About this file

This is a Bid Notice for a Grade, Drain, Surface and Bridge construction project issued by the Oklahoma Department of Transportation (ODOT) for Muskogee County, extending approximately 2.463 miles north on US-69 from 0.52 miles north of the SH-165 interchange within the city of Muskogee. The project encompasses extensive roadway work including clearing, grubbing, excavation, pavement placement, bridge construction and removal, drainage installation, traffic signal and lighting systems, signing and striping, and temporary traffic control measures. The bid notice includes detailed line items across twelve sections totaling over 2,400 individual items of work with varying quantities measured in cubic yards, square yards, linear feet, tons, gallons, and each units. The project is to be let on Thursday, June 11, 2026, at 10:30 a.m., with bidding proposals available beginning May 21, 2026, and submissions accepted until June 10, 2026, at 10:30 a.m. The estimated contract time is 675 calendar days with flexible start provisions allowing work to begin anytime after Notice to Proceed issuance but no later than November 2, 2026. The contract includes three critical internal milestones with specific incentive and disincentive rates: a 375-day milestone for Station 561+00 to 656+00 at $20,000 per day incentive, a railroad bridge removal milestone allowing one weekend at $20,000 per hour incentive, and a 300-day milestone for Station 656+00 to 696+07.50 at $20,000 per day incentive.

The project is federally funded through the National Highway Performance Program (NHPP) and subject to Buy America and Build America requirements with applicable waivers reviewed under Special Provision 106-5. A 5% proposal guaranty is required, and the DBE goal is set at zero for this proposal. The contract allows subcontracting up to 70% of the contract amount, with contractors required to perform at least 30% using their own organization. Liquidated damages are assessed based on contract value ranges, with daily rates from $300 to $1,800 depending on total bid amount. Fuel price adjustments apply to eligible earthwork items with fluctuations exceeding 3% of the base price, calculated monthly using diesel fuel indices. The project includes prevailing wage requirements under Davis-Bacon wage determinations specific to Muskogee County and surrounding counties, with rates varying by classification and location. Pre-bid questions are accepted until May 29, 2026, through the ODOT pre-bid email portal, with responses posted to the ODOT Contracts & Proposals webpage. Upon award, the successful contractor must execute and return the contract within ten working days, with the Department completing execution within fourteen working days.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis‐Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.

Employees must be permitted to use paid sick leave for their own illness, injury or other health‐related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health‐related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO

PAGE 24 OF 193PROPOSAL ID : 260149

is available at https://www.dol.gov/agencies/whd/government‐contracts.

Note: Executive Order 13658 generally applies to contracts subject to the Davis‐Bacon Act that were awarded on or between January 1, 2015 and January 29, 2022, and that have not been renewed or extended on or after January 30, 2022. Executive Order 13658 does not apply to contracts subject only to the Davis‐Bacon Related Acts regardless of when they were awarded.

If a contract is subject to Executive Order 13658, the contractor must pay all covered workers at least $13.30 per hour (or the applicable wage rate listed on this wage determination, if it is higher) for all hours spent performing on the contract in 2025. The applicable Executive Order minimum wage rate will be adjusted annually. Additional information on contractor requirements and worker protections under Executive Order 13658 is available at www.dol.gov/whd/govcontracts.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (iii)).

The body of each wage determination lists the classifications and wage rates that have been found to be prevailing for the type(s) of construction and geographic area covered by the wage determination. The classifications are listed in alphabetical order under rate identifiers indicating whether the particular rate is a union rate (current union negotiated rate), a survey rate, a weighted union average rate, a state adopted rate, or a supplemental classification rate.

Union Rate Identifiers

A four‐letter identifier beginning with characters other than ""SU"", ""UAVG"", "SA", or "SC" denotes that a union rate was prevailing for that classification in the survey. Example:

PLUM0198‐005 07/01/2024. PLUM is an identifier of the union whose collectively bargained rate prevailed in the survey for this classification, which in this example would be Plumbers.

0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. The date, 07/01/2024 in the example, is the effective date of the most current negotiated rate.

Union prevailing wage rates are updated to reflect all changes over time that are reported to WHD in the rates in the collective bargaining agreement (CBA) governing the classification.

Union Average Rate Identifiers

The UAVG identifier indicates that no single rate prevailed for those classifications, but that 100% of the data reported for the classifications reflected union rates. EXAMPLE:

UAVG‐OH‐0010 01/01/2024. UAVG indicates that the rate is a weighted union average rate. OH indicates the State of Ohio.

The next number, 0010 in the example, is an internal number used in producing the wage determination. The date, 01/01/2024 in the example, indicates the date the wage determination was updated to reflect the most current union average rate.

A UAVG rate will be updated once a year, usually in January, to reflect a weighted average of the current rates in the collective bargaining agreements on which the rate is based.

Survey Rate Identifiers

The ""SU"" identifier indicates that either a single non‐union rate prevailed (as defined in 29 CFR 1.2) for this classification in the survey or that the rate was derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As a weighted average rate includes all rates reported in the survey, it may include both union and non‐union rates. Example: SUFL2022‐007 6/27/2024. SU indicates the rate is a single non‐union prevailing rate or a weighted average of survey data for that classification. FL indicates the State of Florida. 2022 is the year of the survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. The date, 6/27/2024 in the example, indicates the survey completion date for the classifications and rates under that identifier.

"SU" wage rates typically remain in effect until a new survey is conducted. However, the Wage and Hour Division (WHD) has the discretion to update such rates under 29 CFR 1.6(c)(1).

State Adopted Rate Identifiers

The ""SA"" identifier indicates that the classifications and prevailing wage rates set by a state (or local) government were adopted under 29 C.F.R 1.3(g)‐(h). Example: SAME2023‐007 01/03/2024. SA reflects that the rates are state adopted. ME

PAGE 26 OF 193PROPOSAL ID : 260149

refers to the State of Maine. 2023 is the year during which the state completed the survey on which the listed classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination.

The date, 01/03/2024 in the example, reflects the date on which the classifications and rates under the "SA" identifier took effect under state law in the state from which the rates were adopted.

WAGE DETERMINATION APPEALS PROCESS

OKLAHOMA DEPARTMENT OF TRANSPORTATION

SPECIAL PROVISIONS

FOR

BUY AMERICA AND BUILD AMERICA, BUY AMERICA

These Special Provisions revise, amend, and where in conflict, supersede applicable sections of the 2019 Standard Specifications for Highway Construction.

106.01 SOURCE OF SUPPLY AND QUALITY REQUIREMENTS (Replace with the following :)

B. Buy America and Build America, Buy America

Buy America (BA) and Build America, Buy America (BABA) requirements are in effect only on projects with federal aid risk, as identified in the contract documents. The Contractor is responsible for submitting completed Material Data Testing (MDT-1) form in accordance with Section 106.01(B)(1) regardless of the BA/BABA requirements.

An article, material, or supply should only be classified into one of the following categories: (1) iron or steel products, (2) construction material, (3) manufactured products, or (4) excluded material. An article, material, or supply should not be considered to fall into multiple categories, except as otherwise provided in Subsection 106.01.B(4)(b)(2). A material is solely classified based on its status at the time it is brought to the worksite.

Except as otherwise provided in Subsection 106.01.B(4)(b)(2) of this special provision, an article, material, or supply shall not be considered to fall into multiple categories. In some cases, an article, material, or supply may not fall under any of the above-listed categories. The classification of an article, material, or supply as falling into one of the categories listed in this paragraph must be made based on its status at the time it is brought to the work site for incorporation into an infrastructure project. In general, the work site is the location of the infrastructure project at which the iron or steel product or manufactured product will be incorporated.

(1) Iron and/or Steel Products

Comply with the Buy America provisions of 23 CFR 635.410 which states that all manufacturing processes, including the application of a coating, for all steel or iron products permanently incorporated into the project shall have occurred in the United States (U.S.).

“All manufacturing processes” are defined as any process required to change the raw ore or scrap metal into the finished steel or iron product (e.g. smelting, rolling, extruding, bending, etc.).

“Coating” is defined as any process which protects or enhances the value of the steel or iron product to which the coating is applied (e.g. epoxy, galvanizing, painting, etc.).

The Contractor is responsible for submitting completed Material Testing Data (MDT-1) for the iron and steel in following items for all projects, regardless of the BA/BABA requirements:

• Precast box culverts

• Reinforced concrete pipe and precast end sections

• Precast inlets and catch basins

• Precast manholes

• Structural steel (girders, diaphragms, anchor bolts, high-strength bolts, sealed expansion joints, etc.)

• Reinforcing steel (all types)

• Welded wire fabric

• Steel spiral wire (drilled shaft cages, bridge rail, etc.)

• Steel piling

PAGE 34 OF 193PROPOSAL ID : 260149

106-5(b-e) 19

• Drill shaft casing (permanent)

• Dowel bars and baskets for paving

• Steel sheet piling (permanent)

• Bridge bearing assemblies (fixed and expansion)

• Post-tensioning steel (strands, wedges, anchor plates, etc.)

• Steel monotube structures

• Galvanized steel supports for overhead and cantilevered sign structures

• Sign posts and bases (all sizes)

• Guardrail, guardrail posts, end sections, terminals, impact attenuators

• Intelligent transportation system or other electronic hardware system cabinets

(2) Waiver for Iron and Steel Raw Materials

The BA/BABA requirements for the following raw materials are waived in accordance with the FHWA nationwide waiver (dated March 24, 1995) for pig iron and processed, pelletized, and reduced iron ore, unless processed or refined to include substantial amounts of steel or iron material, and may be used regardless of source in the domestic manufacturing process for steel or iron material:

• Raw materials (iron ore or alloys)

• Scrap

• Pig iron

• Processed, pelletized, and reduced iron ore material

For recycled steel, only the manufacturing processes to produce steel products must occur domestically, beginning at the point where the recycled steel is melted.

(3) Minimal Use Request for Steel and Iron

Federal regulations allow a minimal use of foreign steel or iron if the cost of the steel and iron products as they are delivered to the project does not exceed 0.1 percent of the total Contract amount, or $2,500, whichever is greater. This threshold applies to the cumulative amount of all foreign steel and iron used on the project. The Contractor must track the amount of incorporated foreign steel and iron throughout the life of a project to ensure the minimal use threshold amount is not exceeded.

(4) Construction Materials

Comply with the Build America, Buy America (BABA) Act of 2 CFR 184. The following construction materials as defined in 2 CFR 184.3 must be manufactured in the United States of America. This means that all manufacturing processes for the construction material occurred in the United States of America.

• Non-ferrous metals

• Plastic and polymer-based products (including polyvinylchloride, composite building materials, and polymers used in fiber optic cables)

• Glass (including optic glass)

• Fiber optic cable (including drop cable)

• Optical fiber

• Lumber

• Engineered wood

• Drywall

For non-ferrous metals, certification requires all manufacturing processes, from initial smelting or melting through final shaping, coating, and assembly, occurred in the United States.
