UNITED STATES GOVERNMENT
Memorandum
U.S. FISH AND WILDLIFE SERVICE
NWRS/Division of Lands, Portland, OR
TO: Ivars Stolcers, Realty Branch Chief DATE: June 14, 2017 ..
FROM: David Hills, Regional Land Surveyor u_S~ ... 1 ~~~) SUBJECT: Preliminary Land Surveyor Report LA - ID, Bear River WCA
Lawrence Fox Tract (llC, -1)
In response to your request this is a preliminary assessment of this tract, based on the provided:
IZI Vesting deed( s) IZI Adjoiner deed(s) IZI Preliminary Title Commitment: Stewart Title Guaranty Company Order No.NTF-77622 dated May 6, 2016 IZI Title Exception Documents IZI Other: Franklin County recorded Surveys and CP&Fs, GLO Surveys, County road information
If and when the non-federal party signs an offer to purchase, or an Exchange or Donation Agreement, we will prepare a Land Surveyor Report pursuant to the Standards of Boundary Evidence, 600 DM 5 and the Service Manual 343 FW 1-2. No analysis of the mineral estate or appurtenant water rights was requested for this report, and no field visit was carried out.
General Information and Location:
The subject tract is a conservation easement, covering approximately 3,270 acres ofrolling to rugged crop and range land in sections 3, 4, 9, 10, 11, 12, 14, 15, 16, and 22 in T12S R40E, BM Franklin County Idaho. The easement covers most but not all of the seller's ownership, with certain areas intentionally not included so that the sellers' future use wi!l not be encumbered.
See attached maps Exhibit D,1-3. Note that the Title Commitment gives vesting in approximately five individuals or entities; based on discussions with your staff, this report assumes that only Lawrence B. Fox and Jana Le Fox are actually in title, and that they hold jointly.
The easement tract contains all of 18 assessor's parcels, all of one parcel which is not numbered by the Franklin County Assessor's office, and parts of three other parcels. Sub-tract (11 C) is separated from sub-tract (11 C-1) by lands of the sellers not included in the easement. The tract lies entirely within the boundary of the Bear River Watershed Conservation Area, and is being submitted for appraisal.
Land description:
The description referenced in the Title Commitment has a number of shortcomings and is NOT suitable for use: it includes some land that is not part of the proposed easement, it was assembled piece by piece from the various vesting deeds, and so is lengthy and hard to follow; and finally it includes an area where the description conflicts with the neighbor’s description. To resolve these issues, I have prepared a Preliminary Description based on the sellers’ vesting deeds, and on conversations involving the seller, the Refuge staff and Realty staff (see Exhibits A, B and C). It contains a combination of aliquot part, metes and bounds, and strip descriptions; it is suitable for the purposes of appraisal and offer, but is NOT suitable for final conveyance. At least one exclusion area must be surveyed to develop the final description.
The sellers’ record description is in harmony with those of the adjoining landowners, with the one exception mentioned above: a small roughly triangular parcel, about 1 acre in size, in the SW1/4NW1/4 section 12 has both gaps and overlaps with the neighbor’s vesting deed. Some chain of title research was unable to resolve this issue, so a “Discrepancy Parcel” description (Exhibit C) approximately covers the area that is actually fenced and occupied. A boundary agreement or correction deed may be required before closing, but the preliminary description is suitable for appraisal and offer.
Acreage:
The subject easement tract is estimated to contain 3,270 acres in total. This is derived using the best available data in the following hierarchy: first General Land Office survey data, then GIS/ record calculations. The GIS calculations are based on a combination of several data sources: a Public Land Survey System grid derived from USGS features (technically called the DRG’s), the digitized location of roads and the bank of Bear River taken from aerial imagery, and calculated lines based on record deed dimensions. The 1-acre exclusion parcel (11Cz) on the east side of North Cleveland Road in the SW 1/4 of section 12 was based on the instructions of the seller and digitized from aerial images. A nominal right of way width of 60 feet was used in excluding the right of way of North Cleveland Road from the easement.
The information available from Franklin County Assessor’s records was obtained and compared with our acreage values. In general, the County also uses the GLO record acreage, but otherwise the reliability of the County data was considered low and not used. Several tax parcels are only partly included in the easement, so the County acreage was not relevant to this report. The tract acreage is broken down in Exhibit E. Note that provision of acreage to two decimal places in that table does imply a corresponding level of accuracy.
Tract GLO/ GIS Acreage
(11C) 3,039 (11C-1) 231
Total Tract (11C, -1) 3,270
Access:
Access to the tract is via North Cleveland Road, maintained by the Franklin County Road and Bridge District, which roughly parallels Bear River in a north-south direction and crosses through the seller’s lands. A publicly maintained road (name not certain) branches off of North Cleveland south of the tract, and proceeds northwesterly near the southerly boundary of the tract to its terminus in section 16. A small publicly-maintained spur road branches west off of North Cleveland in the NE 1/4 of section 14, crosses a private tract and comes close to, or intersects the easterly boundary of the seller’s property.
Several field entrances give access to Tract (11C-1) directly from North Cleveland Road, but for the most part, physical access to the tract from the public roads is via a network of privately-maintained gravel or unsurfaced roads. The history of these roads was not investigated in detail, but according to the seller, many of these roads were originally maintained public roads that were “abandoned” by the District about 10 years ago. Whether this means that there was a formal vacation process completed or simply a cessation of maintenance was not investigated, but this report makes two assumptions:
1) the seller has obtained rights, either formally or by prescription, to continue using these former public roads,
2) other parties are crossing the subject tract under the same circumstances to access their property.
It is further assumed that the easement document will permit use by the government of the roads designated on Exhibit D for purposes of managing and monitoring the easement.
Title Exceptions
This Assessment does not address mineral interests, taxes and/or assessments, grazing rights, or unrecorded agreements other than those noted herein. The Title Commitment lists a large number of Title Exceptions in Schedule B.

Discussion
3. 4. 9. Roads, ditches, fences, canals, transmission lines, utilities, encumbrances, and encroachments
See Access and Encumbrances section.
7. Riparian Issues The Bear River is not identified as a navigable river on the list of navigable waters on the Idaho Department of State Lands website and for the purposes of this report, the Bear River is presumed to be navigable. The seller’s ownership presumably includes a portion of the bed of Bear River; a clause to that effect is included in the preliminary description, but acreage totals do not reflect any ownership within the river.
10. Ditches and Canals Maintenance of the ditches and canals on the property does not impact the Purpose and Intent of the proposed Conservation Easement.
11. Instrument No. 84533, recorded 2/15/1950
13. Instrument No. 93909, recorded 6/16/1954
Transmission Line Easements
A perpetual easement and ROW for the erection and continued maintenance, repair, alteration and replacement of a single pole electrical transmission, distribution and telephone circuits to Utah Power & Light Company. Utah Power & Light is now operated by Rocky Mountain Power Company, a division of PacificCorp.
A centerline is described which encumbers SW1/4NE1/4, NW1/4SE1/4, and W1/2SE1/4 of Sec. 12. This line appears to be in use, running north-south through the Bear River floodplain.
12. Instrument No. 88521, Recorded 10/24/1951
Unknown ROW reserved
A right of way of two acres was reserved from the sale of the S1/2SW1/4 of Sec. 3 and N1/2NW1/4 of Section 10.
Appears to be in reference to a road which is referred to as Hansen Road in some data sets. Current aerial imagery depicts a single lane farm road. Discussions with Mr. Fox indicate this may have once been a county road that has since been abandoned.

An easement for a right-of-way 315 feet in width for 2 electric transmission lines to Pacific Power and Light, a division of PacificCorp.
Encumbers S1/2NE1/4, SW1/4, and NW1/4SE1/4 of Section 10, S1/2N1/2 of Section 11, and SW1/4NE1/4 and SE1/4NW1/4 of Section 12, with two metal transmission poles. See Exhibit A of each instrument for exact location of the transmission line.
This easement is currently in use.
NOTE: See exception No. 33 for the easement covering this transmission line in section 16.
23. Instrument No. 159639, recorded 7/9/1982
Water Rights
This appears to describe potential water rights that would impact the N1/2NW1/4 of Section 15. Water rights are outside the scope of this report. See the Water Rights review for more detail.
25. Instrument No. 172921, recorded 7/16/1986
Anchors for Transmission Line
See Exception 11.
This is an easement to add additional guy wires and anchors to the existing transmission lines in the SW1/4NE1/4 of Section 12.
This easement is assumed to be in use.

Patent Reservations for Ditches, Canals, and Minerals
The United States reserved the right for ditches and canals, as well as all mineral deposits over the SE1/4SE1/4 of Section 15 and the NE1/4NE1/4 of Section 22. There are no apparent ditches or canals and I am unaware of any Federal irrigation projects encumbering this portion of the Fox property.
29. Instrument No. 207850, recorded 10/12/1999
Access Easement
A prescriptive access easement over a road referred to as Buttermilk Road was granted to the Trustees of the Forsgren Family Trust and their heirs. Buttermilk Road runs west along the north section line of Section 11 beginning from a “T” intersection with Cleveland Road to the corner of Sections 2, 3, 10 and 11. It then runs north along the east section line of Section 3 to the northeast corner of the SE1/4SE1/4 of Section 3. Buttermilk Road continues southwesterly through the S1/2SE1/4 of Section 3 and the NW1/4 of Section 10 to the southwest corner of the NW1/4 of Section 10 where it continues to the southwest off of the Fox property.
Allowed uses include ingress and egress for the purpose of ranching operations limited by the number of livestock that can be maintained on the property of the easement holders, transportation of farm equipment, limited firewood cutting and hauling, and limited recreational use. The easement holders are also allowed to maintain the roadway in order to make it passable by normal vehicular travel if the Foxes do not maintain it. The easement holders are not allowed to use Buttermilk Road to access dwellings constructed on their property. The allowed uses of Buttermilk Road do not appear to interfere with the proposed Conservation Easement over the Fox property.
30. Instrument No. 212415, recorded 2/28/2001
Water Well Easement
A perpetual easement permitting access to a well in the NW1/4NW1/4 of Section 14. No well is visible on aerial images, but numerous small roads and tracts may be fulfilling this function.
Water rights are outside the scope of this report. See the Water Rights review for more detail.
31. Instrument No. 239747, recorded 11/21/2007
Access Easement Termination
(See exception 29)
Termination of the access easement over Buttermilk Road, originally recorded 10/12/1999, Instrument No. 207850, for two of the trustees listed in the original easement (Gilbert O. Holyoak and LaNae C. Holyoak). The original access easement is still valid for the other trustees listed in the judgment.
32. Instrument No. 253483, recorded 12/9/2011
Water Rights, Oil, & Geothermal
Portions of the water rights, and oil and geothermal rights were reserved. Both are outside the scope of this report. See the Water Rights review for more detail on the water rights reserved.
33. Instrument No. 246650, recorded 9/23/2009 referencing
State Easement 4424-A (unrecorded)
Transmission Line
A personal representative deed granting ownership to Lawrence Fox from his father’s estate. The deed references State of Idaho Easement No. 4424-A to Pacific Power and Light and State of Idaho Oil and Gas Lease No. 0-7809.
The Idaho Department State of Lands records indicate that Oil and Gas Lease No. 0-7809 has been cancelled, as well as Geothermal Lease No. 4465-16-79.
State of Idaho Easement No. 4424-A grants Idaho Power Company and Pacific Power and Light Company an easement to construct two 345 KV transmission lines, encumbering the NE1/4NW1/4 and the NW1/4NW1/4NE1/4 of Section 16. This easement is currently in use.
Two other easements are referenced in Easement 4424-A:
No. 239 and 2559-A. Neither affects the subject tract.
N/A
Existing electric transmission lines (No easement listed)
Aerial images show that two electric transmission lines – a steel tower line and a two-pole wood structure line – run together north-south through sections 4, 9 and 16. No easement documents are referenced in the title report covering this use, although they are presumed to exist.
Other Encumbrances/ Unauthorized Uses:
An examination of aerial images indicates that the land use on the subject tract is basically the same as on the surrounding tracts: a combination of dryland farming, irrigated farming and grazing. The vast majority of the tract boundaries are defined by fences or other use lines visible on the images, and within that perimeter, with one exception, no unauthorized uses are visible.
The one exception is a small area at the southeast corner of tract (11C), where about a half-acre of the sellers’ land appears to be grazed by the neighbor to the south (see Exhibit F-1). The sellers should be questioned about this area to determine their understanding of the ownership.
Another exception within tract (11C-1) is the east line of the SW1/4NE1/4 section 12 north of Bear River (see Exhibit F-2). In this area, the fence between the seller’s land and the adjoining center-pivot irrigated field is angled to the northwest about 10 degrees off of cardinal. Again, the sellers should be questioned about this area to determine their understanding of the ownership.
As noted under Title Exceptions, there are 2 two-line high voltage electric transmission corridors crossing the tract, one of which is not referenced in the title report. As noted under Access, a network of apparently well-maintained and used roads crosses the tract, serving the seller, the neighbors and the maintenance of the transmission lines.
A few small structures, believed to be well houses or hay sheds are located on the tract, and are presumed to be in use by the sellers. One large hay shed appears to be located on the sellers’ other lands but very close to the easement boundary. This is near the northwest corner of the SW1/4SW1/4 section 12. As farm buildings of this type are an allowable use of the easement, it will be up to the seller to determine if they want it inside the easement or not. A minor adjustment could be made to the boundary pre-closing to take care of any issues.
Land Survey/ Boundary Management:
Survey History: The east half of T12S R40E BM was surveyed by the GLO in 1873, using a combination of granite stones and aspen stakes to mark the corners. The Township was completed in 1913, after the implementation of the Direct System, and the corners were monumented with brass caps. Apparently from recovered monument caps, the same year the Bannock County Surveyor carried out retracement and remonumentation surveys in the eastern half of the Township (this part of Franklin County was a part of Bannock County from 1893 to 1946).
As a courtesy to the Service, the BLM Idaho State Office carried out survey research for the part of the Township surrounding the tract. No private surveys were located for the tract or any adjoining properties; however, approximately 22 Corner Perpetuation and Filing (CP&F) records were found for corners controlling the subject tract (see Exhibit D). It appears that there has been widespread corner loss in the easterly-most tier of sections, but importantly the section corners on the east line of sections 11 and 14 have been preserved. The southwest corner of section 14 and the northeast corner of section 3 provide some control in the east half of the Township, and most, if not all of the GLO brass caps in the West Half of the Township appear to have survived.
Boundary Management: Almost all of the easement boundaries are common with the boundaries of the seller’s underlying fee ownership, and are fenced. Since these fences appear to be more or less in harmony with the sellers’ record ownership, no survey or posting of these boundaries will be required. It is not clear from the images whether the boundary in section 22 has been fenced, but the land use in this area appears compatible, so no survey or posting will be required there, either.
There are four internal boundaries that will require survey and posting:
1) The Jason and Lindsay Fox property in section 14: In 2014, the sellers conveyed a 30-rod east-west by 100 rod north-south (495’ x 1650’) rectangle in the northeast corner of section 14 to their son and daughter in law. This parcel was intended to contain an existing residence, a large barn or shop and a number of smaller structures. Scaling on aerial images however indicates that the parcel is not large enough in an east-west direction to include all of these improvements. Based on discussions with the sellers, the description of this easement tract excludes an additional 10 rods along the west side of that parcel, so that in the future the sellers can adjust their fee boundary to create a 40-rod by 100 rod parcel without affecting the easement.
At a minimum, the east boundary of the easement should be posted, although the corner monuments cannot be set unless the south line of section 11 is established (see discussion below).
2) The SW1/4 section 12 west of North Cleveland Road is owned by the sellers but is excluded from the easement. The easement boundary – the line between sections 11 and 12 – is not fenced or marked in any way. This section line should be posted to put future owners and easement managers on notice as to the easement boundary and avoid future conflicts.
3) The small cluster of farm buildings on the east side of North Cleveland Road in the SW1/4 of section 12 is designated in this Report as Tract (11Cz) and is excepted from the easement.
This exception tract contains 1.06 acres, and is described based on directions from the seller.
The corners will be monumented at agreed-upon locations, and those surveyed dimensions will be reflected in the final easement description.
4) The seller wishes to retain the right to develop cabins, trailer pads and associated facilities as a family recreation area (referred to as the “Building Envelope” in the easement document) in a portion of the tract designated for convenience as the SE1/4NE1/4 section 10. The controlling corners for section 10 have not been documented on any CP&F’s, and the restoration of those corners sufficient to define the SE1/4NE1/4 could entail an expensive survey. The recommended alternative is to create a 40-acre polygon with corners and lines designated by the sellers on the ground, and to monument, post and describe the recreation area accordingly.
Survey Recommendation: As a matter of policy, a geo-referenced map is the minimum requirement to allow future managers to quickly evaluate the status of the easement. It has been apparent in the development of this report that the most commonly-used representation of the Public Land Survey System – the BLM GCDB or Geocommunicator – is inaccurate in this area in the amount of about 80 feet in a north-south direction and a variable amount in the east-west direction. A corner search, recovery and tie effort should be considered to improve the accuracy of this mapping.
The minimal survey required to carry out the boundary posting recommended involves the following items:
1. Recovery and tie to the NE corner section 11, NE corner section 14, SE corner section 14
2. Search for and ties to the E 1/4 section 14, the E 1/4 section 11, the S1/4 section 11 and the SE corner of section 11.
3. Posting of the east line SE 1/4 section 11
4. If the south line of section 11 is established, monument and post the north, west and south boundaries of the 40-rod x 100-rod parcel in NE1/4 section 14.
5. Mark and tie the corners of the (11Cz) exception parcel and the Building Envelope as indicated by the sellers. Calculate the required acreages, monument the corners, and post the lines.
A land survey cost estimate will be provided upon request.
