About this file
This is a Brand Name Justification document from the Naval Surface Warfare Center Panama City Division (NSWC PCD) for the procurement of Yamaha outboard motors. The justification covers the acquisition of twin Yamaha 250hp outboard engines (F250USB/LF250USB) with Digital Electronic Steering (DES) and associated equipment/cabling for a 28' SEAARK vessel.
The acquisition includes specific Yamaha components: two 250hp outboard motors (right and left hand), DEC control box, helm unit assembly, display units, various harnesses, propellers, and installation hardware. The purchase will be conducted using simplified acquisition procedures with an estimated value above $25,000 but below $250,000. The justification cites that only Yamaha brand can meet requirements because the motors match existing equipment on the vessel, the transom mounts are compatible (avoiding replacement costs), and their technician is Yamaha-certified, enabling local maintenance and repairs. The requirement will be synopsized on sam.gov and is structured as a total small business set-aside.

This acquisition will be conducted using simplified acquisition procedures with a total estimated value greater than $25,000. The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold of $250,000.00. REDACTED
4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service. 10 U.S.C. 2304(c) (1). Application for brand name description FAR 6.302- 1(c).
Only this Brand and no other supplies or services will satisfy agency requirements, FAR 6.302- 1(c). NSWC PCD currently has a need for Yamaha Outboard Motors, as referenced in Section 2 of this document. The motors to be purchased are the same size and type that already exist on the vessel. The transom mounts are the same, and will not have to be replaced as part of this purchase, saving additional cost. Additionally, our technician was a previously qualified/certified Yamaha technician prior to his arrival on contract. He has the experience and familiarity with the system that will save future maintenance and repair funds by servicing them locally.
As such, the Government does not expect significant savings through competition and it is more advantageous to the Government to acquire the items listed in Section 2 above, with no substitutes. Therefore, it is in the Governments’ best interest to acquire the Yamaha brand.
5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).
The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, recurring cost, special features, administrative costs, engineering and redesign costs, etc.) to meet the Government’s needs.
6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
For the reasons specified in paragraph 4 above, Yamaha is the only brand that can meet the Government’s needs. This requirement will be synopsized in the government point of entry sam.gov because it is estimated greater than $25,000.00.
7. Any other facts supporting the justification. None.
8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
As stated in paragraph 4 above, Yamaha is the only brand that can meet this requirement.
