About this file
This is a federal contracting clause template for the "Buy American Certificate" provision, effective October 2022, prescribed under FAR 25.1101(a)(2).
The clause requires offerors to certify that all end products, except those listed as exceptions, are domestic end products containing critical components. Offerors must separately identify any foreign end products manufactured in the United States that do not qualify as domestic end products. For foreign end products that are not wholly or predominantly composed of iron, steel, or combinations thereof, offerors must indicate whether the domestic content exceeds 55 percent, except for COTS items (selecting "no" if the percentage is unknown). Offerors must also separately list by line item number all domestic end products that contain critical components. The clause defines key terms—including "commercially available off-the-shelf (COTS) item," "critical component," "domestic end product," "end product," and "foreign end product"—by reference to the "Buy American-Supplies" clause within the same solicitation.
Section (b) provides a blank table for listing foreign end products by line item number, country of origin, and whether they exceed 55 percent domestic content. Section (c) requires listing line item numbers of domestic end products containing critical components. Section (d) specifies that the Government will evaluate offers in accordance with Federal Acquisition Regulation Part 25 policies and procedures.
