140R3022Q0046– Rack Card Distribution

Combined Synopsis/Solicitation

(i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.

(ii) To facilitate electronic quote submissions through beta.SAM Contract Opportunities, a request for quote RFQ No. 140R3022Q0046 is being issued subsequent to this combined synopsis/solicitation.

(iii) This solicitation document and incorporated provisions and clauses are those in effect through

Federal Acquisition Circular number 2022-06.

(iv) This requirement will be a total small business set-aside. The North American Industry

Classification System (NAICS) Code for this acquisition is: 541870 Advertising Material Distribution

Services. The small business size standard for NAICS Code 541870 is $16,500,000.00.

(vi) The Bureau of Reclamation has a requirement for rack card distribution for the Hoover Dam in accordance with the Statement of Work (SOW). Offeror MUST submit supporting documentation along with your quotation to demonstrate the proposed quote meets the SOW.

(vii) The requirement will be accomplished via issuance of a firm fixed price Blanket Purchase

Agreement. All work shall be completed by 2 months after receipt of order.

THE FOLLOWING CLAUSES AND PROVISIONS ARE APPLICABLE TO THIS COMMERCIAL

ITEM ACQUISITION:

(viii) FAR provision 52.212-1, Instructions to Offerors - Commercial Items.

a. Addendum to FAR 52.212-1 –Quote Submission Instructions

This addendum replaced the term “offer” with “quote” within the provision 52.212-1.

In addition to the requirements of the Instructions to Offerors - Competitive Acquisitions provision of this solicitation, each offeror will submit a quote in accordance with the instructions contained in this provision.

(1) Offer will complete and submit Standard Form (SF)18 - Request for Quotation. Pricing must be submitted on the SF-18. Attachment 2 – Experience. All documents are attached to the RFQ.

(2) Submit the following information:

(a) Unique Entity Identifier (UEI):

(3) Technical and Past Performance Information Requested:

(a) Technical: Offeror will provide the information below in a written statement to explain their technical capability. A written response is required for each item.

(b) References:

1) Offerors will have their references listed in Attachment 2 – Experience. Attachment 2 –

Experience must be submitted with your offer to the contracting office via email to Bryan Williamson at bwilliamson@usbr.gov.

NOTE: An offeror without relevant experience, or for whom information on past performance is not available, will be given a Neutral rating, and will not be evaluated favorably or unfavorably. This rating is neither negative nor positive. Neutral is merely indicative of a lack of prior performance.

Government may also use past performance information obtained from other than the sources identified by the offeror. Information obtained from the Contractor Performance Assessment Reporting System

(CPARS) database located at http//www.cpars.gov is one of the sources that will be utilized.

(ix) FAR provision 52.212-2, Evaluation-Commercial Items.

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:

2. Experience

3. Price (all proposed prices will be reviewed for price reasonableness and any instances of unbalanced pricing.)

(ix) Determination of award will be based on the lowest-priced responsive quote from a responsible offeror.

STATEMENT OF WORK OUTLINE

1.0 Background

Hoover Dam has over 6 million visitors annually, 800,000 of which take guided tours.

Well placed, readily available promotional materials can increase our visitation and reach out to the public. A part of Hoover Dam’s marketing strategy is displaying rack cards at locations throughout Southern Nevada. This Statement of Work encompasses the distribution of these promotional materials.

2.0 Scope

To pick up Hoover Dam rack cards from the Bureau of Reclamation Lower Colorado Dams Warehouse and distribute them to Hotels, Casinos, Resorts, Visitor Centers, Car Rental Facilities, Airports, Campgrounds, RV Parks and Military Bases in Southern Nevada and surrounding areas. The distribution amount will be approximately between 40,000 cards per year.

3.0 Objectives

The U.S. Bureau of Reclamation seeks to promote visitation to Hoover Dam, as well as providing information of tours and experiences available at the site. Reclamation would like to reach a broad audience within the Southern Nevada area.

4.0 Tasks

The contractor will:

• Pick up rack cards from the U.S. Bureau of Reclamation Lower Colorado Dams Warehouse;

• Transport the rack cards through their own means;

• Identify and determine locations at Military Bases in Southern Nevada (Clark County) and surrounding areas such as Laughlin, Mesquite, Lake Mead, and Boulder City. This includes locations such as Hotels, Casinos, Visitor Centers, Car Rental Facilities, Airports, Campgrounds, and RV Parks;

• Provide the list of Rack Card locations to the U.S. Bureau of Reclamation;

• Deliver the rack cards on a regular basis (at least monthly) to retain stock at these sites.

• Insert the rack cards into display stands, or if the location stocks these cards, provide them to facility attendants.

• Bill the U.S. Bureau of Reclamation monthly.

• The distribution amount is estimated to be approximately 40,000 cards per year.

5.0 Quality Assurance

• The government shall evaluate the contractor’s performance through random inspections of rack card locations.

6.0 Government-Furnished Property

The U.S. Bureau of Reclamation will provide rack cards to the contractor for distribution. The cards are standard rack card size, 9x4 inches.

These rack cards are packaged as follows:

• Boxes are 18x13x6 inches

• Inside, cards are shrink wrapped into bundles of 100

• Boxes contain 2,700 cards each

• Boxes weigh 39.5 pounds

7.0 Security

There are no specific security requirements for this contract. The contractor must arrange with the U.S. Bureau of Reclamation when picking up rack cards to have access at the

Warehouse.

8.0 Place of Performance

• Pick up rack cards from the U.S. Bureau of Reclamation Lower Colorado Dams Warehouse;

• Deliver the rack cards on a regular basis to Hotels, Casinos, Visitor Centers, Car Rental Facilities, Airports, Campgrounds, RV Parks and Military Bases in Southern Nevada (Clark County) and surrounding areas such as Laughlin, Mesquite, Lake Mead, and Boulder City.

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 6 months.

52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 5 years 6 months.

(a) The use in this solicitation or contract of any Federal Acquisition Regulation (48 CFR Chapter 1) clause with an authorized deviation is indicated by the addition of "(DEVIATION)" after the date of the clause.

(b) The use in this solicitation or contract of any Department of the Interior Acquisition Regulation (48 CFR Chapter 14) clause with an authorized deviation is indicated by the addition of "(DEVIATION)" after the name of the regulation.

PLATFORM (IPP) (APR 2013)

Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).

'Payment request' means any request for contract financing payment or invoice payment by the Contractor.

To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. The IPP website address is:

Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice:

The Contractor shall also submit an electronic copy of the IPP invoice to SEE EMAIL BOX BELOW once the invoice has been submitted to IPP. Failure to email the invoice may cause significant delay or possible rejection of your payment request.

The Contractor must use the IPP website to register access and use IPP for submitting requests for payment.

The Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of St. Louis (FRBSTL) within 3 - 5 business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email IPPCustomerSupport@fiscal.treasury.gov or phone (866) 973-3131.

If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.

(d) Comptroller General Examination of Record. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

52.212-2 EVALUATION-COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. 52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS-COMMERCIAL PRODUCTS AND

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v)) of this provision.

(a) Definitions. As used in this provision—

“Covered telecommunications equipment or services” has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

Highest-level owner means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.

Immediate owner means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.

Inverted domestic corporation, means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).

Manufactured end product means any end product in product and service codes (PSCs) 1000-9999, except—

Predecessor means an entity that is replaced by a successor and includes any predecessors of the predecessor.

Restricted business operations means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174).

Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—

(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;

(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;

(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.

(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service connected, as defined in 38 U.S.C. 101(16).

Small business concern—

(1) Means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and size standards in this solicitation.

(2) Affiliates, as used in this definition, means business concerns, one of whom directly or indirectly controls or has the power to control the others, or a third party or parties control or have the power to control the others. In determining whether affiliation exists, consideration is given to all appropriate factors including common ownership, common management, and contractual relationships. SBA determines affiliation based on the factors set forth at 13 CFR 121.103.

Small disadvantaged business concern, consistent with13 CFR 124.1002, means a small business concern under the size standard applicable to the acquisition, that—

(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by—

(i) One or more socially disadvantaged (as defined at13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States;

and

(ii) Each individual claiming economic disadvantage has a net worth not exceeding $750,000 after taking into account the applicable exclusions set forth at 13 CFR124.104(c)(2); and

(2) The management and daily business operations of which are controlled (as defined at 13.CFR 124.106) by individuals, who meet the criteria in paragraphs (1)(i) and (ii) of this definition.

Subsidiary means an entity in which more than 50 percent of the entity is owned—

(1) Directly by a parent corporation; or

(2) Through another subsidiary of a parent corporation

Veteran-owned small business concern means a small business concern—

(1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C.

101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and

(2) The management and daily business operations of which are controlled by one or more veterans.

Women-owned small business (WOSB) concern eligible under the WOSB Program (in accordance with 13 CFR part 127), means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States.

Women-owned small business concern means a small business concern—

(1) That is at least 51 percent owned by one or more women; or, in the case of any publicly owned business, at least51 percent of the stock of which is owned by one or more women; and

(2) Whose management and daily business operations are controlled by one or more women.

(b) (1) Annual Representations and Certifications. Any changes provided by the Offeror in paragraph (b)(2) of this provision do not automatically change the representations and certifications in SAM

(2) The offeror has completed the annual representations and certifications electronically in SAM accessed through http://www.sam.gov.
