RFP #26-06: Engineering Services for Riverhead Drive & Thomas Road Bulkhead Repair

This is a Request for Proposals (RFP) issued by the Town of Brookhaven, New York, Department of Highways, Division of Stormwater, seeking qualified engineering firms to provide comprehensive services for bulkhead repair and site mitigation at Riverhead Drive and Thomas Road in Sound Beach, New York. The Town requires engineering services including site assessment, topographic survey, project plans and details, engineer's estimate, environmental permit applications, construction bid package preparation, and construction oversight with part-time inspections averaging 20 hours per week over an anticipated two-month construction schedule. The project is necessitated by material seepage at joint failures between bulkheads constructed in 2006 and 2013, which has contributed to slumping of the gabion basket system. The RFP was advertised on September 10, 2026, with technical questions due by September 24, 2026, a Questions and Answers Addendum issued no later than September 29, 2026, and proposals due by October 6, 2026, at 4:30 PM. The contract term shall commence on or about October 30, 2026, and continue for two years or upon project completion. The anticipated project schedule includes winter 2026/2027 for design development, spring 2027 for regulatory permit applications, summer 2027 for construction bid services, and fall 2027 for construction commencement.

Proposals will be evaluated based on general qualifications of the firm and assigned staff (25 points), technical evaluation of project understanding and approach (45 points), and cost evaluation (30 points). Consultants must submit cost proposals using the provided template with staff hours itemized by task, including an initial scoping phase, progress reporting, engineered plans development, environmental permitting, bid services, and construction services, with a separate line item for out-of-pocket expenses such as permit fees and borings. The consultant is responsible for all permit application fees unless explicitly waived; however, the Town's wetland permit fee is waived for Town-constructed projects. The selected consultant must maintain Professional Errors and Omissions Insurance of not less than $1,000,000 per claim and $2,000,000 annual aggregate, Commercial General Liability of $2,000,000 aggregate and $1,000,000 per occurrence, and Automobile Liability of $1,000,000. Proposals must be submitted electronically through the SOVRA BidNet portal or by sealed physical delivery to the Town of Brookhaven Division of Purchasing. All proposals are at the sole expense of the responder with no reimbursement for preparation costs prior to contract award.

RFP #26-06 Page 2 of 29

I. INTRODUCTION

A. PURPOSE

The Town of Brookhaven is soliciting proposals from qualified firms / proposers to provide engineering services for the Riverhead Drive & Thomas Road Bulkhead repair project, located in the Hamlet of Sound Beach. The goal of this project is to identify structural failures and develop engineered solutions to repair points of failure along the bulkhead and the associated slumping gabion basket system situated at the toe of the slope and above the existing bulkhead.

B. BACKGROUND AND INTENT

In 2006, the Town of Brookhaven mitigated a drainage system situated in an easement located on the property of the Sound Beach Property Owners Association (0200-01300-0100-001001). The improvements included new upland drainage, a water quality unit, a new outfall pipe, pipe support, gabion baskets, and approximately 190 LF of new bulkhead that met the existing bulkhead on both sides of the project area. In 2013, and following Superstorm Sandy, the Town conducted a minor erosion control improvement project at this same location. Plans for both projects are included in this RFP as attachments.

Site inspections of the bulkhead by Town of Brookhaven staff indicate that material may be seeping through a joint failure where the two different bulkheads converge. The resultant loss of material may be contributing to slumping of the gabion basket system located above the bulkhead.

A professional engineering firm(s) is sought to assist the Town with developing engineered plans, environmental permits, construction bid services and provide construction inspection and oversight for the bulkhead repair and site mitigation measures.

Anticipated project schedule:

Winter 2026/2027 – design development.

Spring 2027 – regulatory permit applications.

Summer 2027 – construction bid services.

Fall – commence construction.

II. SCOPE OF WORK

The selected consultant will be tasked with developing engineered plans to repair the bulkhead at all points of failure, mitigate the gabion basket system, and provide site restoration as needed.

Engineering services shall include, at a minimum, site assessment, topographic survey, project plans and details, and an engineer’s estimate. Final engineered plans must be suitable for environmental permit applications and issuance of construction bids.

State and Town environmental regulatory permit applications will be required for submission to the appropriate agencies. The selected consultant will be responsible for submission and payment thereof to the applicable agencies and responding to any requests for revisions to permit applications, if warranted. (The Town’s Wetland permit fee is waived for Town constructed projects.) Coordination with the Sound Beach Property Owners Association will be required for all environmental permit applications.

RFP #26-06 Page 3 of 29

Coordination with the Town’s purchasing department will be required to prepare construction bid packages, review responses, and make recommendations for construction services. Upon selection of a contractor, the selected consultant will review and approve contractor submittals and payment vouchers, provide construction oversight and part time inspections. Part time inspections should be presumed to mean an average of 20 hours per week of site inspections as appropriate. Construction administration and review of RFIs are not included in the presumed inspection hours. Project assumes a 2-month construction schedule from mobilization to final restoration.

The selected consultant will be responsible for submitting: a proposed schedule of completion for review and approval, monthly progress reports during the planning stages of the project, weekly progress reports during the construction stages, all field meeting summaries, photo documentation of all phases of construction, all required financial documentation for payment approvals, and any documentation the Town may need to comply with the requirements of all environmental permits. Occasional office meetings, field meetings and conference calls with Town staff will be required.

Cost proposals shall be provided based on the scope of work and the following tasks:

Task 1: Initial scoping - Initial scoping shall include, but not be limited to, an exchange of information, preliminary site assessment, and proposed schedule of completion indicating deliverables at major milestones.

Task 2: Progress reports - Progress reports and meeting summaries shall include, but not be limited to, summaries of all meetings associated with the project including conference calls and field meetings. Monthly progress reports on the status of all activities should accompany monthly payment requests. Weekly email progress reports shall be sent to the project manager for the duration of the contact.

Task 3: Engineered plans - Engineered plans and construction cost estimate shall include, but not be limited to, survey work, analysis of field data, designs submitted for review by the Town at 30%, 60% and 100% design development, distribution of project plans to involved agencies, as appropriate, and probable cost estimates at each phase of design.

Task 4: Environmental permits – Environmental permits shall include the submission of project plans and permit application documents to all regulatory agencies with jurisdiction over the project area, regardless of whether the permit application type is identified in this RFP or a response thereof. Consultants are responsible for all permit application fees unless explicitly stated otherwise.

Task 5: Bid services – Bid services shall include, but not be limited to, preparation of the construction bid package utilizing the Town template, review of all bidder responses for compliance with Town requirements and providing a written recommendation of award for a construction services contract.

Task 6: Construction services - Construction oversight and inspections shall include, but not be limited to, construction inspections and reports and construction management services including review and approval of all submittals, requests for change orders, and contractor invoices submitted for payment.

Cost proposal shall include anticipated number of staff hours per task. Failure to summarize all staff hours by task, inclusive of services provided by subs, will be disqualified. A separate line item should be provided for out-of-pocket expenses such as permit fees, borings, etc. The cost proposal shall be submitted in a separate sealed envelope using the cost proposal template (Exhibit E) found on page 29.

CERTIFICATION OF COMPLIANCE WITH THE IRAN DIVESTMENT ACT

Pursuant to the Iran Divestment Act of 2012 (the “Act”), Chapter 1 of the 2012 Laws of New York, a new provision has been added to State Finance Law (SFL) § 165-a and New York General Municipal Law § 103-g, both effective April 12, 2012. Under the Act, the Commissioner of the Office of General Services (OGS) will be developing a list of “persons” who are engaged in “investment activities in Iran” (both are defined terms in the law) (the “Prohibited Entities List"). Pursuant to SFL § 165-a(3)(b), the initial list is expected to be issued no later than 120 days after the Act’s effective date at which time it will be posted on the OGS website.

By submitting a bid in response to this solicitation or by assuming the responsibility of a Contract awarded hereunder, each Bidder/Contractor, any person signing on behalf of any Bidder/Contractor and any assignee or subcontractor and, in the case of a joint bid, each party thereto, certifies, under penalty of perjury, that once the Prohibited Entities List is posted on the OGS website, that to the best of its knowledge and belief, that each Bidder/Contractor and any subcontractor or assignee is not identified on the Prohibited Entities List created pursuant to SFL § 165-a(3)(b).

Additionally, Bidder/Contractor is advised that once the Prohibited Entities List is posted on the OGS Website, any Bidder/Contractor seeking to renew or extend a Contract or assume the responsibility of a Contract awarded in response to this solicitation must certify at the time the Contract is renewed, extended or assigned that it is not included on the Prohibited Entities List.

During the term of the Contract, should the Town receive information that a Bidder/Contractor is in violation of the above-referenced certification, the Town will offer the person or entity an opportunity to respond. If the person or entity fails to demonstrate that he/she/it has ceased engagement in the investment which is in violation of the Act within 90 days after the determination of such violation, then the Town shall take such action as may be appropriate including, but not limited to, imposing sanctions, seeking compliance, recovering damages or declaring the Bidder/Contractor in default.

The Town reserves the right to reject any bid or request for assignment for a Bidder/Contractor that appears on the Prohibited Entities List prior to the award of a contract and to pursue a responsibility review with respect to any Bidder/Contractor that is awarded a contract and subsequently appears on the Prohibited Entities List.

I, ___________________________________________, being duly sworn, deposes and says that he/she is the _____________________________________________ of the _________________________________________ Corporation and that neither the Bidder/Contractor nor any proposed subcontractor is identified on the Prohibited Entities List.
