About this file

This is a Bidder Questions and Answers document issued by the State of Michigan Enterprise Procurement on behalf of the Michigan Department of Corrections for Solicitation Number 180000000437, concerning Polygraph Testing services. The document addresses eleven questions and corresponding answers related to contract requirements, with the majority of inquiries focusing on insurance obligations, reporting procedures, and use of examination templates. Key service requirements include conducting polygraph examinations at testing locations, maintaining detailed reporting through monthly aggregate reports, and utilizing state-provided templates for examiner reports rather than contractor-developed formats. The document references Standard Contract Terms, reporting requirements outlined in Section 4.3, and clarifies that certain previously required reports (Program Managers Report and Monthly List of Disclosures) are no longer necessary.

The document clarifies several cost and compliance considerations for prospective bidders. Insurance requirements, which generated significant bidder concern regarding expense and necessity, have been reviewed and reaffirmed by the State's Risk Manager and include professional liability insurance of $1,000,000 per occurrence and $1,000,000 annual aggregate, employers liability insurance (a statutory requirement under the Workers' Disability Compensation Act), cyber liability insurance for protection of sensitive material and confidential information, and motor vehicle liability insurance for any vehicles used in contract performance. The State explicitly confirmed that cyber liability coverage is mandatory despite bidder assertions that laptop devices lack internet connectivity and remote access capabilities, as data breach and physical file loss risks necessitate protection for both parties. All reporting templates and examination formats must be provided by the MDOC Program Manager, with contractors prohibited from using alternative formats.

Bidder Question
Answer (to be completed by the State)
1
Standard Contract Terms – Automobile Insurance
17
I am not transporting any employees, clients, agency, or State property. There is no company car. I am only driving myself to testing locations. Would the typical full coverage car insurance be sufficient?
There is no “typical full coverage car insurance”, it is not possible for the State to determine if this insurance would be sufficient, or not. If a motor vehicle is used in relation to the Contractor's performance, the Contractor must have vehicle liability insurance on the motor vehicle for bodily injury and property damage as required by law.
2
Standard Contract Terms – Item 6 – Insurance Requirements – General

I am concerned about the amount of insurance that is required? The total cost has been quite high and some of it seems unnecessary.
The insurance requirements have been implemented via consultation with the State’s Risk Manager and will not be removed, but may be adjusted.
3
Standard Contract Terms – Employers Liability Insurance
18
Is the employers Liability Insurance needed as all employees will have their own insurance?
Employers liability insurance is part of the workers compensation liability insurance coverage is a statutory requirement under the Workers’ Disability Compensation Act. Is it really needed? Laptops are not connected to the internet for the purpose of testing.
Yes, this insurance is needed. If your computer is somehow compromised or physical files lost, the loss of information would impact both the State and the Contractor, leaving both parties liable for any damages that may ensue from the loss of this sensitive material.
6
Standard Contract Terms – Item 6 – Insurance Requirements – Cyber Liability
18
The Privacy and Security Liability (Cyber Liability) Insurance seems excessive as well. The only device used is a laptop with an email system. I do not have a website that and there is no confidential information that can be accessed remotely.
Yes, this insurance is needed. If your computer is somehow compromised or physical files lost, the loss of information would impact both the State and the Contractor, leaving both parties liable for any damages that may ensue from the loss of this sensitive material.
7

The aggregate report asks for the number of pre-test admissions during the month. Can you provide some guidelines about the type of information that is considered a pre-test disclosure, so there can be some consistency between examiners?
Examples of type of information that is considered a pre-test disclosure are violations of special conditions –i.e. contact with minors, use of pornography/sexually stimulating materials, failure to attend treatment, etc. Also, disclosure of additional victims not previously indicated.
8
Section 4.3 – Reporting – Item A
