About this file

This document is a Sole Source Justification for the Department of Veterans Affairs (VA), specifically for the Michael E. DeBakey VA Medical Center (MEDVAMC). The VA is seeking to procure a TrackCore Intelligent Cabinet and Annual Maintenance/Support through a Firm-Fixed Price contract with four option years. The justification cites FAR 13.5 Simplified Procedures for Certain Commercial Items, with the primary rationale being that only one responsible source (LPIT Solutions, Inc.) can provide the required items compatible with MEDVAMC's existing system.

The TrackCore Implant and Tissue Tracking system enables bidirectional tracking of implants from donor to patient, helps manage inventory, supports recall management, and provides real-time reporting of stock levels. Market research included an RFI/Sources Sought issued on sam.gov in May 2025, database searches across multiple platforms, and confirmation that Four Points Technology LLC is an authorized distributor. The medical center argues that replacing the current system would result in substantial additional costs, including server replacements, and that continuing with the existing TrackCore brand minimizes patient care disruption while maintaining regulatory compliance.

TrackCore Intelligent Cabinet and Annual Maintenance/Support Request for Brand Name Justification >SAT

DEPARTMENT OF VETERANS AFFAIRS

SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR CERTAIN

COMMERCIAL ITEMS IN ACCORDANCE WITH FAR 13.5

Acquisition Plan Action ID:

1. Contracting Activity: Department of Veterans Affairs, Network Contracting Office (NCO) 16, located at 5075 Westheimer Rd., Ste. 750, Houston, TX 77056. Program Office: Michael E. DeBakey VA Medical Center (MEDVAMC) located at 2002 Holcombe, Blvd, Houston, TX 77030. Purchase Request Number

2. Nature and/or Description of the Action Being Processed: MEDVAMC’s medical careline is seeking to procure a brand name only TrackCore Intelligent Cabinet, along with Annual Maintenance/Support. This will be a Firm-Fixed Price contract including four (4) option years. The estimated total value of this contract is

3. Description of Supplies/Services Required to Meet the Agency’s Needs: MEDVAMC requires an Intelligent Cabinet and License Software to effectively and efficiently manage and track their biological and non-biological implant inventory. The facility uses the TrackCore Implant and Tissue Tracking system, which has been reviewed by the Joint Commission Resources. This system assists MEDVAMC in meeting regulatory agency and VA requirements for implants.

In addition, this system facilitates bidirectional tracking of all implants and products from donor to facility to patient and back, ensuring compliance with Joint Commission standards.

It enables users to swiftly and accurately retrieve implant information related to recalls, manage inventory, and identify patients impacted by recalled implants. Additionally, the system offers real-time reporting of current stock levels, alerts for expiring products, and cost management capabilities, among other features.

Lastly, the system maintains FDA/AATB certificates and Instructions for Use (IFU) for each vendor and provides the option to upload other relevant documents.

4. Statutory Authority Permitting Restricted Competition:

FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:

(X) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

Market research has revealed that only one responsible source is available, and no other supplies or services will meet the agency's requirements. LPIT Solutions, Inc. is the only provider capable of supplying the required items that are compatible with the current system

Page 2 of 4 Effective Date: 11/15/24 used by MEDVAMC. LPIT Solutions, Inc., a large business, exclusively owns the TrackCore Intelligent Cabinet technology used by MEDVAMC. The necessary equipment can be obtained directly from the OEM and/or one of their authorized distributors.

Additionally, it is more advantageous for the Government to replace cabinet units that have reached the end of their lifecycle rather than investing in an alternative cabinet and RFID system. Replacing this system now would result in a duplication of costs that cannot be recovered through competition. If the facility were to procure a brand name or equivalent, it would necessitate replacing all servers currently used by MEDVAMC, leading to substantial additional costs for the Government.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: An RFI/Sources Sought was issued on sam.gov May 29, 2025, with responses requested by June 04, 2025, with the posting remaining available through June 14, 2025. Additionally, the CO queried the following databases: VetCert, AbilityOne, General Services Administration (GSA) Federal Supply Schedule (FSS) e- Library, VA NAC, Medical Electronic Catalog (ECAT), VA Supply Chain Master Catalog (SCMC), System for Award Management (SAM), Federal Procurement Data System (FPDS), and SBA Dynamic Small Business Search (DSBS) per VHAPG Part 810.001 Market Research (all results documented in paragraph 8 below).

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: One (1) quote is expected; therefore, a price analysis was conducted to determine price is fair and reasonable IAW FAR 13.106(a)(2). The CO compared proposed price to IGCE, and market value of an award made for similar requirement. Contract number 36C25622P0808 awarded to Four Points Technology LLC, a SDVOSB.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: VetCert was searched using the applicable NAICS code 339112. The search showed 666 certified SDVOSB/VOSBs. VHA strategic contracts and Ability One were searched but the required products are not available via those sources.

First, on May 29, 2025, an RFI/Sources Sought was issued on sam.gov with responses requested by June 04, 2025, and the posting remained available through June 14, 2025, prior to archiving. The intent of the RFI was to 1) Determine the availability of sources who could provide the exact brand name for the required cabinet and 2) Determine the availability of sources who could provide item determined to be equivalent cabinet. The posting was essentially an intent to establish sources, and it was stated in the RFI that responses would be used to determine the future formal procurement strategy. One (1) response was received from Four Points Technology LLC, an authorized SDVOSB distributor of TrackCore products stating they could provide the exact cabinet needed to satisfy this requirement. Second, the CO searched FPDS-NG for past purchases under the keyword “TrackCore Intelligent Cabinet”, and uncovered similar requirements were previously procured via contract numbers 36C25622P0808, 36C25621P0957, and 36C25621P0877 all were awarded to Four Points Technology LLC. Third, the CO searched GSA eLibrary under the keyword “TrackCore Intelligent Cabinet” with no results found. Finally, ECAT and the VA Supply Chain Master Catalog were searched but no results were forthcoming.

b. One Level Above the Contracting Officer (Required over SAT but not exceeding $750K): I certify the justification meets requirements for other than full and open competition.
