About this file
This is a Worker Protection and Investment Certification Form (BOP-2201) required by the Commonwealth of Pennsylvania pursuant to Executive Order 2021-06, issued October 21, 2021. The form mandates that all contractors and grantees doing business with Pennsylvania must certify compliance with state labor, workforce safety, and unemployment and workers' compensation laws. Compliance requirements encompass thirteen specific Pennsylvania statutes and regulations, including the Construction Workplace Misclassification Act, Employment of Minors Child Labor Act, Minimum Wage Act, Prevailing Wage Act, Equal Pay Law, and various other employment-related regulations. The certification must be executed by an authorized official of the contractor or grantee and submitted to the purchasing agency.
The form establishes strict penalties for false certifications, including contract termination and three-year ineligibility to bid on future Commonwealth contracts under 62 Pa. C.S. § 531. Contractors are required to report any changes in compliance status immediately to the purchasing agency. The certification is subject to criminal penalties under 18 Pa. C.S. § 4904 for unsworn falsification to authorities. This form serves as a mandatory prerequisite for contract award and establishes an ongoing compliance obligation throughout the contract term.
