The solicitation (1284LM26Q0109) seeks contractors to perform felling, chipping, and hauling of mountain pine beetle-infested ponderosa pine and lodgepole pine trees across three ranger districts of the Pike National Forest (South Platte, South Park, and Pikes Peak) in Colorado. Work must be completed between the date of award and May 15, 2027, with all cutting activities performed prior to campground opening dates and mountain pine beetle flight season in June. The contract is restricted to current LMIR BPA award holders; this is a single-award call order with a small business set-aside. Required services include mobilization, hand-felling of trees (2"–30" diameter breast height), mechanical chipping of material to pieces no larger than 3 inches, and hauling of chips off-site. The mandatory line items include approximately 75 trees for South Platte Ranger District, 20 trees for South Park Ranger District, and 40 trees for Pikes Peak Ranger District, with optional additional quantities of up to 100, 100, and 100 trees respectively for each district pending post-beetle survey findings.

Contractors must submit pricing for all required line items and technical capability statements addressing timeframe, personnel, equipment, deliverables, and relevant past performance. Evaluation occurs in two steps: Pass/Fail technical review followed by lowest-price award. The contract includes comprehensive specifications covering stump height (maximum 5 inches), safety planning with emergency contingencies, fire prevention and control requirements, equipment standards, site protection and restoration, and damage repair obligations for campground facilities. A post-award conference is mandatory within ten days of award. Work will be inspected daily initially for compliance with specifications, with 100 percent visual inspection of completed treatment units. 1. DESCRIPTION/STATEMENT OF WORK

The purpose of this contract is to secure services for the cutting, chipping, and hauling of designated ponderosa pine (Pinus ponderosa) and lodgepole pine (Pinus contorta) mountain pine beetle-infested trees in several campgrounds and developed recreation sites. Material will be removed to prevent the spread of the beetle to healthy trees within the recreation sites. Sites are located across the South Platte, Pikes Peak, and South Park Ranger Districts of the Pike National Forest. Cutting, chipping, and hauling will occur for the removal of mountain pine beetle (MPB) (Dendroctonus ponderosae) infested material prior to campground opening dates and MPB flight in June. Cutting of material will be conducted using hand methods only (chain saw, brush cutter, etc). Moving material, chipping, and hauling can be completed with mechanized equipment including chippers or tracked chippers, skid steerers, and/or chip vans. The Contractor shall furnish all labor, equipment, supervision, workman’s compensation, unemployment insurance, transportation, supplies, and incidentals, to perform all work necessary to cut, chip, and haul infested trees. Schedule of items and quantities may shift at time of award due to available funding.

Estimated trees to be removed at the different locations on each District may change depending on new dead or infested trees located during post beetle flight field surveys. Depending on campground opening dates and access due to snow, above line items may be subject to change.

2. SPECIFICATIONS:

General objectives:

· Trees will be designated for removal using a paint color determined before contract start. Marks will be a diagonal slash at breast height. Do not confuse with previously painted dots at stump height, these are designated spray trees from years past. Only trees marked for removal will be counted towards final payment of the contract. Felling activities shall be conducted in a manner to minimize impacts to existing live trees and shrubs within the recreation site.

· Felling may require special techniques to assist directional felling where trees are bound in other trees. Some incidental removal of other trees my be required to facilitate infested tree removal, but these are not part of the count for final payment.

· Diameters will typically vary from 2” DBH- 30” DBH on average, with the average DBH range of past years removal projects being 8”-14” DBH. Tree heights vary from 20’-85’ with the average height in trees removed in years past of approximately 50-60’. Trees selected will be in a variety of conditions from green standing, to red needles, to older dead. Green standing indicates a more recently infested tree, red dead indicates an older attack or recent decline in tree vigor, and older dead may not have needles and may be in various stages of decay.

· The list of trees, their conditions (green vs red dead vs older dead) and their diameters can be supplied upon request post Fall beetle survey.

· Some recreation sites will have limited entry periods due to opening season dates or certain closure dates of recreation sites during operations. Contractor shall work with the COR to schedule their work around temporary or seasonal closures. All work shall be completed in one recreation site before moving to the next, unless otherwise agreed in advance with the COR.

· Not all listed recreation sites on map will have trees marked for removal. They are given as examples of where infested trees have been surveyed in years past. Some recreation sites not on map may be included in contract. Specific tree numbers by Bid item and recreation site will be given in the Fall post beetle survey.

· Trees will be cut using hand methods only while skidders/chippers are allowed as long as all campground improvements are protected or repaired (see avoidance areas below).

Forked Trees: If a selected tree forks above 4.5’ (breast height), it is considered one tree for the purposes of this contract. If a selected tree forks below 4.5’, it will be counted as two separate trees.

Stump Height: Stumps shall be low-stumped, and cut as as flush to the ground as possible. No higher than 5”, at the highest point. For measurement purposes, the stumps will be measured from the highest ground level point to highest point of stump.

Chipping objectives:

While the average tree diameter is 12” DBH, contractors shall use a chipper large enough to handle whole trees at least 25” DBH. If an occasional tree is larger than the chipper capacity, an agreement for removal of the bolewood can be made between the contractor and COR. Before moving to the next recreation site, the work site must be clean with any chipping or debris removed. Chips may be hauled away in chip vans or dump trucks. All infested woody material shall be processed through a chipper to produce chips no larger than 3” in any dimension. Chips exceeding this size shall be re-chipped or removed from the site at the Contractor’s expense.

Safety:

Contractor’s operations shall facilitate the Government’s safe and practical inspection and conduct of other official duties on Contract Area. The Contractor has all responsibility for compliance with safety requirements for the Contractor's employees. If a conflict develops between the requirements of this contract or agreed upon methods of proceeding hereunder and State or Federal safety requirements, the contract shall be modified, and the Contractor may request an equitable adjustment.

a.

Contractor shall provide a copy of their Safety Plan at the Pre-Work Meeting and electronically, via email, to the COR. The Safety Plan shall be kept in the contract folder for OSHA’s review.

b.

The Safety Plan shall be available to all employees and subcontractors working on the contract.

c.

The Safety Plan shall contain contingency plans for emergencies such as medical, fire, hazardous material spills, and any other assessed hazard; as well as prevention and abatement requirements that apply to this contract.

Avoidance:

Within the Project Area, protected improvements exist which shall not be damaged during work activities. These include but are not limited to fences, gates, roads and ditches, power lines, water sewer lines, facilities including picnic tables, outhouses and vent toilets, water faucets, fire rings and grills, garbage containers, directional posts and bollards, site markers, tent pads, information boards, pay station facilities, etc. If these areas are damaged during work, the contractor must alert the COR. The Contracting Officier will determine if the damge can be satisfactory repaired or must be replaced. Work area must be left in a neat, clean state with no littering within the work area.

Sign areas to alert public that there is tree work being completed within the recreation site. Sites will generally be closed during operations, but many of the areas have year round trails that run nearby.

Slash Treatment:

No slash shall be left within the project area and will be chipped and hauled off site.

Access: Access to the area is available via public Forest Service roads. Recreation sites will generally be gated and access will be granted by the COR or through key/codes. Do not leave any gates open during work operations to reduce entry by the public. Upon leaving the work site for the day, ensure all gates are locked and secured upon exit.

Equipment: All equipment shall be in good working condition and be suitable for the work required. Equipment shall have safety signing and appertuenances required by OSHA. Equipment may be inspected by the COR at any time.

Fire Prevention and Control: For each power saw, portable pump, chipper, or other powered equipment, the Contrator shall furnish one shovel (size 0 or larger), and one dry chemical fire extinguiser, 8 oz or larger, immediately available to the operator of the equpment.

The following FAR and AGAR clauses have been added, effective April 2026:

· FAR 52.222-90, Addressing DEI Discrimination by Federal Contractors (APR 2026).

· AGAR Clause 452.203‑72 Unenforceable Supplier Terms (APR 2026) All call orders will incorporate these changes by reference at award.

Disclaimer: System updates may lag policy updates. The System for Award Management (SAM) may continue to require entities to complete representations based on provisions that are not included in agency solicitations. Examples include 52.222-25, Affirmative Action Compliance, and paragraph (d) of 52.212-3, Offeror Representations and Certifications—Commercial Products and Commercial Services. Contracting officers will not consider these representations when making award decisions or enforce requirements. Entities are not required to, nor are they able to, update their entity registration to remove these representations in SAM.

In advancement of Section 2 of Executive Order 14208, the removal of requirements related to Executive Order 14057 eliminates all non-statutory sustainability requirements or preferences in purchases of food service wares, including paper straws. In addition to removing requirements related to Executive Order 14057, the attachment also reflects recent updates to Code of Federal Regulation citations for the U.S. Department of Agriculture’s BioPreferred® Program, a statutory purchasing preference program.

These class deviations will remain in effect until rescinded or incorporated into the FAR.

The supplier agreement shall bind the ordering activity as the end user to the extent it does not conflict with the terms of this clause, but it shall not bind or impose personal liability on any Government employee or any person acting on behalf of the Government in their personal capacity.

(g) Law and disputes. The supplier agreement is governed by Federal law.

(h) Statutory exception. This clause does not apply to indemnification or any other payment by the Government that is expressly authorized by statute and specifically authorized under applicable agency regulations and procedures.

(i) Continued performance. The supplier or licensor shall not unilaterally revoke, terminate, or suspend any rights granted to the Government except as allowed by the contract. If the supplier or licensor believes the ordering activity to be in breach of the supplier agreement, it shall pursue its rights under the Contract Disputes Act or other applicable Federal statute while proceeding diligently with performance, pending final resolution of any dispute in accordance with the Disputes Clause at FAR 52.212‑4(d) or FAR 52.233‑1, as applicable.

(j) Arbitration. Binding arbitration shall not be used unless specifically authorized by agency guidance.

(k) Equitable or injunctive relief. Equitable or injunctive relief, including the award of attorney fees, costs, or interest, may be awarded against the United States Government only when explicitly provided by statute (e.g., the Prompt Payment Act or the Equal Access to Justice Act).

(l) Revisions to supplier agreements. Any revisions to the supplier agreement must be incorporated into the contract using a bilateral modification. Unilateral revisions are not binding on the Government.

(m) No automatic renewals. If any license or service tied to periodic payment is provided under the supplier agreement (e.g., annual software maintenance or annual lease term), such license or service shall not renew automatically upon expiration of its current term without prior express written consent from an authorized Government representative.

(n) Indemnification. Any clause of the supplier agreement requiring the supplier or licensor to defend or indemnify the end user is amended to provide that the U.S. Department of Justice has the sole right to represent the United States in any such action, in accordance with 28 U.S.C. 516.

(o) Taxes or surcharges. Any taxes or surcharges which the supplier or licensor seeks to pass along to the Government as end user will be governed by the terms of the associated Government contract or order and must be submitted to the Contracting Officer for a determination of applicability prior to invoicing unless specifically agreed otherwise.

(p) Non‑assignment. The supplier agreement may not be assigned, nor may any rights or obligations thereunder be delegated, without the Government’s prior approval, except as expressly permitted by FAR 52.212-4(b) or FAR 52.232-23, as applicable.

(q) Confidential information. If the supplier agreement includes a confidentiality clause, such clause is amended to state that neither the agreement nor the contract price list, as applicable, shall be deemed “confidential information.” Issues regarding release of “unit pricing” will be resolved consistent with the Freedom of Information Act. Notwithstanding anything in the supplier agreement to the contrary, the Government may retain any confidential information as required by law, regulation, or its internal document retention procedures for legal, regulatory, or compliance purposes; provided, however, that all such retained confidential information will continue to be subject to the confidentiality obligations of the supplier agreement.

(r) Conflict with Federal law. If any other language, provision, or clause of the supplier agreement conflicts or is inconsistent with Federal law or the terms and conditions of this contract, such language, provisions, or clauses will be considered null and void and will not be binding on the United States Government.

As prescribed in AGAR 433.104-4 (a)(5)(ii), the following Notice for Filing Agency Protests shall be included in every solicitation.

NOTICE FOR FILING AGENCY PROTESTS

United States Department of Agriculture (USDA) Ombudsman Program

The USDA is committed to issuing solicitations and awarding contracts in a fair and prompt manner. The Ombudsman Program for Agency Protests (OPAP) was established to address protest issues within the agency, providing an alternative to costly and time-consuming litigation. Operating independently, OPAP offers relief comparable to that granted by the Government Accountability Office (GAO). Interested parties are encouraged to resolve concerns through USDA’s internal Alternative Dispute Resolution (ADR) process before pursuing external forums such as the GAO. Concerns may be addressed informally or through a formal agency protest filed with either the Contracting Officer or the Ombudsman.

Informal Forum with the Ombudsman

1. Initial Point of Contact: Interested parties who believe a specific USDA procurement is unfair or otherwise defective should first direct their concerns to the applicable Contracting Officer.

2. Escalation: If the Contracting Officer is unable to address their concerns, interested parties are encouraged to contact the USDA Ombudsman for Agency Protests. Under this informal process, the agency is not required to suspend contract award performance. Utilization of the informal forum does not suspend any time requirement for filing a formal protest with the agency or other forums.

3. Required Information: To ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, Contracting Officer, and solicitation closing date (if applicable).

Formal Agency Protest with the Ombudsman

1. Effort to Resolve: Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the Contracting Officer through open and frank discussions.

2. Independent Review: If the protester’s concerns remain unresolved, an Independent Review is available by the Ombudsman. The protester may file a formal agency protest with either the Contracting Officer or, alternatively, with the Ombudsman under the OPAP program. Contract awards or performance will be suspended during the protest period unless justified in writing for urgent and compelling reasons or determined in writing to be in the best interest of the Government.

3. Resolution Timeline: The agency’s goal is to resolve protests within 35 calendar days from the date of filing.

4. Required Information: Protests shall include the information set forth in FAR 33.104(a)(3). Failure to submit the required information may result in a delay or dismissal of the protest.

5. Timeliness: Protests must be filed within the timeframes specified in FAR 33.104.

6. Submission: Formal protests under the OPAP program should be submitted electronically to SPE.inquiry@usda.gov and the Contracting Officer.

Election of Forum. By initiating a protest with the USDA, the protester agrees not to pursue the same matter with the Government Accountability Office (GAO) or any other external forum while the agency protest is pending. If a protest is filed externally, the agency protest will be dismissed.
