About this file
This document is a Brand Name Determination using Simplified Acquisition Procedures (SAP) for the replacement of antifouling bottom paint for the NOAA P/V F3901 vessel. The required paint must be copper free and compatible with the aluminum hull. Market research indicates the only brand that meets these requirements is SeaVoyage Copper Free Antifouling Paint N51B301 Black or N51R301 Red. The rationale provided is that this brand is essential, compatible with existing systems, and the sole source. A related federal contract opportunity has been issued as Solicitation Number 1333MF24Q0086 for the Bottom Paint for NOAA Vessel P/V F3901. This is a 100% small business set-aside under NAICS code 336611 with a 1,300 employee size standard. Quotes must be submitted electronically by 11:00 A.M. Eastern on July 10, 2024, with the anticipated award date on or about July 12, 2024. The acquisition will be awarded as a firm fixed price order under Simplified Acquisition Procedures.

BRAND NAME DETERMINATION USING
SIMPLIFIED ACQUISITION PROCEDURES (SAP)
FOR AN ACTION NOT EXCEEDING THE SIMPLIFIED ACQUISITION THRESHOLD
(AUTHORITY: FAR 13.106-1(b)(1))
143011-24-0222
1. Agency and contracting activity. Department of Commerce, NOAA Acquisition and Grants Office
(AGO), Fisheries OMB Field Delegates and NMFS OLE PID
2. Description of supplies or services required to meet agency needs (including the estimated value).
Current needs require replacement of antifouling bottom paint for the NOAA P/V F3901. The paint is required to be copper free which is environmentally friendly and the only paint that can be used on an aluminum hull.
3. Identification of the single source or the brand name to be solicited.
SeaVoyage Copper Free Antifouling Paint: N51B301 Black or N51R301 Red.
4. Supporting rationale. Only one source or brand name is reasonably available as detailed below:
o Brand Name – This particular brand name is essential to the requirement and market research indicates similar products do not meet or cannot be modified to meet agency needs. The vessel was previously painted with SeaVoyage Copper Free Antifouling Paint N51R301 Red. To ensure paint warranty, proper bonding, and less cost (use of any other brand would cause the current paint to be sand blasted off, which would be a significant increase in cost) the only paint available that fits into this category is SeaVoyage Copper Free Antifouling Paint: N51B301 Black or N51R301 Red.
o Compatibility to existing systems or equipment - The required supplies must be compatible in all aspects (form, fit, and function) with existing systems or equipment, and the source is uniquely qualified to meet the requirement.
o Exclusive Licensing Agreement/Restrictive Rights/Authorized Reseller - The source has one or more of the following: an established exclusive licensing agreement, proprietary data, limited rights in data, patent rights, OEM required certifications or OEM authorized reseller, copyrights or secret processes with regard to the supplies or services required.
o Urgency – The nature of the requirement has been deemed urgent due to unusual and compelling circumstances. Following competitive procedures would result in unacceptable delays resulting in serious injury to the Government.
5. Market Research.
The paint is required to be copper free which is environmentally friendly and the only paint that can be used on an aluminum hull. The only paint available that fits into this category is SeaVoyage Copper Free Antifouling Paint: N51B301 Black or N51R301 Red.
