department of the Interior, National Park Service, ConOps West, LAKE MABO, Lake Mead National Recreation Area (LAKE)
2. Nature and/or Description of the Action Being Approved:
1-year sole-source bridge contract for the LAKE North Trash Services Contract. The current contract, 140P8121C0002, expires on February 28, 2026. A 5-year follow-on contract (a base and four option years) is estimated at $ . The Government intended to extend the contract using the FAR 52.217-8 clause included in the contract; however, it was found that the pricing for the 6-month extension had not been evaluated at the time of award. Additionally, because of the unprecedented 43-day Government shutdown starting October 1, 2025, there was insufficient time to perform the acquisition for a new 5-year contract. This 1-year bridge contract will prevent an imminent lapse in service which would pose a threat to the health and safety of the Park employees and visitors.
This contract will be awarded under the Authority of FAR 6.302-2, Unusual and compelling urgency, and will result in a firm-fixed price purchase order to Boulder Disposal for continuation of trash services. The period of performance for this contract will be 12 months, from March 1, 2026 through February 28, 2027.
3. A Description of the Supplies or Services Required to Meet the Agency’s Needs, Including the Estimated Value:
Trash collection services at the north district of Lake Mead National Recreation Area with an estimated value of $ . The contractor shall provide and maintain 133 solid waste containers, 29 single stream recycling containers and replacement containers for the life of the contract. Services will occur in both Nevada and Arizona areas of Lake Mead.
4. An Identification of the Statutory Authority Permitting Other Than Full and Open Competition:
FAR 6.302-2 Unusual and compelling urgency; statutory authority 10 U.S.C. 3204(a)(2) or 41 U.S.C. 3304(a)(2).
5. A Demonstration That the Proposed Contractor’s Unique Qualifications or the Nature of the Acquisition Requires Use of the Authority Cited:
The incumbent contractor, Boulder Disposal, is the local trash servicing provider for the covered area. Trash services tend to have very limited vendor options due to the nature of the industry with usually only one or two vendors that serve an area. Boulder Disposal is a small business that offers these services for the area and has continuously provided outstanding performance under the current contract.
6. A Description of Efforts Made to Ensure That Offers Are Solicited From as Many Potential Sources as is Practicable, Including Whether a Notice Was or Will Be Publicized as Required by FAR Subpart 5.2 and, If Not, Which Exception Under FAR 5.202 Applies:
In accordance with FAR 5.202(a)(2), the contracting officer does not need to publicize under
5.201 if the proposed contract action is made under the conditions described in 6.302-2 and the Government would be seriously injured if the agency complies with the time periods specified in
5.203. For the reasons noted above, the contracting officer finds that the Government would be seriously injured if this justification first had to be publicized with a waiting period for responses before taking this action of extending the expiring contract.
7. A Determination By the contracting officer That the Anticipated Cost to the Government Will Be Fair and Reasonable:
The anticipated cost of $ was based on 6-month pricing provided by boulder disposal while investigating the option to extend the term of the contract under FAR 52.217-8. The contracting officer has determined that the cost to the Government will be fair and reasonable by comparison to rates for other similar competitive contracts. With 152 total dumpsters, the estimated rate for this contract is $ per dumpster for 1 year. 140P8125P0046, the current trash services contract for Mojave National Preserve, has a rate of $ per dumpster for the year and 140P8124P0053, the current Katherine Landing trash services contract rate is $ per dumpster for the year. The estimated rate for this contract is in between the rates for these other two contracts, making it a competitive rate compared to rates that were determined fair and reasonable in competitive solicitations. In accordance with FAR 13.206-3(a)(2) a more formal price analysis will be performed and documented in the file when the proposal is received.
8. A Description of the Market Research Conducted (see FAR Part 10) and the Results or a Statement of the Reason Market Research Was Not Conducted:
In accordance with FAR 10.003, market research was not conducted for this requirement because of its unusual and compelling urgency and the limited amount of time the NPS has to avoid a lapse in services. The incumbent, Boulder Disposal, is available to provide the services required for the health and safety of the park employees and visitors.
9. Any Other Facts Supporting the Use of Other Than Full and Open Competition (see FAR 6.302-2
(9) (i) – (iii) for some examples):
N/A
10. A Listing of the Sources, If Any, That Expressed in Writing, an Interest in the Acquisition:
No other sources were identified for this extension as this is being awarded under unusual and compelling urgency.
11. A Statement of the Actions, If Any, the Agency May Take to Remove or Overcome Any Barriers to Competition Before Any Subsequent Acquisition for the Supplies or Services Required:
The NPS is in the process of preparing a competitive solicitation for a 5-year follow-on contract. It is anticipated that the solicitation will be issued summer 2026.
