About this file

This is a Worker Protection and Investment Certification Form required by the Commonwealth of Pennsylvania pursuant to Executive Order 2021-06 for contractors and grantees seeking to do business with the state. The form mandates that all contractors certify compliance with Pennsylvania's Unemployment Compensation Law, Workers' Compensation Law, and applicable state labor and workforce safety laws, including but not limited to regulations covering workplace misclassification, child labor, minimum wage, prevailing wage, equal pay, employment medical examinations, seasonal farm labor, wage payment and collection, construction industry employee verification, healthcare overtime restrictions, apprenticeship and training, and employment records inspection. The certification must be executed by an official duly authorized to represent the contractor or grantee and submitted to the purchasing agency.

The form establishes significant penalties for false certifications, including contract termination and three-year ineligibility to bid on Commonwealth contracts under the debarment and suspension provisions of 62 Pa. C.S. § 531. Certifying officials are required to report any changes in the contractor's compliance status to the purchasing agency immediately and understand that the certification is subject to Pennsylvania's unsworn falsification statutes under 18 Pa. C.S. § 4904. The form requires the signature, date, printed name, and title of the certifying official, as well as the printed contractor or grantee name.
