About this file

This is a Brand Name Justification memorandum issued by the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD) for the acquisition of Mensor instrumentation equipment. The procurement is for hyperbaric test equipment, facilities atmospheric control, and pressure monitoring systems required by the Navy Experimental Diving Unit (NEDU).

The Government is acquiring two items: (1) two units of a Precision Pressure Indicator, Model CPG2500 (Part #41006162) with integrated reference pressure sensors (Type CPR2550) configured for measuring ranges of 0.00-500.00 PSI gauge and -15.00-5.00 PSI bi-directional with 0.008% full-scale accuracy, and (2) two units of a Standard Precision Pressure Transducer, Model CPT6100 (Part #41006163) with a measuring range of 0.00-5000.00 PSI gauge and 0.01% full-scale accuracy. Both items require A2LA-calibration certificates traceable to ISO 17025 standards and will be shipped to the Navy Experimental Diving Unit at 321 Bullfinch Road, Panama City, Florida 32407. The estimated procurement value exceeds $25,000 but does not exceed the simplified acquisition threshold of $350,000.00. The justification for restricting this acquisition to the Mensor brand is based on the equipment's specific configuration for integration with existing NEDU N31 hyperbaric chamber systems, gas supply panels, and software. The Government determined that alternate equipment would introduce unacceptable costs, delays, and potentially harmful new parameters to diving systems tested at NEDU. No market research was conducted among schedule holders because Mensor is the only brand that can meet the Government's specialized needs. The Contracting Officer will determine prior to award that the resulting order represents the best value considering technical specifications, price, and past performance.

The estimated value of this procurement is greater than $25,000. The Government's minimum needs have been verified by the certifying technical and requirements personnel. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold of $350,000.00. This memo does not authorize acquisition for other requirements.

4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor's unique qualifications to provide the required supply or service.

Authority: FAR 6.103-1(d), Application for brand-name descriptions.

The Mensor hardware being procured is comprised of commercial hardware, with specifications configured specifically for use with current NEDU hardware and software systems. The hardware specified provides the means to integrate with already in place systems for NEDU N31 hyperbaric chamber systems. The hardware will be integrated into already-in-place gas supply panels, which provide regulated gas control for diver’s life support equipment undergoing evaluation at NEDU. Additionally, these instruments must provide calibration standards and Certificates of Conformance. Only those articles which have been successfully tested are qualified. In summary, using alternate equipment would prove costly in time and dollars to the government and to the mission. Use of another system may change or introduce new parameters that may be harmful to all diving systems tested and maintained at NEDU. Therefore, it is imperative that this particular brand of equipment is purchased.

As such, the Government does not expect significant savings through competition and does expect significant and unacceptable delays that will negatively impact this requirement.

Therefore, it is in the Governments’ best interest to acquire the Mensor brand.

5. 5. A determination by the ordering activity contracting officer that the order represents the best value, consistent with the commercial evaluation procedures in FAR 12.203.

Prior to award, the Contracting Officer will determine that the resulting order represents the best value and results in the lowest overall cost alternative (considering technical, price, and past performance) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

For the reasons specified in paragraph 4 above, Mensor is the only brand that can meet the Government’s needs. This requirement will be synopsized in the government point of entry sam.gov because it is estimated greater than $25,000.

7. Any other facts supporting the justification.

None.

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

As stated in paragraph 4 above, Mensor is the only brand that can meet the Government’s needs.
