About this file
This is a Buy American Certification document for construction projects funded by the Federal Aviation Administration (FAA) and involves the Kenton County Airport Board (KCAB) in Kentucky for the Terminal Drive Bridge Rehabilitation project. The document outlines compliance requirements with 49 USC 50101, which mandates that all steel and manufactured goods used in FAA-funded airport improvement projects must be produced in the United States unless an FAA waiver has been issued, the product is listed as an excepted article under Federal Acquisition Regulation subpart 25.108, or the product appears on the FAA Nationwide Buy American Waivers Issued list. Bidders must submit this completed certification with their proposals by the deadline of Thursday, July 2, 2026 at 2:00 pm, with a pre-proposal meeting and site visit scheduled for Wednesday, June 10, 2026 at 10:00 am at CVG Centre Admin. Offices in Erlanger, Kentucky. Questions regarding the project are due by Thursday, June 18, 2026 at 11:59 pm, with answers posted no later than Tuesday, June 23, 2026.
Bidders must select one of three mutually exclusive certification options: compliance using only U.S.-produced steel and manufactured products; installation of products with FAA-issued waivers; or installation of excepted articles listed in FAA regulations. Alternatively, the apparent low bidder may request a Type 3 waiver (demonstrating that U.S. component costs exceed 60 percent of total item costs) or Type 4 waiver (showing that total project costs using U.S. domestic products exceed non-domestic costs by 25 percent), with required documentation submitted within 15 calendar days of bid opening. Bidders must provide evidence documenting the source and origin of all steel and manufactured products and agree to furnish U.S. domestic products for any rejected waiver requests. False certifications may result in federal prosecution under Title 18 of the United States Code and 49 USC 47126.
