About this file

This is a Brand Name Justification memorandum for the acquisition of Popoto subsea communications equipment by the Naval Surface Warfare Center Panama City Division (NSWC PCD). The procurement will be conducted as a firm-fixed-price purchase order awarded to the lowest-price authorized reseller of Popoto brand products.

The required items include 8 Boardsets (PMM3511DK-00), 8 Popoto 28KHz Transducers with 1m Cable (PMT-28-OS-01), and 2 Popoto Digital Interface Boards (PDI-00), with delivery required within 4 weeks of award. The equipment is needed for the Submerged Logistics Expeditionary Payloads Retrievable (SLEPR) Project operating within NSWC PCD's Computational Analysis Facility Classified Lab. The justification states that Popoto is the only brand that can meet the requirements, as some parts are exclusively made by this vendor and using alternative parts would require additional tools and labor, potentially impacting system operation. The acquisition will use simplified acquisition procedures with a total value above micro-purchase levels but below the simplified acquisition threshold.

Subj: BRAND NAME MEMORANDUM TO ACQUIRE POPOTO SUBSEA

COMMUNICATIONS EQUIPMENT (ERP No: 1301214917)

1. Identification of the agency and the contracting activity, and specific identification of the document as a “Limited Source Justification.”

This is a brand name justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001 (Contracts Department Code 02).

2. Nature and/or description of the action being approved.

This action will award a firm fixed price purchase order on a brand name specific basis to the lowest price offeror that is an authorized reseller of Popoto brand products .

3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).

The contract effort is to acquire:

Item Part Number Quantity Boardset PMM3511DK-00 8 Popoto 28KHz Transducer with 1m Cable PMT-28-OS-01 8 Popoto Digital Interface Board PDI-00 2 Shipping N/A 1 Lot

REDACTED The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold REDACTED. All equipment will be delivered no later than four (4) weeks after award of the order. REDACTED

4. Identification of the justification rationale (see FAR 8.405-6(a) and (b)) and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

The Submerged Logistics Expeditionary Payloads Retrievable (SLEPR) Project operating within NSWC PCD Computational Analysis Facility Classified (CAFc Lab) requires part items from Popoto which will be used to build low level controller and wire power supply to electric launch motor. Some of the parts from Popoto are exclusively made only by this vendor and other parts are needed to combine with each other to produce the low level controller for this project. Use of alternative parts would be more costly as it would require additional tools and labor to fit the measurement needed. Popoto already provides parts with precise measurements needed for this project.

Additionally, use of alternate equipment may introduce new or changing existing parameters that could damage or effect the proper operation of the Submerged Logistics Expeditionary Payloads Retrievable Project. In summary, Popoto brand parts have been used exclusively in the Submerged Logistics Expeditionary Payloads Retrievable Project to the point that an extensive inventory of these parts are required to properly maintain and ensure the consistent operation of the Submerged Logistics Expeditionary Payloads Retrievable project. These parts are being acquired to maintain that inventory to ensure the readiness of the Submerged Logistics Expeditionary Payloads Retrievable Project.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 8.404(d).

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, reoccurring cost, administrative costs, engineering and redesign costs, etc.) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

FAR 8.404(a) does not require a synopsis for an order against a GSA or GWAC schedule. Use of a non-DoD contract will facilitate contract award through the use of Simplified Acquisition Procedures (SAP) to meet stringent U.S. Navy scheduling requirements.

7. Any other facts supporting the justification.

None

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

As explained in paragraph 4 above, Popoto brand is the only brand that can meet this requirements.
