About this file

This is a Brand Name Justification document for a forklift evaluation and repair order issued by the Naval Sea Systems Command (NAVSEA), Naval Surface Warfare Center, Panama City Division. The acquisition is for two specific services: (1) pickup/delivery of a forklift and (2) evaluation of a hydraulic pump. The order will be a firm fixed price contract awarded to the lowest-price authorized John Deere reseller, with a total dollar value above micro-purchase levels but not exceeding the simplified acquisition threshold.

The justification is based on John Deere being the sole equipment manufacturer that can meet the government's needs, as they are the Original Equipment Manufacturer (OEM) and only authorized John Deere technicians may service the equipment. The Contracting Officer determined this represents the best value, considering factors like price, recurring costs, and administrative expenses. No additional market research was conducted beyond identifying John Deere as the exclusive service provider for this specific forklift repair requirement.

2 Evaluation of hydraulic pump N/A 1 EA

The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. 4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service. 10 U.S.C. 2304(c)(1), 10 U.S.C. 2304(d)(1)(B). Only One Responsible

Source and No Other Supplies or Services Will Satisfy Agency Requirements FAR

6.302-1(a)(2)(iii)(C).

Pursuant to FAR 6.302-1(a)(2)(iii)(C), John Deere is the only brand of equipment that will meet the

Government’s needs for the following reasons. NSWC PCD currently has a need to repair a

John Deere forklift. John Deere is the Original Equipment Manufacturer (OEM) and, as such, only authorized John Deere technicians may work on this equipment. The use of mechanics who are not specifically trained in the repair of John Deere forklifts may result in improper installation of parts, and the equipment being left in less-than-optimal condition upon completion of the service. Therefore, it is advantageous to the Government to utilize only John Deere authorized mechanics for the services listed in Section 2, with no substitutes.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, recurring cost, special features, administrative costs, etc.) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.

REDACTED. No additional market research was conducted for the reasons discussed in paragraph 4 above, for any company other than John Deere to provide the products.

7. Any other facts supporting the justification. None.

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

As stated in paragraph 4 above, John Deere is the only brand that can meet this requirement.
