DEPARTMENT OF THE NAVY

NAVAL FACILITIES ENGINEERING COMMAND, ATLANTIC

6506 HAMPTON BLVD

NORFOLK VA 235085

J&A No. 20-17

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity:

The contracting activity is Naval Facilities Engineering Command (NAVFAC) Atlantic.

2. Description of the Action Being Approved:

This justification requests approval permitting other than full and open competition to authorize utilization of brand name control system hardware and diesel generator set for Solicitation N62470-20-R- 1006, Service Life Extension Program (SLEP) II contract for the Craft-class portal cranes located at Norfolk Naval Shipyard (NNSY) and Puget Sound Naval Shipyard (PSNS).

3. Description of the Supplies/Services:

Proposed design-build contract for the SLEP at NNSY in Portsmouth, VA and PSNS in Bremerton, WA, includes a requirement to replace the existing Rockwell DC drives and Caterpillar Diesel Generator (DG) set. The use of brand name Nidec Avtron ADDvantage-32 Plus DC drives, Volvo Penta diesel engines and Marathon generators with specific MFR/Model components in the acquisition is essential to the Government’s requirements, thereby precluding consideration of a product by another company, as justified below.

4. Statutory Authority Permitting Other than Full and Open Competition:

The statutory authority for this acquisition permitting other than full and open competition is 10 U.S.C.

2304 (c)(1), as implemented by FAR 6.302-1 and 6.302-1 (c), as only one responsible source and no other supplies or service will satisfy the agency requirements; specifically, only the brand name control system hardware and diesel generator set identified meet the Government’s requirements and other brands cannot therefore be considered.

5. Rationale Justifying Use of Cited Authority:

The Government has invested significant resources into supporting Nidec Avtron DC drives, Volvo Penta diesel engines and Marathon generators utilized on a SLEP involving 11 Craft class portal cranes, under contract N62470-14-D-5001. Seven additional Craft-06class portal cranes require a separate SLEP contract, which is the subject of this document.

The Government investment includes accumulation of an inventory of spare replacement parts(only compatible with the identified drives and DG sets), substantial investment in training to specialize engineers and maintenance technicians with the knowledge and understanding to service these drives and DG sets, and accumulation of several years of hands-on field service experience amongst these personnel in repair and reliability improvement to this specific equipment.

J&A No. 20-17

The Government cannot feasibly support the additional bandwidth of electrical technologist personnel needed to support different drive systems on its primary portal crane class (Craft). This skill is historically in short supply and subject to quick turnover in the shipyard. The Government, of necessity, would rely on continuous contracted technical support at significant cost over the life cycle of the cranes. Even so, this approach would not meet the time-critical response to crane breakdown necessary to support Navy ship schedules.

Additionally, the Naval Sea Systems Command Crane Quality Manual (Rev 7) requires corporate configuration control amongst crane classes, such that specific design and components are common to the class of cranes. Therefore, the cranes covered under a second Craft SLEP contract shall be specified to use the same major components as in the first contract (i.e., Nidec Avtron DC drives, Volvo Penta diesel engines and Marathon generators), and the Government investment in people and material resources supports the efficiencies and cost savings of this strategy. The products from these manufacturers are essential to the Government’s requirements and no other products can meet these requirements.

Moreover, to the extent other firms believe they may be able to offer comparable products, conducting competition as to this item on the second SLEP contract, in a manner that may result in a different supplies being incorporated into this highly specialized equipment, would result in substantial duplication of cost (e.g., re-training of personnel, revision of processes, re-stocking spare parts), that is not expected to be recovered through competition.

Cost information is provided below for the purchase of the systems requested. The total estimated cost associated with the purchase of the brand name components is .

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable:

A sources sought notice was published to beta.SAM.gov on 30 April 2020. The intent was to identify potential offerors and to notify the market of the government’s intent to utilize brand name drives and DG sets. The government received responses from three capable firms. None of the responses indicated that there would be a problem utilizing brand name drives and DG sets for the proposed SLEP II. Similarly, no response was received from any firms advising that they could provide alternative drives and/or DG sets that could also meet the Government’s requirements.

For the reasons set forth in Paragraph 5, other than full and open competition is in the government’s best interest. However, in an effort to solicit from as many offerors as practicable, only a portion of this acquisition is other than full and open competition. Utilization of a brand name will only be for the control system and the diesel generator set.

7. Determination of Fair and Reasonable Cost:

The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition:

For the reasons set forth in Paragraph 5, NAVFAC Atlantic has no plans at this time to compete future contacts for the types of supplies/services covered by this document. If another potential source emerges, NAVFAC Atlantic will assess whether competition for future requirements is feasible.

CERTIFICATIONS AND APPROVAL

This justification covers only the portion of the acquisition, which is brand name or peculiar to one manufacturer. Therefore, in accordance with FAR 6.302-1 (c)(ii)(A), the approval level requirements only apply to that portion.
