About this file
This document contains the terms and conditions for a state-level contract opportunity for the Illinois Department of Transportation to procure newly manufactured light towers. The contract requires that all equipment be newly manufactured, with no remanufactured or reconditioned items accepted. The Department reserves the right to waive minor informalities or technical variances if it is in the best interest of the state. If equipment fails to meet specified requirements within one year of delivery, the vendor must repair or replace the equipment at no charge. Bids will only be accepted from established manufacturers or their authorized dealers. Delivery is expected by August 1, 2021, and must be invoiced before August 31, 2021, when the current funding lapses. The Department has requested that these funds roll over to the next fiscal year, but approval is uncertain. If the rollover is not approved, the contract will be extended to allow for delivery once the new funding is available.
The document does not provide pricing terms, set asides, incumbent information, or additional funding details. It focuses primarily on the technical requirements, delivery timelines, and contract administration terms.

Text version
Terms and Conditions Remanufactured Equipment: Remanufactured and/or reconditioned equipment will not be accepted. All equipment must be newly manufactured.
Waiver of Technical Variances: The Illinois Department of Transportation reserves the right to waive minor informalities, deficiencies or technical variances which by their nature are restrictive to a given manufacturer, if in its’ judgment, it would be in the best interest of the State to do so and it would not prejudice the rights of other bidders.
Inspection: If within one year after delivery, the State discovers that the equipment does not meet an awarded specified requirement, the State may require the Vendor, at no charge to the State, to repair or replace the existing equipment with equipment that conforms to the specified requirement. This provision will apply to non-conformities discovered while repairing or maintaining the equipment and which would not be evident through the routine inspection upon delivery.
Vendor/Staff Specifications: Bids will only be accepted from established manufacturers or their authorized dealers. Any dealer submitting a bid hereby guarantees that it is an authorized dealer of the manufacturer and that the manufacturer has agreed to supply the dealer with all quantities of products required by the dealer in fulfillment of its obligations under any resultant contract with the State. Bidder must submit authorized dealer letter upon request.
Delivery Instructions: Delivery shall be made F.O.B. destination during the regular work week and during established receiving hours (8:00 am to 2:00 pm) unless previous arrangements are made with the delivery location a minimum of 24 hours prior to delivery of the equipment.
The successful vendor shall contact the District 24 hours prior to delivery of the equipment.
It is expected that delivery be made and invoice received prior to 08/01/2021. Funding for this procurement lapses on 8/31/2021. However, the Department has requested that these funds rollover to the next fiscal year. It is uncertain if the Illinois General Assembly will approve the request. If the solicitation is awarded and delivery cannot be made by 08/01/2021, no purchase order will be issued unless the rollover request is approved.
If delivery cannot be made and invoice received by 08/01/2021 the Department will extend the contract date to allow time for delivery once the rollover funds have been approved.
