About this file
This is a Determination and Findings (D&F) document authorizing a brand name procurement for an Oshkosh transfer case replacement part. The 5th Logistics Readiness Squadron requires a replacement transfer case for a 2020 Oshkosh HB2723CZ-GOP Snow Removal Truck. The procurement is restricted to Oshkosh brand parts due to patented specifications unique to the manufacturer; replacement parts from other transfer case manufacturers would have incompatible connections and would not function with the existing government truck, making interoperability infeasible.
The contracting officer, Keri D. Meis, determined that the brand name restriction is essential to the Government's requirements and in the best interest of the United States Government. To encourage competition within the brand constraint, the solicitation will be posted to SAM.gov to reach authorized Oshkosh parts distributors. Future procurement strategies will evaluate opportunities to reduce brand name dependency based on the operational life of the snow removal truck and the type or brand of replacement vehicles the Air Force purchases going forward. The determination was signed on 18 August 2026 under the authority of FAR 12.102(a).

DETERMINATION AND FINDINGS
BRAND NAME OSHKOSH TRANSFER CASE ACQUISITION
18 August 2026
1. AUTHORITY:
This Determination and Finding (D&F) is prepared in accordance with the authority of RFO 12.102(a), which permits the use of a brand name specification when it is essential to the Government's requirements, thereby restricting competition.
2. FINDINGS:
1. Description: The 5th Logistics Readiness Squadron (5 LRS) has a requirement to purchase a replacement transfer case for a 2020 OshKosh HB2723CZ-GOP Snow Removal Truck.
2. Requirement for Brand Name: Is due to the Patent of the Item. Oshkosh is the manufacturer of the snow removal truck and has patented specifications that no other company is allowed to copy and/or sell under any other name. Replacement parts manufactured by any other company that makes transfer cases will have different connections that will be inoperable with the Government’s Oshkosh Snow Removal Truck.
3. Efforts to Obtain Competition: There are several authorized distributors that sell
OshKosh manufactured parts. The solicitation will be posted to SAM.gov to encourage competition.
4. Steps to Preclude Future Brand Name Awards: Future brand name awards will be dependent on the life of the snow removal truck. Opportunities to preclude brand name awards will be dependent on the type/brand of replacement vehicles purchased by the Air Force in the future.
3. DETERMINATION:
Based on the findings above, I hereby determine that the procurement of the transfer case for the OshKosh Snow Removal Truck on a brand-name basis is essential to the Government’s requirements and is in the best interest of the United States Government. The need for interoperability and the leveraging of existing government investments preclude the consideration of products from another manufacturer.
