About this file
This is a Justification for Other Than Full and Open Competition (JOFOC) supporting Modification No. 9 to Contract No. 693JK423C600010 between the Department of Transportation (DOT) and BoVision, LLC.
The modification adds 1,912 staffing hours for one full-time Mid-Level Management Analyst to support the Protective Service Division (PSD) during Option Year Three of the existing contract, increasing the Option Year Three price from $352,956.44 to $750,223.64. The analyst will also be deployed during Option Year Four. The requiring activity is DOT's Office of the Secretary (OST), Departmental Office of Intelligence, Security and Emergency Response (S-60), and the contracting activity is the DOT/OST Acquisition Services Division (M-63). The required services include operational scheduling and tracking, executive travel support documentation, data analysis and reporting, equipment and inventory accountability, Government Purchase Card and funding support, budget execution tracking, time and attendance reporting, overtime tracking, and development of standard operating procedures. The justification asserts that BoVision is the only fully capable source based on its existing performance, familiarity with DOT's financial-analysis and business-support needs, and established contract management infrastructure. The document argues that competing a separate contract would create unnecessary administrative burden, delay capability deployment, and fragment responsibility for closely related support processes critical to protecting Cabinet-level leadership. No market research was conducted, and no other sources expressed written interest. The existing contract is scheduled to end in August 2028, at which time a re-compete procurement is anticipated. The JOFOC will be published in SAM.gov either before or within the maximum allowable time after Modification No. 9 is awarded.

Justification for Other Than Full and Open Competition (JOFOC)
In Support of the Issuance of Modification No. 9
To
BoVision’s Contract No. 693JK423C600010
1. IDENTIFICATION OF THE REQUIRING ACTIVITY AND CONTRACTING ACTIVITY
AGENCY (REQUIRING ACTIVITY)
Department of Transportation (DOT) Office of the Secretary (OST) Departmental Office of Intelligence, Security and Emergency Response (S-60), Protective Service Division
(PSD)
CONTRACTING ACTIVITY
U.S. Department of Transportation/OST Acquisition Services Division, M-63 1200 New Jersey Avenue, SE Washington, DC 20590
2. NATURE/DESCRIPTION OF THE ACTION BEING APPROVED
The Department of Transportation’s (DOT), Office of the Secretary (OST), Departmental Office of Intelligence, Security and Emergency Response (S-60) has an existing Contract No.
693JK423C600010, with BoVision, LLC, for financial-and-business-management services relating to security-services that include the Protective Security Division (PSD), which provides protection for high-level DOT officials. The subject needed Modification No. 9 will increase that contract’s originally-specified Option-Year-Three price of $352,956.44 to a new cumulative total Option-Year- Three price of $750,223.64, by adding, to Option Year Three, 1,912 staffing-hours for a needed Mid- Level-Management Analyst. Further details are given in the following section numbered 3.
The Government proposes to execute bilateral Modification No. 9 to Contract 693JK423C600010, Financial Analysis and Business Support Services, with BoVision, LLC. That modification will add 1,912 staffing-hours for one full-time Mid-Level Management Analyst to support PSD during the contract’s upcoming Option Year Three. (And such a Mid-Level Management Analyst will also be deployed in the contractor’s performance of this contract’s Option Year Four.)
This proposed action does not extend the contract beyond the existing Option Year 4 end date and does not add a new protective-services mission, new performance location, or a materially different type of service.
3. DESCRIPTION OF SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY’S NEED
Based on BoVision’s historical performance and familiarity with DOT’s Financial-Analysis-and-Business-- Support needs and processes for efficiently protecting high-level DOT officials, BoVision is believed, by DOT, to be the only firm capable of performing the needed Option Year Three work at the high level of efficiency and dependability indispensable to DOT, and at the low level of risk indispensable to the Department. BoVision’s unique qualifications are specified below in this document’s section numbered 5. PSD is responsible for the safety and security of the Secretary of Transportation and, when directed, the Deputy Secretary during domestic and international travel and official engagements. PSD coordinates with Federal, State, local, territorial, and tribal authorities; supports logistical and security protocols; and supports the Secretary's role in classified continuity programs.
The added Mid-Level Management Analyst is needed to perform the programmatic, analytical, administrative, and operational support that allows protective personnel and PSD leadership to remain focused on the protective mission. Required work includes operational schedules and trackers, executive travel support documentation, data analysis and reporting, equipment and inventory accountability, Government Purchase Card and funding support, budget-execution tracking, time and attendance reporting, overtime and Administratively Uncontrollable Overtime (AUO) tracking, and development of standard operating procedures.
S-60 has expanded to approximately 72 personnel, while PSD's staffing and operational support requirements have also grown. The volume and complexity of travel, workforce, equipment, funding, and reporting activity now exceed the level that can be absorbed reliably by existing Government personnel without diverting attention from operational readiness and protective coverage.
4. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN
COMPETITION
In accordance with the Revolutionary FAR Overhaul’s (RFO’s) Part 6 (section 6.103-1), I hereby determine that the subject procurement’s contemplated Option-Year-Three work is available from only one fully-capable-and-efficient source, BoVision LLC, and that competition is precluded for the reasons indicated below. There are no satisfactory substitutes available.
5. STATEMENT DEMONSTRATING THE UNIQUE QUALIFICATIONS OF THE PROPOSED
CONTRACTOR OR THE NATURE OF THE ACTION REQUIRING THE USE OF THE
AUTHORITY
A separate competition for a single Mid-Level Financial Analyst would require a new acquisition package, solicitation, evaluation, award, security and suitability processing, system access, onboarding, and transition.
Even an expedited competition would not eliminate the time required to establish the new contractor's management controls, reporting procedures, invoicing processes, security interfaces, and working relationships with PSD and other S-60 divisions.
A second contractor performing one segment of the same business-support requirement would also create avoidable duplication. PSD and the acquisition team would have to administer separate contracts, COR oversight, invoices, quality-control processes, access requests, deliverable schedules, and records-management protocols. Responsibility for integrated trackers and reports would be divided between contractors, creating additional handoffs and increasing the risk of inconsistent data, unclear accountability, and missed or delayed actions.
The disruption is operational, not merely administrative. A gap or fragmented transition would affect the accuracy and timeliness of travel-support information, workforce and overtime data, equipment accountability, purchase and funding documentation, and management reports used to allocate people and resources. For a division supporting continuous protection of Cabinet-level leadership, these weaknesses could force protective personnel to backfill support functions at the same time operational demands are increasing.
By contrast, adding the analyst under the existing contract permits immediate integration into an established contract-management and quality-control framework. BoVision is already responsible for performance, supervision, reporting, invoicing, and compliance under the contract. Using that framework reduces transition risk, avoids duplicative contract administration, and provides a single point of accountability for related S-60 business-support services.
The proposed Modification No. 9 is the least disruptive method of obtaining the required capacity because it adds the same general type of support, for the same requiring activity, at the same location, under the same contract-management structure, and within the existing period of performance. It directly addresses an increased level of effort without creating a separate acquisition and transition structure for one position.
Competing a new contract would not simply delay an administrative convenience. It would divide responsibility for closely related support processes and create a period in which Government protective and supervisory personnel would continue absorbing work that distracts from operational readiness. The foreseeable transition, coordination, and data-integration burdens are disproportionate to the limited benefit of separately competing one within-scope analyst position for the remaining contract term.
Maintaining uninterrupted analyst support strengthens PSD's ability to preserve accurate operational information, maintain accountability of equipment and funds, manage workforce and overtime resources, and respond quickly to changing travel and protective requirements. Those capabilities support continuity in the protection of the Secretary and Deputy Secretary and, in turn, continuity of Department leadership and essential Government operations.
6. A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED
FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE, INCLUDING WHETHER A
NOTICE WAS OR WILL BE PUBLICIZED AS REQUIRED BY SUBPART 5.2 AND, IF NOT,
WHICH EXCEPTION UNDER 5.202 APPLIES
Based on the FAR and Revolutionary FAR Overhaul (RFO), and per advice given by DOT’s Office of General Counsel, this JOFOC will be published in SAM.gov—either before the subject Modification No. 9 is awarded, or else within the maximum-allowable-time after that Modification No. 9 has been awarded.
7. THE ANTICIPATED DOLLAR VALUE OF THE PROPOSED ACQUISITION, INCLUDING
OPTIONS IF APPLICABLE, AND A DETERMINATION BY THE CONTRACTING OFFICER
THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND
REASONABLE.
See sections numbered 2 and 5 above in this JOFOC.
8. DESCRIPTION OF MARKET RESEARCH CONDUCTED AND THE RESULTS OR A
STATEMENT OF REASON MARKET RESEARCH WAS NOT CONDUCTED
Market Research was not conducted because no ostensible abundance of Management-Analysis-contractor-companies would enable DOT to identify one as closely-familiar with S-60’s and PSD’s special needs as is BoVision. In an increasingly terroristic world, DOT’s high-level-officials, and the S-60 and PSD components which help to protect them, need the efficiency entailed in BoVision’s un-matched DOT-experience—and they need it now, and without disruption.
9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN
COMPETITION
None
10. A LISTING OF ANY SOURCES THAT EXPRESSED A WRITTEN INTEREST IN THE
ACQUISITION
None
11. A STATEMENT OF ANY ACTIONS THE AGENCY MAY TAKE TO REMOVE OR
OVERCOME ANY BARRIERS TO COMPETITION, IF SUBSEQUENT ACQUISITIONS ARE
ANTICIPATED
BoVision’s existing contract cannot go on forever, and it is in fact scheduled to end in August of 2028.
But in the processing of any re-compete procurement in 2028, it is not now anticipated that BoVision would be knowingly disqualified or otherwise excluded, by DOT, from joining the competition and submitting a proposal at such future time.
