About this file

This is a bond forms document issued by the City of New Smyrna Beach, Florida, for use in conjunction with the T-Hangar E Renovation project. The document provides standardized templates for three types of bonds required for construction contracts: bid bonds, payment bonds, and performance bonds. The bid bond serves as a substitute for a certified or cashier's check accompanying a bid submission and requires the principal contractor and surety to bind themselves for the full bid amount. Upon bid acceptance, the principal must execute a contract within ten days of notification and provide a performance bond in an amount not less than the total contract price. The forms are designed to be completed by contractors and executed through the City's eProcurement Portal as part of the sealed bidding process.

The payment bond obligates the contractor and surety to ensure prompt payment to all subcontractors, material suppliers, and laborers involved in project work, including materials, equipment, insurance premiums, and extensions or modifications to the original contract. The performance bond guarantees that the contractor will faithfully perform all duties, undertakings, covenants, and conditions of the contract during the original term and any extensions granted by the owner, with coverage extending through a one-year guaranty period. All surety companies executing bonds must appear on the U.S. Treasury Department's current list (Circular 570 as amended) and be authorized to conduct business in Florida. Notably, the bond date must not precede the contract date, and if the contractor is a partnership, all partners must execute the bonds. The surety waives notice of any changes, extensions, alterations, or additions to contract terms, specifications, or work scope.
