About this file
This is a Brand Name Justification memorandum for a sole source rental acquisition of power and HVAC equipment conducted by the Naval Surface Warfare Center Panama City Division (NSWC-PCD). The Government seeks to rent specialized equipment from United Rentals Power & HVAC to support chilling systems for diver propulsion device testing at an estimated cost not to exceed $350,000.00 using simplified acquisition procedures. The justification asserts that United Rentals Power & HVAC possesses unique expertise in rapidly creating the required test environments for large-volume chilling applications and that competing vendors lack the specialized knowledge necessary to meet the Government's needs without incurring unacceptable delays that would negatively impact the testing program. Market research was not conducted, as the agency determined that United Rentals is the sole vendor capable of satisfying the requirement.
The contracting officer has determined that the sole source award to United Rentals Power & HVAC represents best value and results in the lowest overall cost alternative considering price, special features, and administrative costs. The acquisition will not be synopsized on sam.gov due to its estimated value exceeding $25,000.00. The justification cites 10 U.S.C. 2304(c)(1) and FAR 6.302-1(c) as legal authority for the brand name restriction. No subsequent actions are identified to remove barriers to competition for future acquisitions of similar services.
