About this file
This document is a Brand Name Memorandum justifying a limited source acquisition for the Naval Sea Systems Command (NAVSEA), Naval Surface Warfare Center, Panama City Division. The procurement involves 43 Fox Aviation Sales pressure adapters (Part Number 3835-R, NSN: 4930015881020) for the Expeditionary Mobile Fuel Additization Capability (EMFAC) project in support of the Marine Corps Systems Command. The acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels but not exceeding $250,000, with all equipment to be delivered within 30 days after order award.
The justification for sole-source procurement is based on the specific configuration of the pressure adapter, which has undergone extensive testing for EMFAC system compatibility and cannot be sourced from alternative vendors. The document emphasizes that no other valve assembly meets the form, fit, and function requirements, and that attempting to use alternative components would require costly and extensive additional testing. Competition will be limited to authorized Fox Aviation Sales resellers, with the contracting officer determining this approach represents the best value and lowest overall cost to meet the government's needs.

MEMORANDUM
Subj: BRAND NAME MEMORANDUM TO ACQUIRE FOX AVIATION SALES PRESSURE
ADAPTERS
1. Identification of the agency and the contracting activity, and specific identification of the document as a “Limited Source Justification.”
This is a brand name justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001.
2. Nature and/or description of the action being approved.
This action will award a firm fixed price purchase order, on a brand name specific basis, for the acquisition of Fox Aviation Sales brand pressure adapters for the Expeditionary Mobile Fuel Additization Capability (EMFAC) project. The EMFAC project is procuring material in support of fielding for the Fuel and Water Team at Marine Corps Systems Command (MARCORSYSCOM). Competition will be limited to authorized resellers of Fox Aviation Sales brand equipment.
3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).
The following items are being acquired:
Description Part Number Qty.
Pressure Adapter 3835-R
NSN: 4930015881020
The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold of $250,000.00. All equipment will be delivered no later thirty (30) days after award of the order.
4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service. 10 U.S.C. 2304(c)(1), 10 U.S.C.
2304(d)(1)(B). Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements FAR 6.302-1(a)(2)(iii)(C).
This pressure adapter has gone through extensive testing to verify compatibility with the EMFAC Program of Record. This particular valve is not available elsewhere due to the configuration being built specifically for use with the EMFAC system, there are currently no other items that meet the form, fit and function provided by this valve assembly. Additionally, there is no work package that would allow a third-party entity to purchase the separate components and assemble independent of this brand name. The insertion of any other valve assembly would require extensive testing to verify compatibility with the EMFAC system as well as ECPs to integrate into the Technical Data Package, both at the cost of the government. This additional testing would be cost prohibitive to the EMFAC program. Therefore it is imperative that the Fox Aviation Sales brand pressure adapter is acquired as it is essential to the EMFAC project.
5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).
The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, reoccurring cost, administrative costs, engineering and redesign costs, etc.)
to meet the Government’s needs.
6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
As mentioned in paragraph 4 above, Fox Aviation Sales is the only brand of pressure adapters that will meet project needs.
7. Any other facts supporting the justification:
None.
8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
As mentioned in paragraph 4 above, Fox Aviation Sales is the only brand of pressure adapters that will meet project needs.
