Electronic proposals will be received by the City of Greensboro, through the Greensboro eProcurement System

(GePS) by choosing Procurement Services Contracts on the City of Greensboro’s Bidding Opportunities page:

https://www.greensboro-nc.gov/business/bidding-opportunities, until August 12, 2026, at 2:00 P.M. EST as determined by the City’s computer server for the Bingham Park Remediation Project.

Project Description and General Requirements

The work generally includes timbering, clearing and grubbing, erosion and sedimentation control, stormwater control, groundwater monitoring well and landfill gas (LFG) probe abandonment, utility management, excavation and relocation or disposal of surficial and buried waste from select areas, the installation of a protective cover soil system above waste (i.e., a nonwoven geotextile demarcation fabric above waste and 12-inches of fill above the demarcation fabric), streambank stabilization, grading, and other incidentals as shown on the Drawings and detailed in the Project Specifications. All work will be completed by the selected contractor within 16 months of the date of mobilization. The contract completion date will be extended for approved change orders or weather delays. Design

Drawings and the Project Specifications can be obtained in GePS or by contacting Rachel Kaplan, Procurement

Services Division, phone: (336) 373-2500, or email: Rachel.Kaplan@greensboro-nc.gov.

Bingham Park (the Site) consists of buried and surficial waste that is located in four separate waste disposal areas

(i.e., Areas A through D) on Parcel Identification Numbers (PINs) 7874545922, 7874559333, 7874559238, 7874559233, 7874559138, 7874641800, 7874540673, 7874542641, 7874544610, 7874545599, 7874554417, 7874458011, and 7874647410. The Site is located in Greensboro, Guilford County, North Carolina, and is accessed from Bingham Street and South English Street, adjacent to the waste disposal areas as described below.

Area A is mostly a municipal park with a manicured grass field, basketball court, and baseball field between

Bingham Street and South English Street. Maplewood Municipal Cemetery and four wooded vacant properties are located north of the park and a church and multifamily residential properties are located south of the park within

Area A. Area B is located west of Bingham Street and Area A on the southeast corner of a vacant property. Areas

C and D are located east of South English Street and Area A at the former Hampton Elementary School Site and are mostly grassed fields with trees and light vegetation.

Public water and sewer utilities service the areas surrounding the Site. Underground utilities at the Site include water, sewer, fiber optic, telephone, and electric. The surrounding properties and the Site are zoned as Traditional

Neighborhood (TN), Single-Family Residential (R-5), and Multi-Family Residential (RM-18) by Guilford County.

Immediately following Notice of Award, the Contractor will prepare and submit an Asbestos Management Plan to the North Carolina Department of Health and Human Services – Division of Public Health – Health Hazards Control

Unit (HHCU). The plan will be approved by the HHCU prior to excavating waste or removing surficial waste. The plan will include having a trained North Carolina accredited asbestos inspector observe waste excavation or surficial waste removal activities, sampling suspect asbestos containing material (ACM), keeping ACM wet to minimize emissions, using closed-cab equipment while handling materials, performing air monitoring to ensure emission controls and personal protective equipment are adequate, placing ACM in leak-tight containers, and disposing of

ACM at a permitted facility. ACM was identified at the Site during the investigation phase, including chrysotile at a concentration of two percent at five sample locations.

Notice To Bidders Page 2 of 5

Following mobilization, the Contractor will terminate electric utilities within Area A and demolish park features as shown on the Design Drawings. Temporary minimum 6-foot chain link fencing with dust cloth, locking vehicle access gates at all construction entrances, and appropriate signage will be installed prior to initiating remedial activities to control access to the Site during working and nonworking hours.

The Site will require timbering and clearing and grubbing prior to implementing remedial activities. The clearing and grubbing process will be completed in phases to control erosion and sedimentation and to limit exposed waste.

Mature trees will be timbered and transported offsite to a processing plant or disposed of at a permitted facility if the timber is not usable. Tree stumps will be temporarily left in place so that the underlying soil is not disturbed.

Vegetation from clearing and grubbing in each phase, including stumps, will be disposed of at a permitted facility.

The vegetation may temporarily be stockpiled and mulched on-site before hauling offsite for disposal. No vegetation will be burned at the Site.

Temporary erosion and sedimentation control measures will be installed following mobilization or clearing activities around the perimeter of the limits of disturbance. Temporary controls include gravel construction entrances, temporary fencing with dust cloths, wattle barriers, water bars, silt fences, super silt fences, silt fence outlets, below grade and above grade washout structures, temporary sediment traps, and temporary swales.

Temporary erosion and sedimentation control measures will be installed and maintained per the specifications and drawings.

Six groundwater monitoring wells and 10 LFG probes will be abandoned by a North Carolina licensed driller in accordance with 15A NCAC 2C.0113 Well Construction Standards. The licensed driller will submit a Well

Abandonment Record (Form GW-30) for each monitoring well and LFG probe to the North Carolina Department of Environmental Quality’s Division of Water Resources. A copy of the abandonment records will be provided to the Engineer and Owner.

A 12-inch diameter underground vitrified clay pipe (VCP) sanitary sewer line traverses the waste disposal area along the southern boundary in Area A. The VCP sanitary sewer line crosses South English Street and traverses through the center of Area C as a 12-inch diameter polyvinyl chloride sanitary sewer line. An 8-inch diameter VCP sanitary sewer line that runs north-south is also located in the center of Area D. A sanitary sewer pump-around system will be installed to pump sewage around sections of the existing sanitary sewer lines when remedial activities are being implemented in close proximity to the sanitary sewer line. Installation and operation of the sanitary sewer pump-around system will be coordinated with the City’s Department of Water Resources to obtain necessary approvals. Upon completion, the sanitary sewer pump-around system will be decommissioned by the Contractor.

Closed-circuit television video inspections of the VCP sanitary sewer line will be performed prior to initiation of the remedial activities and upon completion of phases of the remedy to assess visible damage that may have been caused by the remedy. Reports documenting pre-existing damage to the VCP sanitary sewer line and potential new damage to the line caused by remedial activities will be provided to the Department of Water Resources. If a portion of the VCP sanitary sewer line is found to have been damaged by remedial activities, the damaged portion of the

VCP sanitary sewer line will be removed and replaced with ductile iron pipe.

The waste disposal area consists of approximately 12.7 acres within Areas A through D. Based on investigation data, cover soil thickness ranges from less than 6-inches to greater than 36-inches above waste. The existing topsoil and cover soil above waste will be temporarily removed and stockpiled to allow for the installation of the protective

Notice To Bidders Page 3 of 5 cover soil system or to remove and relocate or dispose of buried waste in select locations. Approximately 28,600 cubic yards (cys) of buried waste will be removed from select locations in Area A and placed beneath the protective cover soil system. Approximately 56,200 cys of waste will be removed from select locations in Areas A through D, including within the stream, and disposed of off-site at the Great Oak Landfill located at 3597 Old Cedar Falls Road in Randleman, North Carolina (Facility Permit No. 7607-MSWLF-2015). Waste transported off-site shall be contained within lined truck beds using heavy-duty polyethylene sheeting (minimum 4–6 mil) and fully enclosed by folding and sealing the liner over the load. Materials shall be loaded in a manner that prevents damage to the liner, and all seams shall be sealed to provide a dust-tight barrier. The Contractor is responsible for ensuring no release of waste, debris, or liquids occurs during transport and that all applicable regulatory requirements are met.

Trucks hauling waste must follow the routes shown on Figure 1 to minimize traffic impacts on residential streets.

Waste removed from Areas A through D will be backfilled with soil cover material/imported common fill and compacted with heavy equipment or tamper, except along the stream.

An unnamed tributary of South Buffalo Creek is located adjacent to the southern boundary of Area B, crosses under

Bingham Street, and runs along the southern boundary of the municipal park in Area A. The stream then crosses under South English Street and flows along the borders of Areas C and D to the northeast. Intermittent drainage features are also located in the northern and southeastern portions of Area A and flow into the unnamed tributary of South Buffalo Creek. Additionally, approximately 0.01 acres of a riparian wetland is in the northeast corner of

Area A. An intermittent drainage feature is also located in between Areas C and D, which flows north into the unnamed tributary of South Buffalo Creek. Approximately 1,220 linear feet of the unnamed tributaries of South

Buffalo Creek are located within the waste disposal areas. Temporary bypass pumping may be used when excavating waste from the stream. After excavating waste from the streams, the existing slopes will be flattened to provide slope stability and stormwater control. Sewer and fiber optic utility lines are also located near the streams.

Impacts to utilities will be minimized by using engineered bank stabilization around sewer outfalls.

The Contractor will design, develop, and implement an Air Monitoring Program to detect the release of particulates and total volatile organic compounds during construction activities. Monitoring stations will be set up daily with respect to accessibility, wind direction and the potential for exposure beyond the limits of disturbance or parcel boundaries. The Air Monitoring Program will detail contaminants to be measured, measuring equipment, frequency and duration of measurements, action level, and required action. Action levels will be developed for the exclusion zone and exclusion zone perimeter and will be based on information published by the American Conference of

Governmental Industrial Hygienists, the Occupational Safety and Health Administration, and the U.S.

Environmental Protection Agency. Dust will also be controlled by wetting dry areas with potable water and by covering waste in trucks leaving the Site or trucks importing fill.

The protective cover soil system installed above waste will include an orange nonwoven geotextile demarcation fabric placed on top of compacted waste followed by 12-inches of fill above the demarcation layer. The 12-inches of fill above the demarcation fabric may include 6-inches of common fill and 6-inches of topsoil with permanent seed, or common fill amended to support grass growth may be used for the 12-inches of soil. Existing topsoil and cover soil, as well as soil used from an offsite borrow source(s), will be sampled by the Contractor per the specifications prior to placement to determine if the soils are suitable for fill and to evaluate the quality of topsoil to determine what amendments may be needed to support permanent grass growth.

Approximately 58,100 cys of common fill and 9,700 cys of topsoil are estimated to be required from a borrow source(s) to support the Project. The Contractor must select a borrow source and collect samples per the specifications and provide the results to Engineer to determine if the borrow source(s) can be used.

Notice To Bidders Page 4 of 5

Engineer has obtained the permits listed below. The Contractor is responsible for obtaining any other permits required by federal, state, or local authorities to complete the work. The Contractor is also responsible for transferring the Erosion and Sedimentation Control Permit from Engineer to Contractor after receiving the Notice of Award from the Engineer.

Details about liquidated damages has been added to Article 17.08 of Section 00 73 01 of the bid documents.

Q-002 Will Contractors be allowed to work a six-day workweek? R-002 No, all work at the site must be performed during regular working hours, 7:00 AM to 6:00 PM

(Monday to Friday).

Q-003

BF-3, Allowances states Provide Contingency Allowance in the amount of two million dollars

($2,000,000.00) in the base bid. The bid schedule does not include this allowance, therefore where should the Bidder include this (i.e., Mobilization, etc.) and is this to be included in the M/WBE utilization goals, and if so, please provide guidance on how to accomplish this goal on work that has not been identified.

R-003

The contingency allowance was added to the revised bid form. This allowance is for unforeseen conditions that may be encountered in the work and is to be used upon written approval from the

Engineer or Owner. Additionally, Minority and Women Business Enterprise (M/WBE) utilization goals are no longer required, but the Contractor should make reasonable efforts to identify and utilize M/WBE subcontractors.

Q-004

Notice to Bidders, Page 4 of 5, states “Payment will be made on a monthly basis of ninety percent

(90%) of the monthly estimates and final payment made upon completion and acceptance of the work.” North Carolina retainage statute primarily restricts withheld funds on public projects to a maximum of 5%. For projects over $100,000, retainage must stop once the project is 50% complete, provided work is progressing satisfactory. Section 00 73 01-7 is agreement with this statute. Please clarify.

R-004 Payment terms in the Notice to Bidders has been removed. Please refer to Section 00 73 01-7 of the bid documents for payment terms.

Q-005

Specification Section 311000, Page 5, Paragraph 3.5 A. 4. States “For smaller trees and other vegetation, grub and remove roots in excess of 1-1/2-inches diameter, matted roots, brush, timber, and logs to a depth of 18 inches below grade.” Is the entire 17 acres to be grubbed down to 18-inches below grade.

R-005 The intent is clear vegetation and roots. In grassed areas, grubbing does not need to extend 18-inches below grade.

Q-006

Specification Section 012200, Page 5, Item Q. Paragraph 2. States “The unit price per acre for this item will be full compensation required for grubbing as specified herein, including but not limited to:

grubbing; hauling; stockpiling of usable soils and vegetation; mulching; and disposing of grubbed material at a permitted facility.” Is it correct to assume that this permitted facility is referring to

Waste Management Great Oak Landfill and that all grubbed material (41,140 CY) within the limits of waste is to be disposed of at this location?

R-006 It is the Contractor's responsibility to find a permitted facility that accepts grubbed material. The

City of Greensboro (City) has not negotiated a rate for disposal of grubbed material.

Q-007

Plan sheet C-4 indicates Waste Excavation Area (Waste to be hauled off-site for disposal) has a soil cover volume of 1565 CY and a waste volume of 42,295 CY. Is this volume referring to soils 18” below ground surface that are being paid for under Item No. 6 Clearing & Grubbing and Disposal of

Grubbed Materials.

R-007

Clearing and grubbing in grassed areas is assumed to be less than 6 inches. The cover soil quantities listed on Sheet C-4 assume that 6 inches of cover soil will be reusable in the white areas shown on

Sheet G-3 where there is more than 1 foot of soil cover above waste. Cover soil in the gray areas is not estimated to be reusable following clearing and grubbing.

Q-008

What is the difference between Cover soil and Waste soil and how will cover soil and waste be differentiated between in the field after the initial 18” grubbing is performed since measurement of these items (Items 15 & 16) are not being measured until after grubbing is completed.

R-008 See response R-005. The intent is not to clear and grub 18 inches throughout the entire Site, only in places where necessary to remove roots.

Q-009

Since off-site disposal is measured by the ton and there is no way to determine an actual conversion rate from in-place cubic-yards to tons across the entire four (A, B, C & D) areas until after the materials are disposed of can this item be paid for in tons opposed to cubic-yards, or can the City provide the conversion rate from cubic-yards to tons for bidding purposes to allow bidders to bid on the same volume for material disposal (apples to apples)?

R-009 The Great Oak Landfill will direct bill the Owner for all disposal fees.

Q-010

Plan sheet C-4 indicates Waste to be Relocated has a soil cover volume of 1257 CY and a waste volume of 16,168 CY. What is the difference between Cover soil and Waste soil and how will cover soil and waste be differentiated between in the field after the initial 18” grubbing (removal/disposal) is performed.

R-010 See responses R-005 and -007. There is soil cover above waste. There isn't waste soil.

Q-011

Section 012200, Page 8, Item 15, Paragraph 2, Last Sentence states “The owner has a negotiated disposal rate at this landfill of $23.32 per ton (plus state tax) for this project. NC state sales tax is currently 4.75%. Is this the only tax the Contractor will be charged for disposal into WM Great Oak

Landfill?

R-011 The Great Oak Landfill will direct bill the Owner for all disposal fees.

Q-012 Is the bid quantity of 205,100 SY (~42.4 acres) correct or should this read SF opposed to SY? R-012 This amount was adjusted on the revised bid form.

Q-013

Wanted to reach out to inquire to see if there are any overlaying files like - .KMZ or .KML for overlaying into google earth / Palantir for accuracy in bidding? Thank you in advance and look forward to your response.

R-013 No overlaying files such as .KMZ of .KML are available. Note that AutoCAD files will be provided to the selected bidder.

Q-014

Based on the plans (Sheet C-7) which indicates a J-Hook arm slope ranging from 2 - 7 degrees and with the Bankfull depth as indicated of 2.6’ the arm length of the arm with a tie-in at the bankfull elevation measures 130 LF at 2o and 37 LF at 7 degrees which is a huge variable. Can the Designer provide a defined arm length or angle so that Bidders are all using the same lengths in calculating structure dimensions?

R-014

The intent is to provide the performance expectations of the J-hook while not exceeding the maximum slope of the vertical arm. As indicated in the detail the arm length shall not exceed 1/3 the width of the bankfull width with the total span not to exceed 60 percent of the bankfull width.

That being said, the bankfull width varies from 130-feet to 150-feet total bankfull width therefore the length of the arm should not exceed 53-feet at a 20 degree angle for 1/3 of the total bankfull width at a 2-degree upslope or 7-degree upslope into the bankfull bench.

Q-015

Has the State of NC determined that the above referenced site materials are indeed considered as a

Hazardous Waste (RCRA) requiring the transporter to have a current EPA ID Number (Permit) issued through NCDEQ, meet all DOT hazmat compliance requirement, have the required CDL hazmat endorsements, and material is to be shipped using RCRA Hazardous Waste manifesting requirements? Normally Hazardous Waste is required to be disposed at a permitted Hazardous

Waste Treatment/Disposal facility and may require specific pre-treatment prior to landfill disposal based on waste classification (characteristics). WM Great Oak Landfill is not a permitted Hazardous

Waste landfill. WM does own a Hazardous Waste landfill in Emelle, Alabama who is permitted to accept Hazardous Waste. Please Clarify.

R-015

The soil is not a Resource Conservation and Recovery Act (RCRA) hazardous waste. However, haulers must maintain all licenses, permits, certifications, registrations, and approvals required by applicable federal, state, and local laws and regulations. Any contractor or subcontractor responsible for the transportation of waste from the Site will be required to have specialized transportation credentials and must possess and maintain all applicable North Carolina Department of Transportation (NCDOT) and U.S. Department of Transportation authorizations, including any required Hazardous Materials (HazMat) endorsements on commercial driver's licenses and any permits necessary for the lawful transport of such materials. Contractors engaged solely in the delivery of clean soil, borrow material, fill material, topsoil, or other approved non-contaminated materials to the Site shall not be required to maintain NCDOT HazMat endorsements unless otherwise required by applicable law or the nature of the materials being transported.

Q-016

Second Bullet states “Hazardous Waste Transport Permit and/or required documents. Can Bidder use a Hauler with this permit and endorsement to meet this requirement since the hauler must carry this and it only applies to the Contractor hauling the Waste?

R-016 Yes, the bidder may use a qualified subcontractor holding the required permit and endorsement to satisfy this requirement. The Contractor is responsible for ensuring compliance.

Q-017

Forth Bullet states “Authorization to utilize a licensed hazardous waste disposal facility, fully permitted under applicable federal and state regulations. Since nothing in this contract is slated to go to a hazardous waste storage, treatment, and/or disposal facility can this be and deferred until the waste requiring hazardous waste disposal is identified and the disposal treatment and disposal requirements are known? WM Great Oak Landfill is not to the best of my knowledge permitted to treat and/or dispose of hazardous waste. Once the waste is characterized as hazardous waste, we can then determine who is permitted to accept it and can provide this form the selected facility following waste profile submission and approve.

R-017 See the response R-015.

Q-018

Section 312513, Page 8, Paragraph 2.3 A. 4. States “Depending on soil pH and design life of the securing pin, galvanized or stainless steel securing pins may be required.” Can this be determined during the bidding process, so bidders are pricing work based on the same specification.

R-018 Per specification Section 310515 imported soils will meet the manufacturers pH requirements and securing pins can be galvanized.

Q-019

Section 312513, Page 8, Paragraph 2.3 A. 2. States “Length: 12 to 24 inches as depicted on Drawings”

Can pin length and spacing for securing matting be provided to allow this be determined during the bidding process, so bidder are pricing work based on the same specification.

R-019

Pin length shall be 24 inches. In Section 312513, Part 2, Paragraph 2.3, A.2. delete the words "12 to

24 inches as depicted on the Drawings" and replace with the words "24 inches". Spacing shall be at

12-inch intervals per Section 312513, Part 3, Paragraph 3.3, B.

Q-020

"Plan Sheet C-9, Detail A, states “Add and/or Replace Existing Trees.” Base on the selected matting planting 2.5” diameter trees will require tracking machinery over matting to plant. Can 15-gallon containerized trees be used opposed to 2.5” diameter trees. All it is advisable to consider the probable mortality rate of the plants installed in the type of matting selected for this installation."

R-020

Sheet C‑9 has been updated to clarify the required tree and shrub quantities, including the specified

2.5-inch DBH trees. The contract documents do not prescribe the Contractor’s means and methods for installation. If the Contractor believes an alternate planting approach—such as the use of

15‑gallon containerized trees—would better suit their installation method or reduce potential plant mortality, they may submit a formal substitution request with supporting documentation for review in accordance with the contract requirements after selection.

Q-021 Plan Sheet C-9, Detail A, Second Tree Note states “Trees should be Bare Root or Balled and

Burlapped” (B&B). The detail appears to indicate Live Stakes and B&B. Please Clarify R-021

The staking shown in Detail A represents the planting spacing pattern only. All trees are intended to be installed as Balled and Burlapped (B&B) at the 10-foot by 10-foot spacing, and all shrubs are to be installed at the 5-foot by x 5-foot spacing. Detail C‑9 has been updated to align with the Buffer

Planting Zone Tables and now reflects B&B installation consistent with the specifications

Q-022 Plan Sheet C-9, Detail B references Install TRM along Limits of Ditch. Please provide a Plan Sheet showing ditch for length verification.

R-022

Limits of ditch are shown on Sheet C-5, approximately 675-linear feet with ditch inlets details indicated on Sheet C-9.

Q-023 Plan Sheet C-9, Detail B references a walking path. Does this path include anything in addition to

HPTRM matting installed under Pay Item 27?

R-023

Install 6-inch depth of 1/4-inch to 3/8-inch crushed stone along the walking path, per drawings 4-wide by 6-inch depth, approximately 1,300 linear feet.

Q-029

Section 012200, Page , Item 1.4 F. States restoration is not a pay item but is considered part of the work and includes paving damage. With 12,000 plus loads of soil rock and waste entering and leaving the site how will damage to pavement due to no fault of the contractor be considered?

R-029

The Contractor is required to document pre-existing conditions per the specifications. The pre-existing conditions documentation will be evaluated at substantial completion to determine if the asphalt for perimeter roads was damaged by the Contractor during the project. The Engineer's representative and Contractor personnel will also monitor the perimeter roads during the project to determine if repairs are needed prior to substantial completion. Repairs if determined necessary are the responsibility of the Contractor.

Q-030 Section 310515, Page 6, Paragraph 3.1 A. states” Excavate to the grades shown on the Drawings.”

Bid plans do not provide this information. Can these drawings be provided for bidding?

R-030

In Section 310515, Part 3, Paragraph 3.1, A. Delete the words "Excavate to the grades shown on the

Drawings." and replace with the words "Excavate to the approximate elevations shown on the

Drawings."

Q-031

Section 311000, Page 4, 3.4 B. states in locations where existing utilities cannot be crossed with interfering with the construction work as shown on the Drawings, Contractor will remove and relocate the utility as directed by the Engineer. Since utility inverts are not defined it is difficult to determine what utilities may require relocation. Can this be added as an allowance for bid comparison?

R-031 Refer to Sheet C-1 for existing utilities believed to be in the work areas.
