About this file

This document is an Amendment No. 1 to a Request for Special Procurement (BS1401-23) issued by the Marion County Business Services Department in Oregon. The amendment extends the time period of the original request from July 1, 2023 to June 30, 2024, to July 1, 2023 to June 30, 2026. It also increases the total estimated cost from $16,200 to $98,000. The purpose of the special procurement is to allow the County to continue leasing a 28' x 64' mobile office unit from Modern Building Systems (now William Scotsman Inc.) that was originally leased in October 2020 to provide office space for assisting residents impacted by the Beachie Creek wildfire. The County is proposing to directly award this lease agreement on a month-to-month basis as a special procurement, as there is not significant competition in the local mobile/modular unit market. The County justifies the special procurement by stating that replacing the existing unit would incur significant additional setup and removal costs of $40,000 to $50,000, and the current provider has offered a lower monthly lease rate to support the County's recovery efforts.

The amendment includes the County's findings that this special procurement meets the standards of being unlikely to encourage favoritism or diminish competition, and will result in substantial cost savings to the County and the public. The Chief Administrative Officer or designee must authorize the special procurement, and the public has the opportunity to protest the decision by the specified deadline.

Title: Supplies and/or Services to be Acquired:

Lease Agreement for 28’ x 64’mobile office unit located in Gates.

Request, Background and Proposed Contracting Procedure:

a. Request:

Business Services requests approval of this Special Procurement to allow the County to continue leasing the modular mobile office unit leased from Modern Building Systems beginning in October 2020 through June 30, 2026.

b. Background:

In October 2020, Marion County Business Services entered into a Lease Agreement with Modern Building Systems, n/k/a William Scotsman Inc., to provide a modular unit as office space. The unit was to be used for public assistance with FEMA Disaster Assistance applications, processing Right of Entry forms, document replacements, and coordination of local resources to the residents impacted by the Beachie Creek wildfire. The unit was originally leased from Modern Building Systems under a retroactive Justification for Noncompetitive Procurement (JNCP) approved in January, 2021, amended and approved September 28, 2021.

c. Proposed Contracting Procedure:

Business Services proposes the continued utilization of the existing Lease Agreement on a month-to-month basis a Direct Award Special Procurement for this Lease Agreement.

Justification for use of Special Procurement: Describe the circumstances that justify the use of a Special Procurement. Attach relevant documentation.

While the exigency of a still active wildfire that supported the JNCP no longer exists, the need does still exist.

The unit is serving as a base for various groups assisting the residents of Gates and the surrounding communities with the recovery and rebuilding efforts.

Findings to Satisfy the Required Standards: This proposed special procurement:

___X__ (a) will be unlikely to encourage favoritism in the awarding of public contracts or to substantially diminish competition for public contracts because:

The modular unit currently in use was sourced from the only manufacturer and dealer of mobile and modular units domiciled within Marion County. There is not significant competition in this market.

and

___X__ (b)(i) will result in substantial cost savings to the contracting agency or to the public because:

Marion County would incur additional set up and removal charges of approximately $40,000 to $50,000 to replace the existing modular unit with a different modular unit. The current provider also has granted Marion County a significantly lower monthly lease rate in an effort to support the residents of Marion County.
