About this file

This document is a Non-Competitive Procurement Justification Memorandum for a naval acquisition. The procurement is for an analog to digital converter circuit card for the Noise and Vibration Monitoring Workstation, to be installed in a P/N AN/UYQ-87(P) subsystem. The item will be sourced exclusively from Coda Octopus Engineering (located in Murray, UT), which is the Original Equipment Manufacturer (OEM) and the only authorized supplier. The justification is based on the item being on the Approved Parts List (APL), with no allowed substitutions, and critical to the workstation's performance of acquiring hydrophone signals.

The memo details that alternative vendors would require significant time and cost to evaluate compatibility, including testing and software redesign, which is neither funded nor feasible within the required delivery timeline. The estimated cost of the procurement is redacted, and the document is dated 4 August 2025, with a digital signature from a Contracting Officer on 16 September 2025. The procurement follows Federal Acquisition Regulation (FAR) guidelines for sole-source acquisitions under the simplified acquisition threshold, specifically citing restrictions on brand name and proprietary rights as justification for the single-source procurement.

NSWCCD SAP Non-Competitive Procurement Justification Memo Effective April 2025

4. Other Reasons.

This item is on the Approved Parts List (APL) for the Noise and Vibration Monitoring Workstation. No substitutions are allowed for APL items and this item is only available from the OEM, Code Octopus Engineering and their authorized distributors.

If unable to procure from Coda Octopus Engineering, the Noise and Vibration Monitoring Workstation will not have the hardware it needs to acquire hydrophone signals, which is a performance requirement of the workstation, due to incompatibility with the rest of the systems.

In order to consider other products or vendors, the In-Service Engineering Agent for the Monitoring Subsystem would need to evaluate alternatives, including significant time and cost to perform associated testing and software development to redesign the system to identify compatible alternatives. Such effort is not funded nor feasible within the required delivery timeline.

B. SOLE SOURCE. (select all that apply)

1. Restrictive Rights. The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.

2. Exclusive Licensing Agreements. The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.

3. Other Reasons.

4. Federal Supply Schedules (FSS): IAW FAR 8.405-6(a)(1)

a. An urgent and compelling need exists, and following the procedures would result in unacceptable delays;

b. Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; or

c. In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order or BPA must not have been previously issued under sole-source or limited-sources procedures.
