SECTION I. BACKGROUND, OVERVIEW, AND GOALS

A. Background

The City of Greeley is a home rule municipality with a council-manager form of government and is the county seat and the most populous municipality of Weld County, Colorado. Greeley is in northern Colorado and is situated 52 miles north-northeast of the Colorado State Capitol in Denver. According to the U.S. Census Bureau, the population of the city is roughly 111,000 which makes it the 12th-most populous city in Colorado. The City has an annual budget of ~$490M with a fiscal year that starts Jan 1st, and employees over 1,100 employees. Greeley is a major city of the Front Range Urban Corridor and home to the University of Northern Colorado which is a public baccalaureate and graduate research university with approximately 12,000 students and six colleges as well as Aims Community College, which has served the community since 1967.

B. Overview

Greeley’s Water and Sewer Department is soliciting a vendor who can assist Greeley and potential regional partners in identifying key governance, financial, operational issues and negotiation points that would need to be considered for other water providers to have an expanded stake in the Boyd Water Treatment Plant (WTP). Potential benefits for the participants should be identified and roughly quantified.

This scope of work is the first phase in what might become a facilitated negotiation to develop an intergovernmental agreement (IGA) for water providers to buy ownership capacity in the Boyd WTP or expand the current wholesale provider model currently used. This effort should focus on identifying the items that will need to be considered in an IGA and the path to completing the IGA.

C. Goals

A report should be delivered outlining options for a more regional approach to the operations, maintenance, and ownership of the Boyd WTP. Brevity will be valued in the final report. Staff are not looking for an academic product, but rather, a report that would provide actionable steps for Greeley’s Water and Sewer Department to take if it and its partners decide to pursue a regional effort.

RFP F26-10-059 Page 5 of 21 10/14/2026

SECTION II. STATEMENT OF WORK

A. Scope of Services

Background:

Greeley Water and Sewer operate two water treatment plants and one wastewater reclamation facility.

The Bellvue WTP is located near the town of Bellvue, CO and treats water sources from the Cache la Poudre River and Colorado-Big Thompson (C-BT) project. The City’s Bellvue treatment plant operates year-round and is the primary source of treated water for Greeley and its wholesale customers. The cost to produce high-quality drinking water at Bellvue WTP is about 1/3 of the cost of that at Boyd WTP. The Boyd WTP is located on Boyd Lake in Loveland and treats water from the Greeley-Loveland Irrigation Company (GLIC) and C-BT water that is delivered through the GLIC system. Boyd WTP treats water during the high-water demand months (April – October). Its production costs are higher than Bellvue WTP’s because it takes more chemicals to treat the water and it must be pumped to Greeley for distribution. Certain water rights can only be treated at specific treatment plants, making each plant needed for reasons beyond simply meeting peak system demands.

Greeley is a wholesale water provider for three municipalities in Northern Colorado: Windsor, Milliken, and Evans. Greeley, at its sole discretion, determines how the plants produce water. Because of the higher production costs at Boyd WTP, and because Greeley has ample Poudre River and C-BT supplies, the Boyd WTP’s seasonal run time has diminished in recent years, limiting the amount of GLIC water that the wholesale water customers can use.

Scope of Work:

The scope for this project is limited to identifying the issues that will need to be addressed if the parties decide to proceed with a Boyd WTP regionalism effort. Advantages and disadvantages of the different approaches to regional water treatment should be identified and evaluated at a high level.

Items that should be included in the evaluation are:

• Governance o Organizational structure options o Representation o Voting rights o Budget approval o Dispute resolution o Contract duration o Changes that may be needed to Greeley’s Code or Charter

• Finance o Division of costs – operating and capital

Cost allocation for operating the plant to the benefit of a limited number of participants

Operating cost allocation when not all partners are operating o Capacity reservations, minimum take or pay provisions o Financial reporting requirements o Evaluation of existing liabilities

Evaluation of the equitable distribution of costs for the costs of ozone treatment and pressure management infrastructure that will likely be essential to new regional partners.

RFP F26-10-059 Page 6 of 21 10/14/2026

• Water rights o Roles and responsibilities for managing the water rights accounting for water treated

Greeley will always maintain water rights accounting for production and distribution of water rights within the system.

Regional entities will be responsible for their own return flow obligations and accounting for wholly consumable effluent credits that they receive from treatment.

All entities will be responsible for water court decree accounting packages of the water rights they own and operate.

o Criteria and recommended process for determining water sources for treatment

• High level evaluation of seasonal operations vs. year-round operations o Necessary improvements to make the plant operational year-round, through cold weather;

including raw water intakes that are resilient to extended cold weather and ice. (Greeley staff will be able to provide the specific improvements needed. This evaluation will be focused on triggers and how to share costs among participants.)

o Treated water demand thresholds or triggers for year-round operations

• Any other considerations

The evaluation should review the options for Greeley as it explores regionalism approaches for the Boyd

WTP.

Options should include:

• The expansion of the wholesale provider/customer model that Greeley currently uses to include a longer run time in the spring and fall, strictly for the benefit of the wholesale customers to more fully utilize their GLIC supplies.

o The evaluation would need to value the extra run time for the Boyd WTP and how that cost would be assessed to the wholesale customers o Water right accounting would need to be addressed at a cursory level.

o A consideration of needed capital investments for a longer running season should be addressed.

o Ditch season from the Big Barnes headgate to the storage reservoirs of Lake Loveland and Boyd should be included. i.e. entities will need to manage storage of their water within the ditch company direction.

• Partial ownership rights for other water providers o The evaluation would need to consider how the Boyd WTP should be valued and the methodology the partners would use to buy into the plant as partial owners.

o A discussion of options should be included for capital investment decisions.

• Any other partnership models the vendor is aware of should be included in the report.

RFP F26-10-059 Page 7 of 21 10/14/2026

Deliverables:

A report should be delivered outlining options for a more regional approach to the operations, maintenance, and ownership of the Boyd WTP. Brevity will be valued in the final report. Staff are not looking for an academic product, but rather, a report that would provide actionable steps for Greeley’s Water and Sewer Department to take if it and its partners decide to pursue a regional effort.
