NEISD is seeking indefinite delivery quantity responses for as-needed roof maintenance and roof-related services at facilities throughout the district, which encompasses 133 square miles in north and northeast Bexar County and serves approximately 52,200 students across 44 elementary schools, 13 middle schools, 8 high schools, and various magnet programs. The solicitation does not guarantee any purchase quantities or dollar amounts, with purchases to be made on an as-needed basis. Questions regarding the solicitation must be submitted through the Ionwave e-bidding platform by October 8, 2026 at 8:00 AM Central Time, and bid responses are due by October 15, 2026 at 9:00 AM Central Time. The initial contract term is three years from the award date, with NEISD reserving the right to extend the contract for two additional one-year renewal periods under the same terms and conditions. No work will be performed on Thanksgiving, Christmas, New Year's, or Easter, and any overtime or holiday pay must be included in unit prices with no change orders permitted for such costs.

Pricing for this IDQ is structured in two sections: Section I requires bidders to indicate a cost coefficient or multiplier (minimum 1 percent) from the RS Means Facilities Maintenance & Repair 2025 Cost Unit Price Book, and Section II requires benchmark or catalog pricing with a specified discount percentage from manufacturer, company, store, or shelf pricing. Payment and performance bonds are required for orders exceeding $25,000 and $100,000 respectively, at the vendor's expense. Bidders must provide proof of insurance naming NEISD as an additional insured upon award, complete a Conflict of Interest Questionnaire, submit HB 1295 Certificate of Interested Parties from the Texas Ethics Commission, provide a signed and notarized Hold Harmless Agreement, and complete fingerprinting packets if services involve proximity to students. The contract may be adopted by other Central Texas Purchasing Alliance (CTPA) member districts and by Judson ISD, San Antonio ISD, and Northside ISD at the same or better pricing terms. Bidders must hold certifications from major roofing manufacturers such as US Ply, Johns Manville, Firestone, GAF, Tamko, Soprema, and others. The solicitation requires compliance with multiple state and federal regulations including Texas Government Code provisions regarding boycotts of energy companies and Israel, firearm discrimination prohibitions, prevailing wage requirements under the Davis-Bacon Act when applicable, and various federal requirements related to equal employment opportunity, debarment status, and environmental compliance.

EDGAR VENDOR CERTIFICATION

When a school district seeks to procure goods and services using funds under a federal grant or contract, specific federal l aws, regulations, and requirements may apply in addition to those under state law. This includes, but is not li mited to, the procurement standards of the Uniform Administrative Requirements, Cost Principles and Audit Requir ements for Federal Awards, 2 CFR 200 (sometimes referred to as the “Uniform Guidance” or new “EDGAR”) . All vendors submitting proposals must complete this EDGAR Certification regarding vendor’s willingness and ability to comply with c ertain requirements which may be applicable to specific school district purchases using federal grant funds.

Vendor should certify vendor’s agreement and ability to comply, where applicable, by having vendor’s authorized representative acknowledge each of the eleven questions listed below. If you fail to complete any item, the district will consider and may list the vendor’s response as “No, I do not agree,” the vendor is unable or unwilling to comply. A “NO” response to any of the items may, if applicable, impact the ability of a school district to purchase from the vendor using federal funds.

In addition to the following specific requirements, vendor agrees, in accepting any purchase order from a school district, it shall make a good faith effort to work with school districts to provide such information and to satisfy such requirements as may apply to a particular school district purchase or purchases including, but not limited to, applicable recordkeeping and record retention requirements.

Vendor Violation or Breach of Contract Terms

Contracts for more than the simplified acquisition threshold currently set at $250,000, which is the inflation adjusted amount determined by the Civilian Agency Acquisition Council and the Defense Acquisition Regulations Council (Councils) as authorized by 41 USC 1908, must address administrative, contractual, or legal remedies in instances where contractors violate or breach contract terms, and provide for such sanctions and penalties as appropriate.

Except as otherwise provided for in these Terms and Conditions, either party may terminate the contract in whole or in part in the event of the other party’s substantial failure to fulfill its obligations under the contract through no fault of the terminating party; provided, however, that the defaulting party is given at least ten (10) business days prior written notice of the default and intent to terminate (delivered by certified mail, return receipt requested, or other method that similarly documents receipt), and a ten (10) business day opportunity to remedy the default to the satisfaction of the terminating party.

North East ISD will not be liable to the vendor for any damages (including, but not limited to, loss of profits or loss of business, or any special, consequential, exemplary, or incidental damages) resulting from termination based on vendor’s default or breach of contract.

If any delay or failure of performance is caused by a Force Majeure, North East ISD may, in its sole discretion, terminate the contract in whole or part, provided such termination complies with the procedures set out above. Any contract termination resulting from any cause other than a Force Majeure event will be deemed valid reason for not considering any future proposals from the defaulting Vendor.

Force Majeure includes, but is not limited to, governmental restraints or decrees, provided they affect all companies in vendor’s industry equally and are not actions taken solely against vendor; acts of God (except natural phenomena, such as rain, wind or flood, which are normally expected in the locale in which performance is to take place); work stoppages due to labor disputes or strikes; fires; explosions; epidemics; riots; war; rebellion; or sabotage.

The remedies under the contract are in addition to any other remedies that may be available under law or in equity.

By submitting a proposal, you agree to the vendor violation and breach of contract terms.

Yes, I agree.

No, I do not agree.
