FAR Part 6 Justification and Approval for Other than Full and Open Competition

1. Contracting Activity: 145th Airlift Wing MSG/MSC

2. Description of Action: 145th Civil Engineer Squadron requests the inclusion of brand name Alerton equipment/systems in solicitation W50S87-21-B-5055 for the Replace Chiller at the 145th Airlift Wing Charlotte, NC. The Government projects award for 2021 and fiscal year 2021 Operations and Maintenance funds will be used.

3. Description of Supplies/Services: The item required to be brand name is Alerton Direct Digital Controls (DDC). It is a state of the art building automation system, which adds efficiency to the heating, ventilation, and air conditioning (HVAC) systems by being able to monitor and control air handling units in all buildings from one (1) main location.

4. Authority Cited: 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Reason for Authority Cited: As described at FAR 6.302-1(a)(2), when the supplies or services required by the agency are available only from one responsible source, or for DoD, NASA and the Coast Guard, from only one or a limited number of responsible sources, and no other types of supplies or services will satisfy agency requirements, full and open competition need not be provided for. As further described in FAR 6.302-1(c), an acquisition or portion of an acquisition that uses a brand-name description or other purchase description to specify a particular brand-name, product, or feature of a product, peculiar to one manufacturer does not provide for full and open competition, regardless of the number of sources solicited; and shall be justified and approved in accordance with FAR 6.303 and 6.304.

The 145th Airlift Wing currently employs Alerton DDC equipment and software as a base wide installation standard to create uniformity and standardization with the HVAC control systems already in place. The use of a different DDC software will not enable the existing base standard software currently employed at the 145th Airlift Wing to communicate with an alternate manufacturer. To install another manufacturer's equipment/systems would require substantial duplication of cost to the Government not expected to be recovered through competition. In addition, unacceptable delays in fulfilling the agency’s requirements would result.If an alternate is used it will create an additional requirement to provide a software package that communicates between manufacturers that will result in an undue burden to the Government and will cost approximately $1M to remediate.

Sixteen facilities currently utilize (or are in the process of installing) the Alerton equipment and software, 25 at Charlotte and 3 at Stanly County. To convert the current 28 facilities utilizing the Alerton software to another manufacturer it is estimated to cost $8M. There are currently 36 buildings at Charlotte and 49 buildings at Stanly County. The same justification and authority has been used in every solicitation and resulting contract that includes an HVAC scope (see paragraph 10 below for further information).

6. Efforts to Obtain Competition: As this is a brand name requirement, this justification will be included with the solicitation as required by FAR 5.102(a)(6).

Solicitation W50S87-21-B-5055 for the subject project will be issued as a small business set-aside and will be posted through the Government-wide point of entry located at www.beta.sam.gov.

7. Actions to Increase Competition: The Government will continue to seek out vendors proposing cost-effective solutions that meet the Government's needs.

Additionally, we will continue to conduct market research to find equipment/systems that are not proprietary in nature.

8. Market Research: A recent discussion with an Alerton representative indicated that no other manufacturer’s equipment/systems will integrate with existing Alerton equipment/systems which are currently in use at the 145th Airlift Wing.

9. Interested Sources: Not applicable.

10. Other Facts: Recent examples where Alerton DDC system was included/installed with a construction project include:
