About this file

This document is a Single Source Justification (SSJ) for a sole source procurement by the Department of State's WRAIR Europe-Middle East (WRAIR-EME) laboratory. The requirement is to purchase consumable microbiology laboratory supplies from BioMerieux, specifically compatible with their Vitek MS Prime, Vitek 2, and BioFire FilmArray automated testing systems. The total estimated contract value is $97,364.00, including options, with monthly deliveries of consumables requiring at least 28 days of shelf life upon delivery.

The justification emphasizes the unique requirements of the laboratory, noting that alternative products would necessitate costly additional components and potentially compromise data quality. The procurement is being conducted as a brand-name sole source acquisition under FAR 13.106-1(b)(1), with the Contracting Officer determining that only one source is reasonably available. The procurement will support WRAIR-EME's surveillance activities by ensuring consistent, region-specific, high-quality testing capabilities. The document is signed by the Director of Logistics and the Contracting Officer from the American Embassy in Tbilisi, with both certifying the accuracy and completeness of the information.

Department of State Contracting Activity ☒ Overseas Post Tbilisi

Requiring Activity WRAIR Europe-Middle East

SECTION 2: NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED

Approval is requested to award on a sole source basis to Name Brand Justification for the supplies and/or services described in Section 3 on behalf of the Requiring Activity.

SECTION 3: DESCRIPTION OF SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS

The requirement is to provide consumables for microbiology laboratory work at WRAIR - EME. The estimated value for the entire period of performance is $97,364.00, including options. These supplies/services require that purchased supplies are compatible with the automated test systems/devices on hand at WRAIR - EME, such as Vitek MS, Vitek 2 and BioFire FilmArray. Items should be provided by authorized dealer and should have no less than 28 days of shelf life at the moment of delivery. Consumables should be delivered monthly in accordance with the provided schedule. This will allow the Office of WRAIR – EME to accomplish identification and testing of study specimens collected under the various surveillance activities, as part of WRAIR – EME’s mission.

SECTION 4: IDENTIFICATION OF THE STATUTORY AUTHORITY PERMITTING OTHER THAN

FULL AND OPEN COMPETITION

In accordance with Federal Acquisition Regulation (FAR) 13.106-1(b)(1), the Contracting Officer has deemed only one source reasonably available based on the following:

☒ Brand-name

SECTION 5: DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE

QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY

CITED

WRAIR – EME laboratory is equipped with the laboratory devices/automated systems manufactured by BioMerieux: Microbiology analyzer Vitek MS Prime, Vitek 2 and BioFire FilmArray. Requested consumables, of BioMerieux production, are specifically designed to operate equipment on hand. The selection of these specific items is based on the preceding extensive laboratory work to identify and select the most suitable, best- performing test kits among different manufacturers, able to produce region-specific high - quality data.

Using alternate products will result in the need to acquire additional components that would be cost prohibitive. Purchase of consumables from a manufacturer, other than requested, has a high probability of not obtaining similar quality data due to reagent specificity. In addition, it is important to use the same test kits through the study in order to collect data comparable with the previous results and perform proper data analysis.

SECTION 6. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST

TO THE GOVERNMENT IS FAIR AND REASONABLE

By signing the justification, the Contracting Officer makes a determination that the price to the Government is anticipated to be fair and reasonable.

SECTION 7. CERTIFICATIONS
