About this file
This is a Commercially Useful Function (CUF) Compliance Form required by the State of California for RFQ 25-221 regarding a Hamilton STARlet laboratory instrument. The form establishes mandatory requirements for small businesses, micro businesses, and disabled veteran business enterprises (DVBEs) serving as prime bidders or subcontractors on state contracts. Bidders must demonstrate their commercially useful function by providing detailed written statements addressing five key criteria: responsibility for executing a distinct element of work, actual performance or management of assigned work, performance of work normal to the business's function, responsibility for product sourcing and payment obligations, and adherence to standard industry practices regarding subcontracting limits.
The form requires separate submissions for each small business, micro business, or DVBE entity involved in the contract. Bidders must complete all five functional criteria sections with specific explanations of their role and contributions to the project. The document includes designated spaces for bidder identification, signature, date, and for subcontractor submissions, the subcontractor name and business type classification. This compliance documentation is mandatory under California Military and Veterans Code 999.5 and Government Code 14837.4(A/B) to ensure that certified disadvantaged businesses perform substantive work rather than serving as pass-through entities.
