About this file
This document is a Brand Name Specification Determination for the Oregon State Police, dated October 14, 2025. The agency requires Waters Corporation brand vials for forensic instruments, with an estimated total contract value of up to $250,000 over five years, anticipating approximately 100 cases every six months. The procurement is specifically for specialized vials that are compatible with the agency's existing forensic laboratory instruments and meet their complex technical requirements and validation procedures.
The determination justifies the brand-specific procurement through four key findings: (a) the specification will not encourage favoritism or diminish competition due to available distributor competition, (b) it will result in cost savings compared to alternative high-recovery vials on state price agreements, (c) Waters brand vials are currently the best option meeting quality and performance standards, and (d) the vials are essential for efficiently utilizing existing forensic instruments. The procurement is authorized under Oregon Revised Statutes ORS 279B.200-215 and Oregon Administrative Rules OAR 125-247-0691, with approval granted by the Delegated Procurement Officer.
