About this file
This is a Brand Name Justification Memorandum issued by NSWC-PCD (Naval Surface Warfare Center Panama City Division), Code 024, located at 110 Vernon Ave., Panama City, FL 32407. The document justifies a sole-source acquisition of one Rosemount, Inc. X-STREAM Enhanced General Purpose Process Gas Analyzer (XEGP), Model #XEGP-A-09-B40-1-B40-1-O26-0-000-0-000-0-3-0-A-0-C-0-0-1-B-K, identical to Serial Number 5176247, plus shipping if not included in the price. The estimated acquisition value exceeds $25,000.
The XEGP analyzer is critical for real-time monitoring of O2 and CO2 levels within the Saturation Fly-Away Diving System (SATFADS) hyperbaric chambers and dive bell to support diver life support and safety. The justification for brand-name restriction to Rosemount equipment is based on stringent SATFADS certification requirements, the need to avoid integration issues with competing manufacturers' products, and the significant costs and extended lead times associated with re-certifying the system and retraining personnel on alternative equipment. The Contracting Officer has determined the award to authorized Rosemount resellers represents the best value and lowest overall cost alternative. The acquisition will be conducted using simplified acquisition procedures and will be synopsized on sam.gov. No market research among schedule holders was conducted, as Rosemount is identified as the only manufacturer capable of meeting this requirement.

Subj: BRAND NAME JUSTIFICATION MEMORANDUM TO ACQUIRE ONE (1) X-
STREAM ENHANCED GENERAL PURPOSE PROCESS GAS ANALYZER (XEGP)
1. Identification of the agency and the contracting activity, and specific identification of the document as a “Brand Name Justification.”
This is a brand name justification. Contracting activity is NSWC-PCD, Code 024, 110 Vernon Ave., Panama City, FL, 32407.
2. Nature and/or description of the action being approved.
This action will award a firm fixed price purchase order to authorized resellers of Rosemount, Inc. X-STREAM Enhanced General Purpose Process Gas Analyzer (XEGP) to properly monitor O2 and CO2 levels within the Saturation Fly-Away Diving System (SATFADS) hyperbaric chambers and dive bell for divers’ life support.
3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).

This acquisition will be conducted using simplified acquisition procedures. The Government's minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements.
4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.
10 U.S.C. 2304(c)(1). Application for brand name description FAR 6.302-1(c).
The item listed in Paragraph 3 of this document is the same model as the XEGP units currently installed in the SATFADS. The XEGP is critical for monitoring O2 and CO2 levels throughout the system in real-time for divers’ life support and safety. Due to the stringent certification requirements of the SATFADS, it is imperative to replace the units from the same manufacturer (ROSEMOUNT) to avoid potential integration issues with products from other manufacturers, to limit the risk to life and health of the divers, and to avoid the immense costs and long lead times to re-certify the system and re-train the personnel in the operation and maintenance of different equipment.
As such, the Government does not expect significant savings through competition and it is more advantageous to the Government to award on a brand name basis to authorized resellers of
Rosemount, Inc. equipment.
5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 8.404(d).
The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.
6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
For the reasons specified in paragraph 4 above, Rosemount, Inc. is the only brand that can meet the Government’s needs. This requirement will be synopsized in the government point of entry sam.gov because it is estimated greater than $25,000.00.
7. Any other facts supporting the justification.
None.
8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
As stated in paragraph 4 above, Rosemount, Inc. is the only brand that can meet this requirement.
