About this file

Summary

This is a Brand Name Specification Determination document issued by the Oregon State Police (OSP) on August 5, 2022, for the procurement of Defense Technology less-lethal munitions for the agency's SWAT and Mobile Response Team (MRT) weapons systems. The procurement covers crowd control devices, first responder equipment, tactical/SWAT munitions, and training devices through a six-year price agreement with a not-to-exceed estimated cost of $150,000. OSP determined that Defense Technology is the sole manufacturer meeting the agency's specific quality, performance, and functionality requirements, noting that the SWAT/MRT teams have exclusively used Defense Technology munitions for at least four years and have trained extensively with these specific products. The agency justified the brand name specification based on the critical nature of weapon compatibility and officer familiarity, emphasizing that identical munitions are essential for life-and-death tactical operations. The determination was approved by Sharon Domaschofsky, Designated Procurement Officer, via email on August 10, 2022, with the agency planning to issue a competitive solicitation through OregonBuys to secure multiple distributors of the Defense Technology product.

The procurement is authorized under ORS 279B.200-215 and OAR 125-247-0691, with the agency finding that multiple distributors of Defense Technology less-lethal munitions exist in the marketplace, thereby encouraging competition despite the brand name specification requirement. No specific incumbent information, set-asides, or alternative funding sources are detailed in the determination document. The decision reflects the agency's position that operational safety and training consistency justify the exclusive brand specification, as officers require hands-on experience with identical munitions to maintain tactical proficiency and ensure mission-critical reliability.
