About this file
This document is a Justification for Other Than Full and Open Competition (JOFOC) for a sole-source procurement by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).
The ATF's Forensic Science Laboratory–Washington and Forensic Science Laboratory–Atlanta require procurement of two (2) Bruker EIGER2 R 500K detector upgrade packages to replace obsolete detectors in existing Bruker D8 Discover X-ray Diffractometers (XRDs). The detectors are used in the explosives and trace section for casework and research. Each upgrade package includes the EIGER2 R 500K multimode detector with specified technical capabilities (including micron-precise repositioning, continuously variable sample-to-detector distance from 100mm to 500mm, hybrid photon counting technology, and 75-micron pixel size), a Bruker universal detector mount and I/O Board, a Dell computer with Windows 11, Diffrac.MEASURE Center software, and Diffrac.EVA software. All items must be brand new, certified to OEM specifications, and covered by a one-year manufacturer warranty. Installation by a certified Bruker technician is included. One detector will be delivered to the National Laboratory Center in Beltsville, Maryland, and one to the Forensic Science Laboratory–Atlanta in Atlanta, Georgia. Estimated cost is $348,150 with anticipated 25% discount from Bruker due to detector obsolescence. Required delivery is within ninety (90) days of contract award, with installation within one month of delivery. The procurement is conducted under sole-source authority (RFO 6.103-1) because Bruker AXS is the only responsible source for these replacement detectors. Market research confirmed no alternative suppliers exist. The contracting officer is Steven Jaimes, and the COR is Cynthia Carter. The JOFOC was approved on August 12, 2026.

Version June 2026
Atlanta (FSL-A) has a requirement for the procurement of two (2) Bruker EIGER2 R 500K detector packages. The current detectors in the X-ray diffraction instruments were brought over from older systems when new XRDs were procured a few years ago. These detectors will now be obsolete and no longer covered under any instrument warranties for parts or service. The Instruments run approximately 500K each and it benefits the government to purchase just the replacement detectors.
The XRD is used in the explosives and trace section for casework and research to continue to keep ATF up to date in the analysis of explosives.

The estimated cost for this purchase is $348,150 with a Required Delivery Date (RDD) no later than ninety (90) days after award. It is anticipated that Bruker will provide the government with a 25% discount on the detector upgrade package since the current detectors will be obsolete in the next year.
4. Identify statutory authority permitting other than full and open competition.
This acquisition is conducted under the authority of 41 U.S. Code § 3304 – Use of Non-Competitive Procedures and the exceptions listed under RFO 6.103 – Other than full and open competition.
(Check the appropriate box for the authority – and bold the statement)
RFO 6.103-1 Only one responsible source and no other supplies or services will satisfy agency requirements.
RFO 6.103-2 Unusual and compelling urgency.
RFO 6.103-3 Industrial mobilization; engineering, developmental, or research capability; or expert services.
RFO 6.103-4 International agreement.
RFO 6.103-5 Authorized or required by statute.
RFO 6.103-6 – National Security
RFO 6.103-7 Public Interest
5. Services: A statement demonstrating the unique qualifications of the proposed contractor or the nature of the action requiring use of the referenced authority.
Dectris is the manufacture of the EIGER2 R 500K detector specifically made for the Bruker AXS Inc D8 Discovery X-Ray Diffractometer (XRD). According to the sole source letter from Bruker AXS LLC, they are the sole source provider for the sales of the detector upgrade package.
Version June 2026
6. A description of efforts made to ensure offers/quotes were solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by RFO 5.1 and, if not, which exception under RFO 5.201(b) applies.
In accordance with RFO 5.1, a pre-solicitation notice was not issued as this requirement is exempt in accordance with RFO 5.101(b)(1)(i), however a sole source notice and redacted JOFOC will be posted on SAM.gov upon approval of this justification. The program office does not anticipate any responses as there is only one vendor who can provide the required replacement detectors. Any responses received will be sent to the program office and placed in the file.
7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the contracting officer that the anticipated cost to the government will be fair and reasonable.
The Government estimated cost is $348,150 which is based on the apparent fair market value and market research conducted. Bruker AXS is the sole provider of replacement detectors for the XRD system. FSL-A and FSL-W made the decision to replace the detectors instead of procuring two (2) new systems that would cost the government approximately $1,000,000. By awarding this effort for just the replacement detectors, the Government would save almost $650,000. The anticipation is that Bruker will provide the government with a 25% discount on the detector upgrade package since the current detectors will be obsolete in the next year. The CO will determine price reasonableness by comparing the quoted price to the IGCE.
8. A description of the market research conducted and the results or the reason market research was not conducted.
Market research was performed in accordance with the information documented in the MR report memo. The results of market reached identified that the replacement detectors can only be provided by Bruker AXS. See Section 5 above for additional information provided in the vendor’s sole source letter.
See Section 11 for actions the Bureau will take to remove or overcome any future barriers to competition.
9. Any other facts supporting the use of other than full and open competition.
N/A – See Sections 5 and 8 above regarding the use of other than full and open competition.
10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.
