Justification for Brand Name Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 553-25-063-0065

1. Contracting Activity:

Department of Veterans Affairs, Network Contracting Office 10, located at 2780 Airport Dr., Suite 340, Columbus, OH 43219, in support of the John D. Dingell VA Medical Center, located at 4646 John R Street, Detroit, MI 48201.

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

$149,532.20 The Stealth Station S8 is an intraoperative surgical navigation system that is used to guide ENT procedures. It is a computer-based workstation that loads MRI and CT scans and used an optical or electromagnetic tracking system that co-registers the patients anatomy with the MRI/CT scans and tracks sterile instruments during surgery.

3. Unique characteristics that limit availability to Brand Name Only, with the reason no other supplies or services can be used:

This is a direct replacement of the system currently in use. To keep consistency in the department, we request to entertain only the Medtronic NIM Vital in the interest of prioritizing fleet standardization. The Medical Center already owns at least one of the reusable instrument trays, and several of the M4/M5 Microdebriders as well as multiple IPC consoles, so there is no additional capital outlay for these items. The reusable instrument tray has 9 trackable instruments (a variety of suctions and probes)that have an unlimited amount of usages so there is not a “re-order” cost associated with them. No comparable competition was found to be compatible with the current system.

4. Description of market research conducted and results or statement why it was not conducted: Dr.

Searched VetCert with NAICS code 339113, and located 933 SD/VOSB vendors. Searched DSBS (quick market research) using NAICS 339113 and keywords ENT Navigation, and there were 0 vendors listed. Spoke to Medtronics (OEM, Large Business) and was advised they have 2 SDVOSB vendors, Trillamed and Veterans Healthcare Supply Solutions. The VA Rule of Two cannot be met, but the SBA Rule of Two has been met. This action will be competed Open Market, Brand Name, Small Business set-aside.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
