Justification for Brand Name Products
Date: September 16, 2021
Project: GLCA FY22 Replacement & Installation of Hite Fuel Dispenser
1. Identifications
a. Agency: National Park Service
b. Contracting Office: Arizona Major Acquisition Buying Office
2. Description of the action being approved:
The National Park Service (NPS) intends to solicit for and award a firm-fixed priced, construction contract for the Replacement & Installation of Hite Fuel Dispenser located in Glen Canyon. The project requires the use of brand name products for the fuel dispenser and associated software. In accordance with FAR 6.302-1(c)(1), this document justifies and approves the use of a brand-name description to specify a particular brand-name that is particular to one manufacturer. This written justification provides approval for limiting competition to the listed brand name products as authorized by the Federal Acquisition Regulations (FAR).
3. Description of supplies and services:
The Hite Fuel Station located in Glen Canyon requires the removal and installation of a new Gilbarco dispenser (EN- 700NL1-02 Gilbarco Encore NL-1 700S 3+1 Blender Dispenser EMV Compliant, PA04190008 Z-P00-MEDH00 Gilbarco Passport EDH2 Enhanced Dispenser Hub with Windows 10 – 4G DRAM – 256G SSD, and EN01001 GA389 Encore Canopy Kit Sinclair Centennial). Upgrade Gilbarco Passport software to Version 20 (M01462K002T Gilbarco Passport PS60 V20.01 Windows 10 Server/Combo Install Kit with SSD and Licenses) and install new Mako box. Install new BRCM in back room (PA04220000022B Gilbarco Distribution Box w/ backroom communication module 2 with security bracket w/o
SSOM 110V).
4. Authority:
a. 41 U.S.C. 3304(a)(1): Application for brand-name descriptions.
b. FAR Part 11.105: The Brand Name products are essential to the Government’s requirements, and market research indicates other companies’ similar products do not meet and cannot be modified to meet the agency’s needs.
c. FAR 6.302-1(c): The use of the name brand products is essential to the Government’s requirements, thereby precluding consideration of a product manufactured by another company.
5. The description of the product’s unique qualifications or the unique nature of the acquisition:
Gilbarco is the only manufacture that can provide the necessary fuel dispenser that can be incorporated into current system. No other manufacture can provide a compatible fuel dispenser and software requirements that Gilbarco can provide. The use of another product would require an entire overhaul of the fuel station systems and would be cost prohibitive as current components would be replaced that have not reached the manufacturer’s specified life span.
Additional the fuel station must be operational and continuing with Gilbarco will ensure minimal interruptions and provide a seamless integration of a new fuel dispenser. Any benefits that could be gained by changing to a different manufacture would be negated by the cost of making the change, which is not feasible, and would not be recoverable.
6. Efforts to obtain competition:
a. Efforts to ensure offers are solicited from as many potential sources as is practicable:
In an effort to maximize competition, a search utilizing the Small Business Dynamic Search resulted in four (4) small businesses within close proximity of the project that can accomplish the necessary work. For acquisitions over $25,000 the solicitation will be issued on the Government’s Point of Entry, SAM.gov.
