About this file

This is a federal contracting provision template for the Buy American Certificate clause (October 2022), which establishes requirements for certifying the domestic content of products in federal procurements.

The provision requires offerors to certify that each end product, with specified exceptions, is a domestic end product containing a critical component. Offerors must separately identify foreign end products manufactured in the United States that do not qualify as domestic end products. For foreign end products not consisting wholly or predominantly of iron, steel, or their combination, offerors must indicate whether domestic content exceeds 55 percent, unless the items are COTS (Commercially Available Off-The-Shelf) products. The provision includes three structured sections: section (a) containing the primary certification requirements; section (b) for listing foreign end products by line item number, country of origin, and whether they exceed 55 percent domestic content; and section (c) for separately listing line item numbers of domestic end products containing critical components. Terms including "COTS item," "critical component," "domestic end product," "end product," and "foreign end product" are defined in the corresponding "Buy American-Supplies" clause within the solicitation. Evaluation of offers will follow the policies and procedures outlined in Part 25 of the Federal Acquisition Regulation.
