About this file
This is a contract agreement template from Cecil County, Maryland, establishing the formal terms between the county and a contractor for laboratory monitoring services, specifically wastewater and sludge sample analyses at various county locations. The contractor must complete the project within the timeframe outlined in the bid proposal, beginning upon receipt of the Notice to Proceed letter. All analytical methods performed must comply with United States EPA approval and Maryland Department of the Environment requirements for the applicable sample matrices. The contract emphasizes that time is of the essence and that no extra work or materials beyond those specified in the contract and bid proposal will be compensated unless ordered in writing by Cecil County. The only exception allows the Director of the Department to issue verbal orders for emergency work or to prevent project delays, provided such orders are reduced to writing within twenty-four hours.
Cecil County agrees to pay the contractor the aggregate cost as proposed in the bid, calculated from the unit and lump sum prices submitted in the contractor's proposal. The contractor bears all risk, cost, and expense for any work or materials performed without prior written authorization and forfeits compensation for such unauthorized work. The contract requires execution by both the county and contractor with appropriate signatures, notarization, and company seals. Approval by the Cecil County Attorney's office is required for legal sufficiency before the contract becomes effective.
