Some of these calls require changing the codes to add or remove employee names with no material costs or replace motion/door contacts that require an hour for each service call. If the time exceeds two hours, authorization must be provided from the District for any additional time and materials billing costs.

11. Alarm Company shall respond to service/repair calls from the Maintenance & Operations Department with personnel that are familiar with District sites and equipment and have proper tools and parts for repairs. This shall be at no additional charge to the District.

• False alarms should be investigated. Any false alarms that are caused by equipment failure and/or monitoring calling the incorrect respondent party will be the responsibility of the alarm company to cover any fees assessed.

• The District will assume responsibility for false alarm fees that are caused by insects, rodents or other pests. An evaluation will be required on a case-by-case basis to determine the cause and identify if the District or Contractor will be responsible for these charges.

13. Programming fees will be the responsibility of the contractor for fire alarm and intrusion systems. Some of these systems are proprietary and will require an outside contractor to program. Monitoring will be based upon a fixed cost.

14. The scope of service will require that each fire alarm needs to be monitored. The timer test will be acceptable.

Contractor and any Subcontractors engaging in work on the Project are required to review and comply with the provisions of the California Labor Code, Division 2, Part 7, Chapter 1, beginning with Section 1720, and the regulations of the Department of Industrial Relations implementing those provisions. These statutory and regulatory provisions contain specific requirements concerning for example, the determination and payment of of prevailing wages, retention, inspections and auditing of payroll records, use of apprentices, payment of overtime compensation, and various penalties for fines which may be imposed for violations of the requirements of the chapter. Submission of a bid proposal constitutes the bidder’s representation that is has thoroughly reviewed these statutory and regulatory requirements and agrees to bind every Subcontractor performing work on the Project to these requirements to the extent such requirements are applicable to the Subcontractor’s work. The District will also require active D.I.R. Registration number for each Contractor and Subcontractor. Prevailing rates of per diem wages for each craft, classification, or type of worker needed to execute the Contract, as determined by Director of the State of California Department of Industrial Relations, are available on the internet at (http://www. dir.ca.gov).

23. Bidders Interested in More Than One Bid. No person, firm, or corporation shall be allowed to make, or file, or be interested in more than one bid unless alternate bids are specifically called for. A person, firm, or corporation that has submitted a sub proposal to a bidder, or that has quoted prices of materials to a bidder, is not thereby disqualified from submitting a sub-proposal or quoting prices to other bidders or making a prime proposal.

24. Contractors’ State License Board. Contractors are required by law to be licensed and regulated by the

Contractors’ State License Board. Any questions concerning a contractor may be referred to the Registrar, Contractors’ State License Board, P.O. Box 26000, Sacramento, California 95826

25. Fingerprinting. By law it is the District’s responsibility to determine whether a contractor must provide fingerprint certification. Pursuant to Education Code Section 45125.2, the District considers the totality of the circumstances in order to determine if fingerprinting of employees of a contractor working on a school site is required. Factors to be considered include the length of time the contractor’s employees are on school grounds, whether students are in proximity with the location where the contractor’s employees are working and whether the contractor’s employees are working alone or with others. A determination regarding whether fingerprint certification is required is contained in the general conditions.

26. Code of Conduct and Fair Competition. It is the responsibility of the Bidder to notify the District

Representatives in writing of any possible conflict of interest as set forth below. Fairfield-Suisun USD will investigate the matter and determine if an actual conflict of interest exists. A conflict of interest arises when a FSUSD employee, officer, or agent involved in the RFP process or Contract has a financial or any other interest in a Bidder. If a conflict of interest exists, the Bidder may not submit a Bid. FSUSD employees, officers and agents may neither solicit nor accept gratuities, favors, or anything of monetary value from Bidder’s, Contractors, or parties to sub-agreements. Any such actions must be reported immediately.

27. Protest Procedure. The procedural guidelines to file a bid protest are outlined on the following page.

f. The bidder whose bid has been protested may submit a written response to the bid protest. Such response shall be submitted to the District Purchasing Department no later than 4:30 p.m., no later than three (3) working days after the deadline for submission of the bid protest, as set forth above, and shall include all supporting documentation. Such response shall also be transmitted concurrently to the protesting bidder and to all other bidders who appear to have a reasonable prospect of receiving an award depending upon the outcome of the protest.

g. The procedure and time limits set forth in this section are mandatory and are the bidder’s sole and exclusive remedy in the event of bid protest. The bidder’s failure to comply with these procedures shall constitute a waiver of any right to further pursue the bid protest, including filing a Government Code Claim or legal proceedings. A bidder may not rely on a protest submitted by another bidder, but must timely pursue its own protest.

h. If the District determines that a protest is frivolous, the protesting bidder may be determined to be non-responsible and that bidder may be determined to be ineligible for future contract awards by the District.
