About this file

This is a Brand Name Justification document supporting a simplified acquisition for a medical motorized power weight transport cart system. The Department of Veterans Affairs (VA), Veterans Integrated Service Network (VISN) 15, Network Contracting Office 15 in Rolla, Missouri is procuring the IMMO 100902 IMMO WLT 550kg/1,210lb weight testing cart in standard white finish and the associated 100613 strap and hardware kit. The estimated contract value is $16,048.00 on a firm-fixed-price basis. The justification establishes that this procurement does not provide for full and open competition under FAR 6.302-1(c), as it uses a brand-name specification limited to a single manufacturer due to unique proprietary characteristics not available from competitors, including the precise 550 kg load rating, model-specific structural configuration, and required standard white finish for compatibility with existing equipment.

Market research was conducted to identify alternative sources and comparable units meeting the defined specifications; however, no competing manufacturers offered products providing the complete set of required technical specifications. The contracting officer determined that alternate products cannot integrate with currently fielded systems without significant modification and would create unacceptable safety, compliance, and performance risks. This is a service-disabled veteran-owned small business (SDVOSB) set-aside acquisition conducted under FAR Part 13 Simplified Acquisition Procedures, with solicitation number 36C25526Q0596. Prospective offerors must be registered in the System for Award Management (SAM) and certified through the Small Business Administration Veteran Certification website, with NAICS code 334519 and a size standard of 600 employees.

IMMO Weight Testing Cart 36C255-26-AP-3226 VHAPG Part 813.106 Simplified Acquisition Procedures: Soliciting for a Brand Name Justification for SAP under the SAT

DEPARTMENT OF VETERANS AFFAIRS

Justification for Brand Name Awards IAW FAR 13.106-1 For Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C255-26-AP-3226

1. Contracting Activity:

Department of Veterans Affairs (VA), Veterans Integrated and Service Network (VISN) 15, Network, Contracting Office (NCO) 15. Rolla, Missouri Multispecialty Community Based Outpatient Clinic 13063 Old Wire Outer Rd Rolla, MO 65401. 2237# 589-26-4-7311-0324.

As explained in FAR 6.302-1(c), an acquisition that uses a brand-name description does not provide for full and open competition:

(c) Application for brand-name descriptions.

(1) An acquisition or portion of an acquisition that uses a brand-name description or other purchase description to specify a particular brand-name, product, or feature of a product, peculiar to one manufacturer-

(i) Does not provide for full and open competition, regardless of the number of sources solicited; and

(ii) Shall be justified and approved in accordance with 6.303 and 6.304.

Additionally, if the acquisition uses a brand-name description, the FAR requires the justification to be included with the solicitation (i.e. the contracting officer shall). FAR 5.102(a)(6):

(6) When an acquisition contains brand name specifications, the contracting officer shall include with the solicitation the justification or documentation required by 6.302-1(c), 13.106-1(b), or 13.501, redacted as necessary (see 6.30

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

The sole source requirement is for the procurement of the IMMO 100902 IMMO WLT 550kg/1,210lb & 100613 Strap and hardware kit in standard white unit. This item is required to meet project‑specific load, compatibility, and configuration standards essential for safe and successful mission execution. The acquisition will be a Firm‑Fixed Price purchase to obtain the required IMMO model and strap and hardware kit, which provides the exact technical specifications necessary for integration with existing systems and equipment.

Estimated total contract value: $16,048.00

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

The IMMO 100902 IMMO WLT 550kg/1,210lb in standard white and 100613 Strap and hardware kit possesses several proprietary characteristics not available from competing manufacturers. These include the precise 550 kg (1,210 lb) operational load rating, model‑specific IMMO WLT structural configuration, and the required standard white finish needed for compatibility and uniformity with existing equipment. Competing brands do not provide the exact combination of load capacity, structural design, or validated finish requirements. Additionally, alternate products cannot integrate with currently fielded systems without significant modification, resulting in unacceptable safety, compliance, and performance risks. Due to these unique, manufacturer‑specific attributes, only the IMMO 100902 IMMO WLT model and 100613 strap and hardware kit meets all required technical specifications necessary for the project.

4. Description of market research conducted and results or statement why it was not conducted:

Market research was conducted to identify potential sources capable of providing an item meeting all of the defined specifications. Searches for comparable units with the same load rating, IMMO WLT structural configuration, and required standard white finish identified multiple manufacturers producing similar categories of equipment. However, none offered a product meeting the complete set of required specifications.

Vendor research revealed that competing brands either lacked the precise 550 kg/1,210 lb validated load rating, offered incompatible configurations, or did not provide a standard white finish aligned with project requirements. A review of available commercial products showed no alternative that provided full compatibility with existing systems.

Based on the results of the market research, only the IMMO 100902 IMMO WLT 550kg/1,210lb standard white unit and Strap and hardware kit meets the required specifications, making it the sole known source capable of fulfilling the requirement.

Contracting Officer's Certification: Based on the analysis of the market research and historical data, the Contracting Officer does not have an expectation that two or more SBA VETCERT VeteranOwned small business concerns will submit offers.

Paul Dixon Contracting Officer
