About this file

This document is a Brand Name Justification memorandum from the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD) for procuring a STIDD Brand AC3 Acoustic Communications Module (Part Number 4600-301). The acquisition will be a small business set-aside using simplified acquisition procedures, with a total dollar value above micro-purchase levels but not exceeding $250,000.00.

The justification indicates STIDD is the sole Original Equipment Manufacturer (OEM) capable of meeting USSOCOM PEO-M Combat Diving's technical requirements, having undergone rigorous testing for military operator needs. The Contracting Officer determined this represents the best value considering price, special features, and administrative costs. The solicitation requires vendors to email quotes by Thursday, 26 June 2025 at 11am Central Time, with requirements including submission on company letterhead, providing CAGE code and lead time, ability to invoice through Wide Area Workflow (WAWF), and potential shipping line item if not included in pricing.

Subj: BRAND NAME JUSTIFICATION TO PROCURE STIDD BRAND AC3 ACOUSTIC

COMMUNICATIONS MODULE, 4600-301

1. Identification of the agency and the contracting activity, and specific identification of the document as a “Brand Name Justification.”

This is a brand name justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001.

2. Nature and/or description of the action being approved.

Authorization to solicit, on a brand name basis, for the acquisition of STIDD Brand Acoustic Communication Modules. Competition will be limited to authorized sellers of STIDD brand products listed in Paragraph 3 of this document.

3. A description of the supplies or services required to meet the agency’s needs (including the estimated).

AC3 ACOUSTIC

COMMUNICATIONS MODULE,

4600-301 1

The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold of $250,000.00.

4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

10 U.S.C. 2304(c)(1). Application for brand name description FAR 6.302-1(c).

The Naval Surface Warfare Center Panama City Division has a need for the item listed in Paragraph 3 of this document. STIDD is the Original Equipment Manufacturer (OEM) of the diver propulsion device and the only brand of acoustic communications modules demonstrated to meet the requirements of the sponsoring program office, USSOCOM PEO-M Combat Diving. The STIDD DPD3 is an approved diver propulsion device for use by the USSOCOM military operators and as such, it has undergone rigorous testing to demonstrate it meets the technical capability requirements of its operators. Another brand has not been demonstrated to properly interface and meet the technical requirements of the USSCOM military operators and sponsoring program office.

As such, the Government does not expect significant savings through competition and does expect significant and unacceptable delays that will negatively impact this requirement.

Therefore, it is in the Governments’ best interest to acquire the STIDD brand.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (such as considering price, special features, administrative costs) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

For the reasons specified in paragraph 4 above, STIDD is the only brand that can meet the Government’s needs. This requirement will not be synopsized in the government point of entry sam.gov because it is estimated at greater than $25,000.00.

7. Any other facts supporting the justification.

None.

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

As stated in paragraph 4 above, STIDD is the only brand that can meet this requirement.
