About this file
This is a Solicitation, Offer, and Award document (Standard Form 1442) for a commercial construction project issued by the USDA Forest Service.
The solicitation seeks construction of approximately 16,414 feet of four-wire fence in the Lowline Fire area, Gunnison County, Colorado, to replace fences damaged by the 2023 Low Line Fire with wildlife-friendly fencing and removal of old damaged materials. The work is classified under NAICS Code 238990 (All Other Specialty Trade Contractors) with a size standard of $19.0 million and an estimated magnitude of $100,000–$250,000. The Government intends to make one award and requires contractors to submit pricing for all line items. The contractor must commence work within 10 calendar days of receiving notice to proceed and complete all work by September 15, 2027. An organized site visit is scheduled for November 9, 2026, at 10:00 a.m. Mountain Time at the Gunnison Ranger District Office, with attendance strongly encouraged but not mandatory.
Quotes must be submitted by December 3, 2026, at 9:00 a.m. Mountain Time via email to Janice King (janice.king@usda.gov) and Lucas Dahlman (lucas.dahlman@usda.gov). Questions are due by November 16, 2026, at 9:00 a.m. Mountain Time. Award will be made based on best value to the Government, evaluated on technical approach (detailed execution plan, relevant experience within past three years, and construction schedule) and price. A bid guarantee of 20 percent of total offer price (not to exceed $3 million) on Standard Form 24 is required at time of offer. Performance and Payment Bonds (100 percent) using mandatory Standard Forms 25 and 25A are due within 10 calendar days after award. The contract is firm fixed price, with pricing submitted on the provided Excel spreadsheet (C4_Attachment 1–SOI) rounded to the nearest whole dollar with no cents. Offerors must include company name and UEI number on the Schedule of Items. Construction wage rate requirements and Buy American requirements for construction materials apply. The offer must remain firm for 60 calendar days from the receipt date.

Evaluation and Basis for Award
The provision at FAR 52.212-2, Evaluation—Commercial Products and Commercial Services mailto:jack.starkebaum@usda.gov http://www.sam.gov/ mailto:janice.king@usda.gov mailto:lucas.dahlman@usda.gov mailto:janice.king@usda.gov mailto:lucas.dahlman@usda.gov is not applicable to this solicitation. In lieu of this provision, quotes will be evaluated in accordance with FAR 12.203 based on the criteria listed below. Award will be made to the offeror representing the best value to the Government.
The Government intends to evaluate quotations to determine the best value to the Government, based on the evaluation factors outlined in this solicitation. The Government may consider quotations that exceed minimum requirements and offer additional value or benefits, even if they are not the lowest priced. However, formal trade-off procedures will not be conducted
Evaluation Factors The Government will evaluate the content of the offeror’s submitted offer to assess reasonableness of the contractor’s Technical Approach for which a Confidence Assessment Rating will be assigned to the offeror’s capability to perform the required work. The following factors will be considered:
Factor 1 - Technical Approach:
The technical approach will evaluate the ability of the offeror to provide a sound, compliant, approach that meets all requirements and shows a thorough understanding of the work outlined in the SOW for constructing approximately 16,414 feet of four wire fence in the vicinity of the 2023 Low Line Fire, Gunnison County, Colorado. The purpose and need are to replace existing fences damaged by the 2023 Low Line Fire with a friendly wildlife fence and provide removal of old and damaged fence materials.
All offerors must provide the following, minimum, information and documentation with their quotations to be considered responsive and have their offers evaluated:
• A detailed 1-2 page explanation of the offeror’s approach; this must include an execution plan outlining the systematic removal and installation of the identified fencing system in accordance with the Statement of Work (SOW), and construction Specifications and Diagram. A simple statement of capabilities will not suffice. The offeror must address how it will accomplish the requirements of the SOW addressing key tasks and demonstrating a thorough understanding of the project.
• Offer shall submit the company’s experience of similar work in fence removal and installation that has been completed within the past three years. Include the project’s name, the project’s contact person’s name and number, location, dollar amount of the project, and period of performance. This submission shall be no more than 2 pages.
• Offerors shall include a Construction Schedule (such as a Gantt Chart) illustrating the project’s schedule for the work to be completed within the estimated Period of Performance for this contract or earlier. The government will evaluate the proposed completion dates, key work tasks, and the order in which they are to be executed. Acceptable proposals will demonstrate the ability to complete the project within the specified time frames, or even earlier. The schedule will NOT be counted as part of the detailed explanation.
Confidence Assessment: Based on the offeror’s technical approach and schedule, the Government will assign one of the following confidence ratings:
• High Confidence – Government has a high expectation of successful performance.
• Some Confidence – Government has a reasonable expectation of success.
• Low Confidence – Government has concerns about successful performance.
• Neutral Confidence – No relevant performance available; no positive or negative inference will be made.
Factor 2 - Price:
The offeror shall provide pricing as requested below and in the attached Schedule of Items spreadsheet titled “C4_Attachment 1 - SOI”.
Schedule of Items - All items shall be priced and submitted on the Excel Spreadsheet provided, C4_Attachment 1 – SOI. Do NOT submit pricing in Adobe format.
All individual line-item pricing provided shall be rounded up to the nearest whole dollar, do NOT include cents, the total pricing should equate to the individual line-item amounts.
Ensure the name of the company and the UEI number is added to the Schedule of Items (Include the Contractor’s name and UEI block highlighted in yellow on the SOI).
Total price evaluation will be for the base period, all optional items, and all periods. Failure to propose pricing for the base items, optional items, and periods on individual line items may result in a quotation being excluded from further consideration. The offeror’s quotation will be evaluated in accordance with FAR 12.204, to determine if it is fair and reasonable.
(b) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

NOTICE FOR FILING AGENCY PROTESTS
United States Department of Agriculture (USDA) Protest Procedures
The United States Department of Agriculture (USDA) is committed to fair, transparent, and efficient acquisitions. Interested parties with concerns about this solicitation are encouraged to seek resolution through the following USDA procedures.
Tier 1: Contracting Officer Concern Resolution
Submission: Interested parties with concerns about either the solicitation or subsequent award should first submit their concern directly to the Contracting Officer, providing sufficient detail to allow the Contracting Officer to understand and assess the issue.
Process: The Contracting Officer will review the concern, seek clarification as needed, and engage with the interested party to attempt prompt resolution.
Review Timeline: The Contracting Officer will make every effort to provide a response or resolution within 10 business days of receiving the concern.
Effect on Award or Performance: Tier 1 engagement is not considered an official notification of filing an agency protest and does not pause solicitation deadlines, delay award decisions, or suspend contract performance.
Next Steps: If the matter cannot be resolved at Tier 1, the interested party may file a written agency protest under Tier 2. USDA encourages all parties to seek resolution with the Contracting Officer before filing an agency protest.
Tier 2: Agency Protest If concerns cannot be resolved at Tier 1, an interested party may file a written agency protest with either the Contracting Officer or the USDA Independent Review Authority. The decision by the USDA Independent Review Authority is an alternative to a decision by the Contracting Officer. The USDA Independent Review Authority will not consider an appeal of the Contracting Officer’s decision on an agency protest.
https://www.usda.gov/guidance-documents/acquisition-policy/ocp/usda-agar30-sept-26pdf
The protest must state whether the protester elects review by the Contracting Officer, by the UDSA Independent Review Authority. If no election is stated, the Contracting Officer will decide the protest.
Required Information: Protests shall include the information set forth in FAR 33.104-4 (a)(3).
Failure to submit the required information may result in a delay or dismissal of the protest.
Submission: Agency protests should be submitted electronically to SPE.inquiry@usda.gov and the Contracting Officer.
Timeliness: Protests must be filed within the timeframes specified in FAR 33.104.
Effect on Award or Performance: Contract awards or performance will be suspended during the protest period unless justified in writing for urgent and compelling reasons or determined to be in the best interest of the Government.
Review Timeline: USDA strives to resolve agency-level protests within 35 business days of receipt.
Election of Forum: By filing a protest with USDA, the protesters agree not to file a protest on the same matter with the Government Accountability Office (GAO) or any other external forum while the agency protest is pending. If such a protest is filed externally, the USDA agency protest will be dismissed.
Questions: Questions regarding this notice or protest procedures should be directed to the Contracting Officer identified in this solicitation.
