About this file
This is a Worker Protection and Investment Certification Form issued by the Commonwealth of Pennsylvania pursuant to Executive Order 2021-06 for use by contractors and grantees conducting business with the state. The form applies to the Department of Conservation and Natural Resources (DCNR) project FD-01 Shale to Wirt Road, which involves the delivery and tailgate of approximately 6,000 tons of Driveway Grade Shale to Wirt Road located in Franklin County, Quincy Township. All contractors must certify compliance with Pennsylvania's Unemployment Compensation Law, Workers' Compensation Law, and applicable state labor and workforce safety laws prior to contract award.
The certification requires an authorized official to affirm the contractor's compliance with thirteen specific Pennsylvania labor statutes, including provisions related to workplace misclassification, child labor, minimum wage, prevailing wage, equal pay, employment medical examination fees, seasonal farm labor, wage payment and collection, industrial homework, construction industry employee verification, excessive overtime in healthcare, apprenticeship and training, and employment records inspection. Contractors must immediately report any changes to their compliance status to the Purchasing Agency. False certifications result in contract termination and three-year debarment from bidding on Commonwealth contracts under 62 Pa.C.S. § 531, with penalties enforceable under 18 Pa.C.S. § 4904 (Unsworn falsification to authorities). The form was published February 4, 2022.
