About this file
This is a Sole Source Justification Memorandum for the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD) to acquire MK68 Ejector Release Mechanisms. The contracting activity will award a firm fixed price order to Ensign-Bickford Aerospace & Defense (EBAD), located at 640 Hopmeadow Street, Simsbury, CT 06070 (Cage 96336). The requirement involves purchasing 35 units of E4000-3361-1-PBOF ERM Linear Actuators (Part Number N83361-1) for the Multi Mission Buoy (MMB) Anchor Separation Mechanism, with delivery required no later than 40 weeks after award. The acquisition will be conducted using simplified acquisition procedures.
The justification for sole source procurement under 10 U.S.C. 2304(c)(1) and FAR 6.302-1 is based on EBAD being the sole developer and original equipment manufacturer of the linear actuators with exclusive knowledge of the design and functionality. The government determined that alternative actuator systems underwent unsuccessful testing, and substituting different products would necessitate system redesign, Engineering Change Proposals, and extensive retesting, resulting in significant schedule delays and increased funding requirements while introducing undefined interface risks. The government did not acquire technical data package rights since these are commercial items developed for the aerospace and defense industry. The Contracting Officer determined the order represents the best value and lowest overall cost alternative to meet the government's needs. No additional market research was conducted given that EBAD is the only capable source.

Redacted. The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures. The items will be submitted no later than 40 weeks after award of the order. Redacted.
4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.
10 U.S.C. 2304(c) (1) - Only one responsible source and no other supplies or services will satisfy agency requirements, FAR 6.302-1.
The NSWC PCD has a requirement to acquire MK68 Ejector Release Mechanisms for the Multi Mission Buoy (MMB). This purchase is not suitable for full and open competition for the following reasons.
a) Ensign-Bickford Aerospace & Defense (EBAD) is the sole developer and original equipment manufacturer (OEM) this item. As such they are the only source with sufficient knowledge of the linear actuator design and functionality to supply the component.
b) After extensive testing in other relevant undersea weapon systems, non-successful testing of other actuator systems, and trade studies conducted by the development team, these actuators were designed into the MMB’s Anchor Separation Mechanism which created the system design. Replacing the actuators with another product or manufacturer will not only duplicate the effort and delay the delivery of the MMB due to required system redesign, Engineering Change Proposals (ECPs) and extensive testing, resulting in significant schedule delay and increase requirements of funding. The replacement will introduce undefined interface risks.
c) The Government did not purchase or acquire the rights in data and design or a technical data package (TDP) for these items because they are commercial items developed to support the aerospace and defense industry at large.
EBAD is the only source capable of meeting the requirement. As such, the Government does not expect significant savings through competition, and it is more advantageous for the Government to award on a sole source basis to EBAD.
5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).
The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.
6. A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.
Redacted. No additional market research was conducted for the reasons discussed in paragraph 4 above, for any company other than Ensign-Bickford Aerospace & Defense to provide the products.
7. Any other facts supporting the justification. None.
8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
As stated in paragraph 4 above, Ensign-Bickford Aerospace & Defense is the only source that can meet the requirement.
