About this file
This is a Memorandum for Record documenting a brand-name justification for a limited source acquisition under FAR 12.102(a) procedures. The 109th Airlift Wing Logistics Readiness Squadron requires a Waterous CP-5 water pump (Serial Number 154766) as a replacement component for a P-23 Aircraft Rescue and Fire Fighting (ARFF) vehicle to restore it to operational status. The total estimated acquisition value is redacted in the document.
The justification establishes that only the Waterous brand pump is technically acceptable because the P-23 crash-rescue truck is custom-engineered specifically around the OEM Waterous pump's physical footprint, mounting brackets, intake/discharge plumbing, and drivetrain connections. Substituting alternative manufacturers' pumps (such as those from Hale or Darley) would be technically infeasible, as they would not physically fit within the pump compartment or interface with the vehicle's split-shaft transmission and Power Take-Off driveline. Retrofitting a different brand would require extensive depot-level chassis modifications and custom plumbing fabrication exceeding the cost of the replacement pump itself and causing unacceptable operational delays that would compromise airfield safety. Market research identified at least two small business Waterous distributors capable of providing the OEM pump, ensuring competition among authorized vendors. The Contracting Officer determined the Waterous CP-5 water pump as the only brand reasonably available to fulfill the Government's requirement, with a brand-name solicitation to be posted to SAM for competition among authorized small business Waterous distributors.

MEMORANDUM FOR RECORD
Subject: Brand-Name Justification (FAR 12.102(a)) – OEM Waterous Bran Replacement Pump for P-23 Airfield Crash-Rescue Truck
Purpose: The purpose of this memorandum is to document the basis for a brand name limited source acquisition utilizing the procedures at Revolutionary FAR Overhaul (RFO) 12.202(a). The Government has determined that only a Waterous brand pump will be fully compatible with the existing fire truck without substantial duplication of cost and unacceptable safety risks.
Description of Supplies/ Services: The 109th Airlift Wing Logistics Readiness Squadron has a requirement for a Waterous CP-5 Pump for a P-23 Fire Truck (Serial number 154766). The total estimated value is .
Circumstances Limiting Competition: This brand-name requirement is for a replacement Waterous CP-5 water pump (Serial Number 154766) to restore a P-23 Aircraft Rescue and Fire Fighting (ARFF) vehicle to operational status. The P-23 crash-rescue truck is custom-engineered around the exact physical footprint, mounting brackets, intake/discharge plumbing, and drivetrain connections of the OEM Waterous pump. Substituting an alternate manufacturer's pump is technically unacceptable because it would not physically fit within the pump compartment, nor would it mate with the vehicle's specific split-shaft transmission and Power Take-Off (PTO) driveline. Attempting to retrofit a different brand would require extensive, depot-level chassis modifications and custom plumbing fabrication that would exceed the cost of the replacement pump itself and cause an unacceptable delay, thereby keeping this flightline emergency asset out of service and compromising airfield safety.
Market Research: Market research was conducted to identify potential sources. While other major fire pump manufacturers exist (e.g., Hale, Darley), none can provide a drop-in replacement that conforms to the physical, mechanical, and technical constraints of the P-23’s existing OEM configuration. Waterous distributors capable of providing the OEM pump, ensuring adequate competition among vendors for this brand-name item.
Determination: Based on the foregoing, I hereby determine that the Waterous CP-5 water pump is the only brand reasonably available of fulfilling the Government’s requirement. brand-name solicitation will subsequently be posted to SAM to be competed among authorized
Waterous distributors.
