About this file
This is a Sole-Source Determination and Justification document submitted to the Oregon Business Development Department (OBDD), Economic Strategies and Research Team by Procurement and Contract Specialist Kellie Stavang on March 6, 2025. The document seeks approval from Denise Wendler, Interim Procurement and Contracts Manager and Designated Procurement Officer, to enter into a sole-source contract with Wiser LLC for renewal of the WISERTrade International Trade Data and Analytics database subscription. The WISERTrade Direct Redistributing Subscriber Database is an online tool that stratifies US Census export data by state, country, port, industry (to the four-digit NAICS level), and Harmonized System codes (to the six-digit level), enabling agency staff to analyze real-time export and import trends for internal customers and external economic development partners. OBDD has utilized this database since 2008 and serves as Oregon's primary state agency for fielding trade and export data requests from media, government entities, and economic development partners. The contract is for an estimated value of $125,000 for the annual subscription and shall not exceed $150,000 or renew beyond an additional seven-year period through March 31, 2032, whichever occurs first. The protest period closes at 5:00 PM on March 13, 2025, with protests to be submitted to Kellie.STAVANG@biz.oregon.gov.
The justification for sole-source procurement is based on market research findings that WISERTrade is the only database providing the level of granular trade data required by OBDD, as confirmed through searches of the Department of Administrative Services Statewide Price Agreements, the State Library of Oregon Database subscriptions, and internet research. Agency staff have additionally researched competing vendors through recent and historical inquiries, phone conversations, and product demonstrations, consistently determining that WISERTrade remains the sole provider meeting the agency's specific needs. The procurement is justified under ORS 279B.075 and OAR 137-047-0275 based on compatibility considerations, as the database's integration into established agency workflows and customizable export query features, which save staff time and enable tailored analysis, make switching vendors operationally unfeasible. To date, OBDD has spent $72,000 on this subscription since 2008. The determination was approved electronically via OregonBuys by DPO Denise Wendler.

SOLE-SOURCE DETERMINATION AND JUSTIFICATION
FOR SUPPLIES AND SERVICES
To: Denise Wendler, Interim Procurement and Contracts Manager, Designated Procurement Officer (DPO)
Agency/Division: Oregon Business Development Department (OBDD), Economic Strategies and Research Team
Agency Procurement Specialist: Kellie Stavang, Procurement and Contract Specialist
Date: March 06, 2025
Re: Sole Source Determination pursuant to Oregon Revised Statute (ORS) 279B.075 and Oregon Administrative Rule (OAR) 137-047-0275
1. Authority to enter into a Sole-Source Contract: OAR 137-047-0275
2. Estimated Total Value of Contract: $125,000 Prospective Vendor: Wiser LLC
3. Subject of Contract: WISERTrade International Trade Data and Analytics
4. Background:
Agency intends to renew Wiser LLC’s WISERTrade Direct Redistributing Subscriber Database, an online database, that takes US Census reported export data and stratifies it by state, country, port, industry (down to the four digit NAICS level) and globally recognized Harmonized System (HS) codes, (down to the six digit level). This allows Agency staff to pull real time export data to discern trends for internal and external customers. It is also used in planning which markets and industries to target for recruiting and outreach. Additionally, WISERTrade imputes import data which we use in our analysis often.
Agency has been using the database since 2008 and to date has spent a total of $72,000. This sole source justification applies to the annual subscription of WISERTrade Direct Redistributing Subscriber Database and shall not exceed $150,000 or renew beyond an additional seven year period through March 31, 2032, whichever occurs first.
WISERTrade is the only product capable of meeting the Agency’s need. With use of the database being embedded in established workflows it is recommended moving forward with this vendor and their product. Changing software now will seriously affect the Agency’s ability to identify key industries, understand markets, and conduct outreach to companies who can be best served by the Agency’s programs. OBDD is also the primary agency within the State of Oregon’s enterprise system to field frequent requests for data and analysis on trade and exports. Customers requesting this data are included but not limited to the media, government entities, and economic development partners.
5. Findings:
C2025134_Sole-Source Determination Page 2 of 3
A. Market Research Overall Finding.
Pursuant to ORS 279B.075, Agency must conduct market research that supports the assertion that there is only one source that can provide the goods or services. Agency market research consisted of searching the Department of Administrative Services Statewide Price Agreements, the State Library of Oregon Database subscriptions, and the internet and found that WISERTrade Direct Redistributing Subscriber Database is the only database that provides the level of granular data needed to understand the impacts of trade on Oregon’s economy. Additionally, WISERTrade allows users to create customized lists when running export queries, saving staff time and allowing for analysis tailored to the type of client requesting the data.
And
B. Findings of Fact pursuant to OAR 125-247-0275(2) must include, at a minimum, one of the following:
☐ Pursuant to OAR 125-247-0275(2)(a): Compatibility. Provide findings supporting your determination that the efficient utilization of existing goods requires the acquisition of compatible goods or services from only one source.
☒ Pursuant to ORS 279B.075 (2)(b): Exchange of Software or Data. Provide findings supporting your determination that the goods or services required for the exchange of software or data with other public or private agencies are available from only one source.
OBDD is the State’s economic development leader and Oregon’s economy is heavily dependent on global trade. As such, timely and accessible trade data is a necessity for conducting business and prioritizing resources. Agency staff have researched other vendors (recently and historically), including internet searches, phone conversations, and product demonstrations, and WISERTrade remains the sole provider of accessible Census trade data customized for the Agency’s needs.
☐ Pursuant to ORS 279B.075 (2)(c): Pilot or Experimental Project. Provide findings supporting your determination that the goods or services are for use in a pilot or an experimental project.
☐ Pursuant to ORS 279B.075 (2)(d): Other findings that support the conclusion that Supplies and Services are available from only one source may include but are not limited to considerations of: unique design, availability, geographic location, exclusive authorized representative, cost of conversion, and warranty services.
6. Protests: OAR 137-047-0275(3) provides that an Affected Person may protest OBDD’s determination that the Goods or Services or class of Goods or Services are available from only one source in accordance with OAR 137-047-0710.
